AMENDMENT TO SENATE BILL 2109

2    AMENDMENT NO. ______. Amend Senate Bill 2109 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing
5Sections 10-16a and 10-22.39 as follows:
 
6    (105 ILCS 5/10-16a)
7    Sec. 10-16a. School board member's leadership training.
8    (a) This Section applies to all school board members
9serving pursuant to Section 10-10 of this Code who have been
10elected after the effective date of this amendatory Act of the
1197th General Assembly or appointed to fill a vacancy of at
12least one year's duration after the effective date of this
13amendatory Act of the 97th General Assembly.
14    (b) Every voting member of a school board of a school
15district elected or appointed for a term beginning after the
16effective date of this amendatory Act of the 97th General

1Assembly, within a year after the effective date of this
2amendatory Act of the 97th General Assembly or the first year
3of his or her first term, shall complete a minimum of 4 hours
4of professional development leadership training covering
5topics in education and labor law, financial oversight and
6accountability, and fiduciary responsibilities of a school
7board member, and, beginning with the 2022-2023 school year,
8trauma-informed practices for students and staff. The school
9district shall maintain on its Internet website, if any, the
10names of all voting members of the school board who have
11successfully completed the training.
12    (b-5) The training for trauma-informed practices for
13students and staff required under this Section must include,
14but is not limited to, all of the following information that is
15relevant to and within the scope of the duties of a school
16board member:
17        (1) The recognition of and care for trauma in students
18    and educators.
19        (2) The relationship between educator wellness and
20    student learning.
21        (3) The effect of trauma on student behavior and
22    learning.
23        (4) The prevalence of trauma among students, including
24    the prevalence of trauma among student populations at
25    higher risk of experiencing trauma.
26        (5) The effects of implicit or explicit bias on

1    recognizing trauma among various racial or ethnic groups
2    of students.
3        (6) Effective district and school policies and
4    practices that are shown to:
5            (A) prevent and mitigate the negative effect of
6        trauma on student behavior and learning; and
7            (B) support the emotional wellness of educators.
8    (c) The training on financial oversight, accountability,
9and fiduciary responsibilities, and, beginning with the
102022-2023 school year, trauma-informed practices for students
11and staff may be provided by an association established under
12this Code for the purpose of training school board members or
13by other qualified providers approved by the State Board of
14Education, in consultation with an association so established.
15    (d) The State Board of Education may adopt any rules
16necessary to implement and administer this Section.

18    (105 ILCS 5/10-22.39)
19    Sec. 10-22.39. In-service training programs.
20    (a) To conduct in-service training programs for teachers.
21    (b) In addition to other topics at in-service training
22programs, at least once every 2 years, licensed school
23personnel and administrators who work with pupils in
24kindergarten through grade 12 shall be trained to identify the
25warning signs of mental illness, trauma, and suicidal behavior

1in youth and shall be taught appropriate intervention and
2referral techniques. A school district may utilize the
3Illinois Mental Health First Aid training program, established
4under the Illinois Mental Health First Aid Training Act and
5administered by certified instructors trained by a national
6association recognized as an authority in behavioral health,
7to provide the training and meet the requirements under this
8subsection. If licensed school personnel or an administrator
9obtains mental health first aid training outside of an
10in-service training program, he or she may present a
11certificate of successful completion of the training to the
12school district to satisfy the requirements of this
13subsection.
14    Training regarding the adoption and administration of a
15trauma-informed school standard satisfies the requirements of
16this subsection (b).
17    A course of instruction as described in this subsection
18(b) may provide information that is relevant to and within the
19scope of the duties of licensed school personnel and school
20administrators. A course of instruction may include, but is
21not limited to, all of the following:
22        (1) The recognition of and care for trauma in students
23    and educators.
24        (2) The relationship between educator wellness and
25    student learning.
26        (3) The effect of trauma on student behavior and

1    learning.
2        (4) The prevalence of trauma among students, including
3    the prevalence of trauma among student populations at
4    higher risk of experiencing trauma.
5        (5) The effects of implicit or explicit bias on
6    recognizing trauma among various racial or ethnic groups
7    of students.
8        (6) Effective district and school policies and
9    practices that are shown to:
10            (A) prevent and mitigate the negative effect of
11        trauma on student behavior and learning; and
12            (B) support the emotional wellness of educators.
13    (c) School guidance counselors, nurses, teachers and other
14school personnel who work with pupils may be trained to have a
15basic knowledge of matters relating to acquired
16immunodeficiency syndrome (AIDS), including the nature of the
17disease, its causes and effects, the means of detecting it and
18preventing its transmission, and the availability of
19appropriate sources of counseling and referral, and any other
20information that may be appropriate considering the age and
21grade level of such pupils. The School Board shall supervise
22such training. The State Board of Education and the Department
23of Public Health shall jointly develop standards for such
24training.
25    (d) In this subsection (d):
26    "Domestic violence" means abuse by a family or household

1member, as "abuse" and "family or household members" are
2defined in Section 103 of the Illinois Domestic Violence Act
3of 1986.
4    "Sexual violence" means sexual assault, abuse, or stalking
5of an adult or minor child proscribed in the Criminal Code of
61961 or the Criminal Code of 2012 in Sections 11-1.20,
711-1.30, 11-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5,
812-12, 12-13, 12-14, 12-14.1, 12-15, and 12-16, including
9sexual violence committed by perpetrators who are strangers to
10the victim and sexual violence committed by perpetrators who
11are known or related by blood or marriage to the victim.
12    At least once every 2 years, an in-service training
13program for school personnel who work with pupils, including,
14but not limited to, school and school district administrators,
15teachers, school guidance counselors, school social workers,
16school counselors, school psychologists, and school nurses,
17must be conducted by persons with expertise in domestic and
18sexual violence and the needs of expectant and parenting youth
19and shall include training concerning (i) communicating with
20and listening to youth victims of domestic or sexual violence
21and expectant and parenting youth, (ii) connecting youth
22victims of domestic or sexual violence and expectant and
23parenting youth to appropriate in-school services and other
24agencies, programs, and services as needed, and (iii)
25implementing the school district's policies, procedures, and
26protocols with regard to such youth, including

1confidentiality. At a minimum, school personnel must be
2trained to understand, provide information and referrals, and
3address issues pertaining to youth who are parents, expectant
4parents, or victims of domestic or sexual violence.
5    (e) At least every 2 years, an in-service training program
6for school personnel who work with pupils must be conducted by
7persons with expertise in anaphylactic reactions and
8management.
9    (f) At least once every 2 years, a school board shall
10conduct in-service training on educator ethics,
11teacher-student conduct, and school employee-student conduct
12for all personnel.

14    Section 99. Effective date. This Act takes effect upon
15becoming law.".
