2 | | AMENDMENT NO. ______. Amend Senate Bill 2122 on page 2, by |
3 | | replacing lines 14 through 19 with the following: |
4 | | " (c) The presumption of inadmissibility of a confession of |
5 | | a minor, who at the time of the commission of the offense was |
6 | | under 18 years of age, at a custodial interrogation at a police |
7 | | station or other place of detention, when such confession is |
8 | | procured through the knowing use of deception, may be overcome |
9 | | by a preponderance of the evidence that the confession was |
10 | | voluntarily given, based on the totality of the |
11 | | circumstances. "; and

12 | | on page 4, by replacing lines 9 through 14 with the following:
