SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/17-63 new

    Amends the Criminal Code of 2012. Creates the offense of deceptive sale of pipeline components. Provides that a person commits the offense, when he or she sells, purchases, or trades a knowingly falsely labeled pipeline component that does not meet or exceed the industry safety standards adopted by the Illinois Commerce Commission, under the Illinois Gas Pipeline Safety Act, for the pipeline component. Provides that a violation is a Class A misdemeanor. Provides that if the violation results in death or great bodily harm to another person, deceptive sale of pipeline components is a Class 4 felony. Defines "component".

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by adding
5Section 17-63 as follows:
 
6    (720 ILCS 5/17-63 new)
7    Sec. 17-63. Deceptive sale of pipeline components.
8    (a) In this Section, "component" means any part of a
9pipeline that may be subjected to pump pressure including, but
10not limited to, pipe, valves, elbows, tees, flanges, and
11closures.
12    (b) A person commits deceptive sale of pipeline
13components, when he or she sells, purchases, or trades a
14knowingly falsely labeled pipeline component that does not
15meet or exceed the industry safety standards adopted by the
16Illinois Commerce Commission, under Section 3 of the Illinois
17Gas Pipeline Safety Act, for the pipeline component.
18    (c) Deceptive sale of pipeline components is a Class A
19misdemeanor. If the violation results in death or great bodily
20harm to another person, deceptive sale of pipeline components
21is a Class 4 felony.
