2 | AMENDMENT NO. ______. Amend Senate Bill 1673 on page 1, | ||||||
3 | line 4, after "by", by inserting "changing Sections 2.11c, | ||||||
4 | 3.5, and 9, and by"; and
| ||||||
5 | on page 1, by inserting immediately below line 5 the | ||||||
6 | following: | ||||||
7 | "(510 ILCS 5/2.11c)

8 | Sec. 2.11c. Intact animal. "Intact animal" means an animal | ||||||
9 | that has not been sterilized spayed or neutered .

4 | and vaccinate feral cats in programs recognized by the county | ||||||
5 | or a municipality. This Section does not apply to a county with | ||||||
6 | 3,000,000 or more inhabitants.

11 | " Sec. 3.6. Feral cat jurisdiction and sterilization. The | ||||||
12 | Department and no other State agency has any jurisdiction over | ||||||
13 | feral cats, except that the Department of Natural Resources | ||||||
14 | has jurisdiction over cats in State Parks. "; and | ||||||
15 | on page 1, by inserting below line 12 the following:

17 | Sec. 9. Any dog found running at large contrary to | ||||||
18 | provisions of this Act
may
be apprehended and impounded. For | ||||||
19 | this purpose, the Administrator shall
utilize any existing or | ||||||
20 | available animal control facility or licensed animal shelter. | ||||||
21 | The dog's owner shall pay a $25 public safety fine to be | ||||||
22 | deposited into the county animal control fund or the county | ||||||
23 | pet population control fund. Funds transferred to or retained |

1 | by a municipality before the effective date of this amendatory | ||||||
2 | Act of the 100th General Assembly under this paragraph shall | ||||||
3 | continue to be transferred to and be retained by that | ||||||
4 | municipality. A dog found running at large contrary to the | ||||||
5 | provisions of this Act a second or subsequent time must be | ||||||
6 | sterilized spayed or neutered within 30 days after being | ||||||
7 | reclaimed unless already sterilized spayed or neutered ; | ||||||
8 | failure to comply shall result in impoundment.

9 | A dog that is actively engaged in a legal hunting | ||||||
10 | activity, including training, is not considered to be running | ||||||
11 | at large if the dog is on land that is open to hunting or on | ||||||
12 | land on which the person has obtained permission to hunt or to | ||||||
13 | train a dog. A dog that is in a dog-friendly area or dog park | ||||||
14 | is not considered to be running at large if the dog is | ||||||
15 | monitored or supervised by a person.
