AMENDMENT TO SENATE BILL 1794

2    AMENDMENT NO. ______. Amend Senate Bill 1794, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 1, on page 1, by replacing lines 12 through 15 with the
5following:
6"underpayments. Each unit of local government must provide
7appropriate statutes of limitation for the determination and
8assessment of taxes covered by this Act, provided, however,
9that a statute of limitations may not exceed the following:";
10and
 
11on page 10, line 22, after "amended", by inserting "by
12changing Section 16-122 and"; and
 
13on page 11, by replacing lines 6 through 16 with the following:
14"parent: (i) any court costs, attorney's fees, or other fees
15incurred under subsection (d) of Section 8-11-2.5 of the
16Illinois Municipal Code; or (ii) any penalties or interest

1imposed by a municipality under Section 8-11-2.5 of the
2Illinois Municipal Code.
 
3    (220 ILCS 5/16-122)
4    Sec. 16-122. Customer information.
5    (a) Upon the request of a retail customer, or a person who
6presents verifiable authorization and is acting as the
7customer's agent, and payment of a reasonable fee, electric
8utilities shall provide to the customer or its authorized
9agent the customer's billing and usage data.
10    (b) Upon request from any alternative retail electric
11supplier and payment of a reasonable fee, an electric utility
12serving retail customers in its service area shall make
13available generic information concerning the usage, load shape
14curve or other general characteristics of customers by rate
15classification. Provided however, no customer specific
16billing, usage or load shape data shall be provided under this
17subsection unless authorization to provide such information is
18provided by the customer pursuant to subsection (a) of this
19Section.
20    (c) Upon request from a unit of local government and
21payment of a reasonable fee, an electric utility shall make
22available information concerning the usage, load shape curves,
23and other characteristics of customers by customer
24classification and location within the boundaries of the unit
25of local government, however, no customer specific billing,

1usage, or load shape data shall be provided under this
2subsection unless authorization to provide that information is
3provided by the customer or the unit of local government is
4requesting the information for the purposes of an audit under
5Section 8-11-2.5 of the Illinois Municipal Code.
6    (d) All such customer information shall be made available
7in a timely fashion in an electronic format, if available.
