| 1 | | AN ACT concerning State government.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Interagency Wetland Policy Act of 1989 is |
| 5 | | amended by adding Section 1-7 as follows:
|
| 6 | | (20 ILCS 830/1-7 new) |
| 7 | | Sec. 1-7. Alexander-Cairo Port District. Notwithstanding |
| 8 | | any other provision of this Act, this Act does not apply to |
| 9 | | construction activities at facilities or property covered by |
| 10 | | the Alexander-Cairo Port District Act, provided that such |
| 11 | | facilities or property are located within 6 miles of the |
| 12 | | confluence of the Ohio River and the Mississippi River, and |
| 13 | | further provided that such actions comply with the applicable |
| 14 | | mitigation requirements contained in 40 C.F.R. Part 230.
