1 | AN ACT concerning local government.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the | ||||||
5 | Decennial Committees on Local Government Efficiency Act. | ||||||
6 | Section 5. Definition. As used in this Act, "governmental | ||||||
7 | unit" includes all units of local government that may levy any | ||||||
8 | tax, except municipalities and counties. | ||||||
9 | Section 10. Formation of committee; members; vacancy; | ||||||
10 | administrative support.

11 | (a) Within one year after the effective date of this Act | ||||||
12 | and at least once every 10 years thereafter, each governmental | ||||||
13 | unit must form a committee to study local efficiencies and | ||||||
14 | report recommendations regarding efficiencies and increased | ||||||
15 | accountability to the county board in which the governmental | ||||||
16 | unit is located. | ||||||
17 | (b) Each committee's membership shall include the elected | ||||||
18 | or appointed members of the governing board of the | ||||||
19 | governmental unit; at least 2 residents of the governmental | ||||||
20 | unit, who are appointed by the chair of the board of the | ||||||
21 | governmental unit, with the advice and consent of the board; | ||||||
22 | and any chief executive officer or other officer of the |

1 | governmental unit. The committee shall be chaired by the | ||||||
2 | president or chief elected or appointed official of the | ||||||
3 | governing board of the governmental unit, or his or her | ||||||
4 | designee. The chairperson may appoint additional members to | ||||||
5 | the committee as he or she deems appropriate. | ||||||
6 | Committee members shall serve without compensation but may | ||||||
7 | be reimbursed by the governmental unit for their expenses | ||||||
8 | incurred in performing their duties. | ||||||
9 | (c) A committee may employ or use the services of | ||||||
10 | specialists in public administration and governmental | ||||||
11 | management and any other trained consultants, analysts, | ||||||
12 | investigators, and assistants it considers appropriate, and it | ||||||
13 | may seek assistance from community colleges and universities | ||||||
14 | as necessary to prepare the report required under Section 25. | ||||||
15 | (d) If a vacancy occurs in the committee membership, the | ||||||
16 | vacancy shall be filled in the same manner as the appointments | ||||||
17 | under subsection (b). | ||||||
18 | (e) Each governmental unit shall provide administrative | ||||||
19 | and other support to its committee. | ||||||
20 | Section 15. Duties of a committee. The duties of a | ||||||
21 | committee include, but are not limited to, the study of the | ||||||
22 | governmental unit's governing statutes, ordinances, rules, | ||||||
23 | procedures, powers, jurisdiction, shared services, | ||||||
24 | intergovernmental agreements, and interrelationships with | ||||||
25 | other governmental units and the State. The committee shall |

1 | also collect data, research, and analysis as necessary to | ||||||
2 | prepare the report described in Section 25. | ||||||
3 | Section 20. Meetings. Each committee shall meet at least 3 | ||||||
4 | times. The committee may meet during a regularly scheduled | ||||||
5 | meeting of the governmental unit as long as: (1) separate | ||||||
6 | notice is given in conformance with the Open Meetings Act; (2) | ||||||
7 | the committee meeting is listed as part of the board of the | ||||||
8 | governmental unit's agenda; and (3) at least a majority of the | ||||||
9 | members of the committee are present at the committee's | ||||||
10 | meeting. Each meeting of the committee shall be public, and | ||||||
11 | the committee shall provide an opportunity for any person to | ||||||
12 | be heard at the public hearings for at least 3 minutes. The | ||||||
13 | committee may require speakers to register. The committee | ||||||
14 | shall meet in accordance with the Open Meetings Act, and the | ||||||
15 | committee shall be a public body to which the Freedom of | ||||||
16 | Information Act applies. | ||||||
17 | At the conclusion of each meeting, the committee shall | ||||||
18 | conduct a survey of residents who attended asking for input on | ||||||
19 | the matters discussed at the meeting. | ||||||
20 | Section 25. Report. Each committee shall summarize its | ||||||
21 | work and findings within a written report, which shall include | ||||||
22 | recommendations in respect to increased accountability and | ||||||
23 | efficiency, and shall provide the report to the county board | ||||||
24 | in which the governmental unit is located no later than 18 |

1 | months after the formation of the committee. The report shall | ||||||
2 | be made available to the public. | ||||||
3 | Section 30. Dissolution of the committee. After a | ||||||
4 | committee has made the report required under Section 25 | ||||||
5 | available to the public, the committee is dissolved until it | ||||||
6 | is reestablished with newly appointed members under Section | ||||||
7 | 10. | ||||||
8 | Section 85. The School Code is amended by changing Section | ||||||
9 | 17-1.1 as follows: | ||||||
10 | (105 ILCS 5/17-1.1) | ||||||
11 | Sec. 17-1.1. Shared service reporting and fiscal | ||||||
12 | efficiency. | ||||||
13 | (a) Annually, each school district shall complete a report | ||||||
14 | developed by the State Board of Education, to accompany the | ||||||
15 | annual financial report and to be published on the State Board | ||||||
16 | of Education's Internet website, that summarizes district | ||||||
17 | attempts to improve fiscal efficiency through shared services | ||||||
18 | or outsourcing in the prior fiscal year. The report must be | ||||||
19 | primarily in checklist form and approximately one page in | ||||||
20 | length. It shall include, but shall not be limited to, the | ||||||
21 | incidence of the following shared service options: insurance; | ||||||
22 | employee benefits; transportation; personnel recruitment; | ||||||
23 | shared personnel; technology services; energy purchasing; |

1 | supply and equipment purchasing; food services; legal | ||||||
2 | services; investment pools; special education cooperatives, | ||||||
3 | vocational cooperatives, and other shared educational | ||||||
4 | programs; curriculum planning; professional development; | ||||||
5 | custodial services; maintenance services; grounds maintenance | ||||||
6 | services; food services; grant writing; and science, | ||||||
7 | technology, engineering, and mathematics (STEM) program | ||||||
8 | offerings. The report shall also include a list of potential | ||||||
9 | shared services or outsourcing the district may consider or | ||||||
10 | investigate for the next fiscal year and any anticipated | ||||||
11 | barriers to implementation. This report must be approved by | ||||||
12 | the school board at an open meeting that allows for public | ||||||
13 | comment, and it shall be published on the Internet website of | ||||||
14 | the school district, if any. | ||||||
15 | (b) Based on data supplied by school districts through the | ||||||
16 | annual financial report, regional superintendents of schools | ||||||
17 | shall publish annually a regional report summarizing district | ||||||
18 | attempts to improve fiscal efficiency through shared services | ||||||
19 | or outsourcing within the educational service region. This | ||||||
20 | report shall include a list of all joint purchasing | ||||||
21 | initiatives, joint agreements between districts, attempts to | ||||||
22 | reduce or eliminate duplication of services and duplicative | ||||||
23 | expenditures, and identification of any overlapping regional | ||||||
24 | service delivery systems. | ||||||
25 | (c) For school districts required to develop and submit to | ||||||
26 | the State Board of Education a deficit reduction plan under |

1 | Section 17-1 of this Code, the regional superintendent of | ||||||
2 | schools and the school district shall jointly prepare a shared | ||||||
3 | services and outsourcing plan that considers actions that may | ||||||
4 | improve the district's fiscal efficiency and how future | ||||||
5 | savings associated with shared services or outsourcing are to | ||||||
6 | be utilized.

8 | Section 90. The State Mandates Act is amended by adding | ||||||
9 | Section 8.46 as follows: | ||||||
10 | (30 ILCS 805/8.46 new) | ||||||
11 | Sec. 8.46. Exempt mandate. Notwithstanding Sections 6 and | ||||||
12 | 8 of this Act, no reimbursement by the State is required for | ||||||
13 | the implementation of any mandate created by the Decennial | ||||||
14 | Committees on Local Government Efficiency Act. | ||||||
15 | Section 99. Effective date. This Act takes effect upon | ||||||
16 | becoming law. |
