SYNOPSIS AS INTRODUCED:

625 ILCS 5/4-111 new

    Amends the Illinois Vehicle Code. Provides that the Secretary of State shall establish a vehicle theft hotline to facilitate the location of stolen vehicles via their installed existing global positioning systems, collaborate with vehicle manufacturers and dealers to provide information and assistance to law enforcement officers in the investigation of vehicle theft, and ensure that consumers are provided with information concerning the hotline upon the purchase of any new or used vehicle manufactured with a global positioning system. Provides that the manufacturer of any vehicle sold in this State shall establish a hotline available to State, county, and local law enforcement agencies exclusively for the purpose of tracking vehicles stolen in vehicular hijacking incidents or that have been used in the commission of kidnapping, aggravated battery with a firearm, attempted homicide, or homicide. Provides that the manufacturer's hotline shall relay real-time location information to the 9-1-1 call center of the offending vehicle's location to the best of the manufacturer's technical capability. Requires the Secretary of State to oversee the manufacturer hotline program and adopt a fee and fine structure for implementation of and compliance with the program. Provides that the fees and fines shall be used to supplement any costs incurred by administering the program. Requires law enforcement to use its 9-1-1 system call center staffed 24 hours a day, 7 days a week for the purpose of verification of a law enforcement officer's identity and a bona fide incident report number related to the incident. Requires manufacturers to provide written statements detailing tracking and disabling system capabilities. Requires the Secretary of State to distribute the manufacturers' statements.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by adding
5Sections 4-110 and 4-111 as follows:
 
6    (625 ILCS 5/4-110 new)
7    Sec. 4-110. Stolen vehicle finder hotline. The Secretary
8of State shall establish a vehicle theft hotline to facilitate
9the location of stolen vehicles via their installed existing
10global positioning systems. The Secretary of State shall
11collaborate with vehicle manufacturers and dealers to provide
12information and assistance to law enforcement officers in the
13investigation of vehicle theft and ensure that consumers are
14provided with information concerning the hotline upon the
15purchase of any new or used vehicle manufactured with a global
16positioning system.

18    Sec. 4-111. Manufacturer's vehicle hotline; law
19enforcement verification; manufacturer statements.
20    (a) A manufacturer of any vehicle sold in this State shall
21establish a hotline that is staffed 24 hours a day, 7 days a
22week available to State, county, and local law enforcement

1agencies exclusively for the purpose of tracking vehicles
2stolen in vehicular hijacking incidents or that have been used
3in the commission of kidnapping, aggravated battery with a
4firearm, attempted homicide, or homicide. The manufacturer's
5hotline shall relay real-time location information to the
69-1-1 call center of the offending vehicle's location to the
7best of the manufacturer's technical capability.
8    (b) The Secretary of State shall oversee the manufacturer
9hotline program and shall have rulemaking authority over the
10program. The Secretary of State shall adopt a fee and fine
11structure for implementation of and compliance with the
12program. The fees and fines shall be used to supplement any
13costs incurred by administering the program.
14    (c) A State, county, or local law enforcement agency shall
15use the 9-1-1 system call center staffed 24 hours a day, 7 days
16a week for the purpose of verification of a law enforcement
17officer's identity and a bona fide incident report number
18related to the incident.
19    (d) A manufacturer of any vehicle sold in this State shall
20submit an annual written statement detailing the
21manufacturer's tracking and disabling system capabilities,
22including, but not limited to, real-time turn-by-turn,
23interval pinging, slow down, engine cutoff, and alarm or light
24activation, per model, trim, and year. The Secretary of State
25shall develop a standardized form for manufacturers to use to
26submit the annual written statement. The manufacturer's annual

1written statement shall be submitted to the Secretary of State
2by January 1 of each year. The Secretary of State shall publish
3the information contained in each manufacturer's annual
4written statement in a conspicuous location on its website to
5assist consumers with identifying information concerning a
6vehicle manufacturer's program and vehicle capabilities.
7    (e) The Secretary of State shall distribute annually an
8updated copy of the manufacturers' statements to the Illinois
9State Police and the Illinois Attorney General's Office by
10June 1 of each year.
