AMENDMENT TO SENATE BILL 1915

2    AMENDMENT NO. ______. Amend Senate Bill 1915 as follows:
 
3on page 2, line 8, after "State", by inserting "agency or
4institution of higher education"; and
 
5on page 2, line 14, after "foodware.", by inserting "The
6contract awarded the cost preference in this subsection (b)
7shall also include the option of providing the State agency or
8institution of higher education with single-use plastic
9straws."; and
 
10by replacing line 15 on page 2 through line 7 on page 3 with
11the following:
 
12    "(c) When any State contract is to be awarded for or
13including single-use disposable foodware, the State agency or
14institution of higher education shall include a requirement

1that the responsible bidder or offeror provide a compostable
2or recyclable alternative to single-use disposable foodware.
3The State agency or institution of higher education shall
4select the compostable or recyclable alternative unless its
5cost exceeds its single-use alternative by more than 10%. The
6contract or award that is to be awarded the cost preference in
7this subsection (c) shall also include the option of providing
8the State agency or institution of higher education with
9single-use plastic straws.
10    (d) After January 1, 2023, State agencies and departments
11may not procure single-use plastic disposable foodware for use
12at any State parks or natural areas, and instead shall offer
13only compostable foodware or recyclable foodware, except for
14single-use plastic straws which must be offered upon request.
15    (e) After January 1, 2024, or at the renewal of its next
16contract, no vendor contracted through a State agency or
17department may provide customers with single-use plastic
18disposable foodware at any site located at a State park or a
19natural area, and instead shall offer only compostable
20foodware or recyclable foodware, except for single-use plastic
21straws which must be offered upon request.".
