SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/6-506.5 new

    Amends the Uniform Commercial Driver's License Act of the Illinois Vehicle Code. Provides that the employer of an employee driver who drives a commercial motor vehicle may participate in the Employer Notification System. Provides that a request to participate in the employer notification system shall be accompanied by a fee. Provides that any fire department, police department, or other department or agency organized for the purposes of public safety and having official recognition of the city, county, city and county, district, or township in which the department or agency is located shall participate in the employer notification system but shall not be subject to the participation fee. Provides that the Secretary of State's Office shall adopt rules implementing the employer notification system.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Section 6-506.5 as follows:
 
6    (625 ILCS 5/6-506.5 new)
7    Sec. 6-506.5. Employer notification system.
8    (a) The employer of an employee driver who drives a
9commercial motor vehicle, as defined in Section 6-500, may
10participate in the employer notification system, which is a
11process for the purpose of providing the employer with a
12report showing the driver's current public record as recorded
13by the Secretary of State's Office, and any subsequent
14convictions, failures to appear, accidents, driver's license
15suspensions, driver's license revocations, or any other
16actions taken against the driving privileges or certificate of
17the driver added to the driver's record while the employer's
18notification request remains valid and uncanceled. Such
19records shall be produced automatically upon an employee
20driver's conviction, failure to appear, accident, driver's
21license suspension, driver's license revocation, or any other
22action taken against the driver's driving privileges.
23    (b) Upon the termination of a driver's employment, the

1employer shall notify the Secretary of State's Office to
2discontinue the driver's enrollment in the employer
3notification system.
4    (c) A request to participate in the employer notification
5system established by this Section shall be accompanied by a
6fee determined by the Secretary of State's Office to be
7sufficient to defray the entire actual cost to the Secretary
8in administering the employer notification service.
9    (d) Any fire department, police department, or other
10department or agency organized for the purposes of public
11safety and having the official recognition of the city,
12county, city and county, district, township, or the like in
13which the department or agency is located shall participate in
14the employer notification system but shall not be subject to
15the fee established pursuant to this Section.
16    (e) The Secretary of State's Office shall adopt rules
17implementing the employer notification system, ensuring driver
18privacy is safeguarded in compliance with the Privacy Act of
191978, the Driver's Privacy Protection Act of 1994, and any
20other applicable federal or State law. To the extent
21practicable, the Secretary of State shall use the Federal
22Motor Carrier Safety Administration's "Best Practices and
23Recommendations" when drafting such rules.
