SYNOPSIS AS INTRODUCED:
 
20 ILCS 5/5-715

    Amends the Departments of State Government Law of the Civil Administrative Code of Illinois. In provisions concerning expedited licensure for service members and spouses, provides that each director of a department that issues an occupational or professional license is authorized to and shall issue a temporary provisional license to any qualified service member or spouse thereof during the expedited 60-day license application review period. Provides that a provisional license shall be issued by the department to any qualified service member or spouse thereof meeting the specified application requirements during the application review period regardless of whether the service member or the spouse currently resides in this State.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Civil Administrative Code of Illinois is
5amended by changing Section 5-715 as follows:
 
6    (20 ILCS 5/5-715)
7    Sec. 5-715. Expedited licensure for service members and
8spouses.
9    (a) In this Section, "service member" means any person
10who, at the time of application under this Section, is an
11active duty member of the United States Armed Forces or any
12reserve component of the United States Armed Forces, the Coast
13Guard, or the National Guard of any state, commonwealth, or
14territory of the United States or the District of Columbia or
15whose active duty service concluded within the preceding 2
16years before application.
17    (a-5) The Department of Financial and Professional
18Regulation shall within 180 days after the effective date of
19this amendatory Act of the 101st General Assembly designate
20one staff member as the military liaison within the Department
21of Financial and Professional Regulation to ensure proper
22enactment of the requirements of this Section. The military
23liaison's responsibilities shall also include, but are not

1limited to: (1) the management of all expedited applications
2to ensure processing within 60 days after receipt of a
3completed application; (2) coordination with all military
4installation military and family support center directors
5within this State, including virtual, phone, or in-person
6periodic meetings with each military installation military and
7family support center; and (3) training by the military
8liaison to all directors of each division that issues an
9occupational or professional license to ensure proper
10application of this Section. Beginning in 2020, and at the end
11of each calendar year thereafter, the military liaison shall
12provide an annual report documenting the expedited licensure
13program for service members and spouses, and shall deliver
14that report to the Secretary of Financial and Professional
15Regulation and the Lieutenant Governor.
16    (b) Each director of a department that issues an
17occupational or professional license is authorized to and
18shall issue an expedited license to a service member who meets
19the requirements under this Section. Review and determination
20of an application for a license issued by the department shall
21be expedited by the department within 60 days after the date on
22which the applicant provides the department with all necessary
23documentation required for licensure. An expedited license
24shall be issued by the department to any service members
25meeting the application requirements of this Section,
26regardless of whether the service member currently resides in

1this State. The service member shall apply to the department
2on forms provided by the department. An application must
3include proof that:
4        (1) the applicant is a service member;
5        (2) the applicant holds a valid license in good
6    standing for the occupation or profession issued by
7    another state, commonwealth, possession, or territory of
8    the United States, the District of Columbia, or any
9    foreign jurisdiction and the requirements for licensure in
10    the other jurisdiction are determined by the department to
11    be substantially equivalent to the standards for licensure
12    of this State;
13        (3) the applicant is assigned to a duty station in
14    this State, has established legal residence in this State,
15    or will reside in this State within 6 months after the date
16    of application;
17        (4) a complete set of the applicant's fingerprints has
18    been submitted to the Department of State Police for
19    statewide and national criminal history checks, if
20    applicable to the requirements of the department issuing
21    the license; the applicant shall pay the fee to the
22    Department of State Police or to the fingerprint vendor
23    for electronic fingerprint processing; no temporary
24    occupational or professional license shall be issued to an
25    applicant if the statewide or national criminal history
26    check discloses information that would cause the denial of

1    an application for licensure under any applicable
2    occupational or professional licensing Act;
3        (5) the applicant is not ineligible for licensure
4    pursuant to Section 2105-165 of the Civil Administrative
5    Code of Illinois;
6        (6) the applicant has submitted an application for
7    full licensure; and
8        (7) the applicant has paid the required fee; fees
9    shall not be refundable.
10    (c) Each director of a department that issues an
11occupational or professional license is authorized to and
12shall issue an expedited license to the spouse of a service
13member who meets the requirements under this Section. Review
14and determination of an application for a license shall be
15expedited by the department within 60 days after the date on
16which the applicant provides the department with all necessary
17documentation required for licensure. An expedited license
18shall be issued by the department to any spouse of a service
19member meeting the application requirements of this Section,
20regardless of whether the spouse or the service member
21currently reside in this State. The spouse of a service member
22shall apply to the department on forms provided by the
23department. An application must include proof that:
24        (1) the applicant is the spouse of a service member;
25        (2) the applicant holds a valid license in good
26    standing for the occupation or profession issued by

1    another state, commonwealth, possession, or territory of
2    the United States, the District of Columbia, or any
3    foreign jurisdiction and the requirements for licensure in
4    the other jurisdiction are determined by the department to
5    be substantially equivalent to the standards for licensure
6    of this State;
7        (3) the applicant's spouse is assigned to a duty
8    station in this State, has established legal residence in
9    this State, or will reside in this State within 6 months
10    after the date of application;
11        (4) a complete set of the applicant's fingerprints has
12    been submitted to the Department of State Police for
13    statewide and national criminal history checks, if
14    applicable to the requirements of the department issuing
15    the license; the applicant shall pay the fee to the

2        (7) the applicant has paid the required fee; fees

4    (c-3) Each director of a department that issues an
5occupational or professional license is authorized to and
6shall issue a temporary provisional license to any qualified
7service member or spouse thereof during the expedited 60-day
8application review period as provided under subsections (b)
9and (c). A provisional license shall be issued by the
10department to any qualified service member or spouse thereof
11meeting the application requirements under subsections (b) and
12(c) during the application review period regardless of whether
13the service member or the spouse currently resides in this
14State.
15    (c-5) If a service member or his or her spouse relocates
16from this State, he or she shall be provided an opportunity to
17place his or her license in inactive status through
18coordination with the military liaison. If the service member
19or his or her spouse returns to this State, he or she may
20reactivate the license in accordance with the statutory
21provisions regulating the profession and any applicable
22administrative rules. The license reactivation shall be
23expedited and completed within 30 days after receipt of a
24completed application to reactivate the license. A license
25reactivation is only applicable when the valid license for
26which the first issuance of a license was predicated is still

1valid and in good standing. An application to reactivate a
2license must include proof that the applicant still holds a
3valid license in good standing for the occupation or
4profession issued in another State, commonwealth, possession,
5or territory of the United States, the District of Columbia,
6or any foreign jurisdiction.
7    (d) All relevant experience of a service member or his or
8her spouse in the discharge of official duties, including
9full-time and part-time experience, shall be credited in the
10calculation of any years of practice in an occupation or
11profession as may be required under any applicable
12occupational or professional licensing Act. All relevant
13training provided by the military and completed by a service
14member shall be credited to that service member as meeting any
15training or education requirement under any applicable
16occupational or professional licensing Act, provided that the
17training or education is determined by the department to be
18substantially equivalent to that required under any applicable
19Act and is not otherwise contrary to any other licensure
20requirement.
21    (e) A department may adopt any rules necessary for the
22implementation and administration of this Section and shall by
23rule provide for fees for the administration of this Section.
