| 2 | AMENDMENT NO. ______. Amend Senate Bill 1673 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Animal Control Act is amended by changing | ||||||
| 5 | Sections 2.11c, 3.5, and 9 as follows: | ||||||
| 6 | (510 ILCS 5/2.11c)
| ||||||
| 7 | Sec. 2.11c. Intact animal. "Intact animal" means an animal | ||||||
| 8 | that has not been sterilized spayed or neutered.

| 11 | Sec. 3.5. County animal population fund use limitation. | ||||||
| 12 | Funds placed in the county animal population control fund may | ||||||
| 13 | only be used to (1) spay, neuter, vaccinate, or sterilize | ||||||
| 14 | adopted dogs or cats; (2) sterilize spay, neuter, or vaccinate | ||||||
| 15 | dogs or cats owned by low income county residents who are | ||||||
| |||||||
| |||||||
| 1 | eligible for the Food Stamp Program or Social Security | ||||||
| 2 | Disability Benefits Program; or (3) sterilize spay, neuter, | ||||||
| 3 | and vaccinate feral cats in programs recognized by the county | ||||||
| 4 | or a municipality. This Section does not apply to a county with | ||||||
| 5 | 3,000,000 or more inhabitants.

| 8 | Sec. 9. Any dog found running at large contrary to | ||||||
| 9 | provisions of this Act
may
be apprehended and impounded. For | ||||||
| 10 | this purpose, the Administrator shall
utilize any existing or | ||||||
| 11 | available animal control facility or licensed animal shelter. | ||||||
| 12 | The dog's owner shall pay a $25 public safety fine to be | ||||||
| 13 | deposited into the county animal control fund or the county | ||||||
| 14 | pet population control fund. Funds transferred to or retained | ||||||
| 15 | by a municipality before the effective date of this amendatory | ||||||
| 16 | Act of the 100th General Assembly under this paragraph shall | ||||||
| 17 | continue to be transferred to and be retained by that | ||||||
| 18 | municipality. A dog found running at large contrary to the | ||||||
| 19 | provisions of this Act a second or subsequent time must be | ||||||
| 20 | sterilized spayed or neutered within 30 days after being | ||||||
| 21 | reclaimed unless already sterilized spayed or neutered; | ||||||
| 22 | failure to comply shall result in impoundment.
| ||||||
| 23 | A dog that is actively engaged in a legal hunting | ||||||
| 24 | activity, including training, is not considered to be running | ||||||
| 25 | at large if the dog is on land that is open to hunting or on | ||||||
| |||||||
| |||||||
| 1 | land on which the person has obtained permission to hunt or to | ||||||
| 2 | train a dog. A dog that is in a dog-friendly area or dog park | ||||||
| 3 | is not considered to be running at large if the dog is | ||||||
| 4 | monitored or supervised by a person.
