AMENDMENT TO HOUSE BILL 999

2    AMENDMENT NO. ______. Amend House Bill 999 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Healthcare and Family
5Services Law is amended by adding Section 2205-40 as follows:
 
6    (20 ILCS 2205/2205-40 new)
7    Sec. 2205-40. Co-located facilities; essential
8reproductive health care services.
9    (a) As used in this Section, "co-located facility" means a
10facility licensed in accordance with rules adopted by the
11Department of Healthcare and Family Services under subsection
12(b).
13    (b) The Department of Healthcare and Family Services shall
14adopt rules creating a licensing scheme and designation for
15co-located facilities.
16    (c) A co-located facility shall provide essential

1reproductive health care services according to a sliding fee
2schedule for uninsured patients, such as the Sliding Fee
3Discount Program's fee schedule used by Federally Qualified
4Health Centers. The essential reproductive health care
5services offered by a co-located facility shall include, but
6are not limited to, all of the following:
7        (1) Annual women's health examinations, including, but
8    not limited to, Papanicolaou tests and breast
9    examinations.
10        (2) Recovery support services for pregnant and
11    postpartum individuals affected by a substance use
12    disorder, including, but not limited to, the prescription
13    of medications that are approved by the United States Food
14    and Drug Administration and the Center for Substance Abuse
15    Treatment for the treatment of an opioid use disorder in
16    pregnant individuals. As used in this paragraph, "recovery
17    support" has the meaning ascribed to that term in Section
18    1-10 of the Substance Use Disorder Act.
19        (3) Preconception wellness visits.
20        (4) Prenatal care, including, but not limited to,
21    ultrasound examinations.
22        (5) Labor and delivery services.
23        (6) Postpartum care and support.
24        (7) Examinations and prescriptions for contraceptives.
25        (8) Clinical management of miscarriage and stillbirth.
26        (9) Examinations, care, and prescriptions for sexually

1    transmitted infections.
2        (10) Assessment for and prescription of pre-exposure
3    prophylaxis (PrEP).
4        (11) Perinatal doulas and community health workers who
5    specialize in reproductive health care issues.
6    (d) A co-located facility must obtain a certificate of
7need from the Health Facilities and Services Review Board
8under the Health Facilities Planning Act to operate an
9obstetric bed unit with a bed capacity of no more than 10 beds.
10    (e) A co-located facility shall be eligible to receive
11funding through the Department of Human Services for
12programming described in subsections (h) and (i) of Section
1335-5 of the Substance Use Disorder Act.".
