AMENDMENT TO SENATE BILL 1789

2    AMENDMENT NO. ______. Amend Senate Bill 1789 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Healthcare and Family
5Services Law of the Civil Administrative Code of Illinois is
6amended by adding Sections 2205-35 and 2205-40 as follows:
 
7    (20 ILCS 2205/2205-35 new)
8    Sec. 2205-35. Generic prescription drug contracting. The
9Department of Healthcare and Family Services shall implement
10and develop a program to establish a State prescription
11generic drug label for the purpose of increasing competition
12in the generic drug market and lowering generic drug prices
13for all purchasers. The Department shall contract with one or
14more generic drug manufacturers to manufacture certain generic
15drugs on behalf of the State and participating entities. The
16Department shall adopt rules necessary to implement and

1administer the program created under this Section.
 
2    (20 ILCS 2205/2205-40 new)
3    Sec. 2205-40. State Generic Drug Label Task Force.
4    (a) There is hereby established the State Generic Drug
5Label Task Force to study the cost savings of establishing a
6State prescription generic drug label.
7    (b) The Task Force shall consist of the following members:
8        (1) one member of the House of Representatives
9    appointed by the Speaker of the House of Representatives
10    in consultation with the Minority Leader of the House of
11    Representatives;
12        (2) one member of the Senate appointed by the
13    President of the Senate in consultation with the Minority
14    Leader of the Senate;
15        (3) one member who is a representative of the
16    Department of Healthcare and Family Services appointed by
17    the Director of Healthcare and Family Services;
18        (4) one member from a managed care organization
19    appointed by the Director of Healthcare and Family
20    Services; and
21        (5) one member who is a pharmacist appointed by the
22    Director of Healthcare and Family Services.
23    (c) Members of the Task Force shall serve without
24compensation.
25    (d) The Department shall provide administrative support to

1the Task Force.
2    (e) The Task Force shall select from among its members of a
3chairperson. The Task Force shall convene and hold its first
4meeting beginning in September 2021, and shall hold at least
5one meeting per month until the issuance of the report of the
6Task Force under subsection (f).
7    (f) The Task Force shall study the cost savings of
8establishing a State prescription generic drug label, and all
9relevant and related matters, and issue a report on its
10findings to the Governor and the General Assembly on or before
11December 31, 2021.
12    (g) This Section is repealed on January 1, 2023.
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.".
