SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Local Government Business Anti-Poaching Act. Provides that no municipality or county shall offer after the effective date of the Act any incentive to a business or corporation to move its headquarters located in Illinois, or any part of its business located in Illinois, away from the current location. Defines "incentive". Limits home rule powers. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Local
5Government Business Anti-Poaching Act.
 
6    Section 5. Definition. As used in this Act, "incentive"
7means any economic benefit, financial benefit, or other
8benefit, such as those authorized under the Economic
9Development for a Growing Economy Tax Credit Act, the Property
10Tax Code, the Counties Code, the Illinois Municipal Code
11(including the Tax Increment Allocation Redevelopment Act), or
12any other provision of law authorizing abatements, credits, or
13tax or fee reductions.
 
14    Section 10. Illinois business poaching prohibited.
15Notwithstanding any other provision of law, no municipality or
16county shall offer after the effective date of this Act any
17incentive to a business or corporation to move its
18headquarters located in Illinois, or any part of its business
19located in Illinois, away from the current location.
 
20    Section 15. Home rule. The regulation of offering any
21incentive to a business or corporation to move its

2located in Illinois, away from the current location are
3exclusive powers and functions of the State. A home rule unit
4may not regulate such matters. This Act is a denial and
5limitation of home rule powers and functions under subsection
6(h) of Section 6 of Article VII of the Illinois Constitution.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
