AMENDMENT TO SENATE BILL 1768

2    AMENDMENT NO. ______. Amend Senate Bill 1768 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Highway Code is amended by
5changing Section 4-220 as follows:
 
6    (605 ILCS 5/4-220)
7    Sec. 4-220. Bicycle and pedestrian ways.
8    (a) Bicycle and pedestrian ways shall be given full
9consideration in the planning and development of
10transportation facilities, including the incorporation of such
11ways into State plans and programs.
12    (b) In or within one mile of an urban area, and subject to
13the Department's option in subsection (e), the Department
14shall establish and solely fund bicycle and pedestrian ways
15shall be established in conjunction with the construction,
16reconstruction, or other change of any State transportation

1facility except:
2        (1) in pavement resurfacing projects that do not widen
3    the existing traveled way or do not provide stabilized
4    shoulders; or
5        (2) where approved by the Secretary of Transportation
6    based upon documented safety issues, excessive cost, or
7    absence of need; or .
8        (3) where the municipality passes a resolution stating
9    that a bicycle or pedestrian way does not fit within its
10    development plan.
11    (c) Bicycle and pedestrian ways may be included in
12pavement resurfacing projects when local support is evident or
13the bicycling and walking accommodations can be added within
14the overall scope of the original roadwork.
15    (d) The Department shall establish design and construction
16standards for bicycle and pedestrian ways. Beginning July 1,
172007, this Section shall apply to planning and training
18purposes only. Beginning July 1, 2008, this Section shall
19apply to construction projects.
20    (e) If programmed funds identified in Section 2705-615 of
21the Department of Transportation Law are not expended for 5
22years, the Department has the option to use those funds to pay
23the cost of bicycle and pedestrian ways in roadway projects
24affected by this Section.
