1 | | AN ACT concerning education.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The School Code is amended by adding Sections |
5 | | 10-20.85 and 34-18.82 and by changing Section 10-22.39 as |
6 | | follows: |
7 | | (105 ILCS 5/10-20.85 new) |
8 | | Sec. 10-20.85. Trauma kit. |
9 | | (a) In this Section, "trauma kit" means a first aid |
10 | | response kit that contains, at a minimum, all of the |
11 | | following: |
12 | | (1) One tourniquet endorsed by the Committee on |
13 | | Tactical Combat Casualty Care. |
14 | | (2) One compression bandage. |
15 | | (3) One hemostatic bleeding control dressing endorsed |
16 | | by the Committee on Tactical Combat Casualty Care. |
17 | | (4) Protective gloves and a marker. |
18 | | (5) Scissors. |
19 | | (6) Instructional documents developed by the Stop the |
20 | | Bleed national awareness campaign of the United States |
21 | | Department of Homeland Security or the American College of |
22 | | Surgeons' Committee on Trauma, or both. |
23 | | (7) Any other medical materials or equipment similar |

1 | | to those described in paragraphs (1) through (3) or any |
2 | | other items that (i) are approved by a local law |
3 | | enforcement agency or first responders, (ii) can |
4 | | adequately treat a traumatic injury, and (iii) can be |
5 | | stored in a readily available kit. |
6 | | (b) Each school district may maintain an on-site trauma |
7 | | kit at each school of the district for bleeding emergencies. |
8 | | (c) Products purchased for the trauma kit, including those |
9 | | products endorsed by the Committee on Tactical Combat Casualty |
10 | | Care, shall, whenever possible, be manufactured in the United |
11 | | States.

13 | | Sec. 10-22.39. In-service training programs. |
14 | | (a) To conduct in-service training programs for teachers. |
15 | | (b) In addition to
other topics at in-service training
|
16 | | programs, at least once every 2 years, licensed school |
17 | | personnel and administrators who work with pupils in |
18 | | kindergarten through grade 12 shall be
trained to identify the |
19 | | warning signs of mental illness, trauma, and suicidal behavior |
20 | | in youth and shall be taught appropriate intervention and |
21 | | referral techniques. A school district may utilize the |
22 | | Illinois Mental Health First Aid training program, established |
23 | | under the Illinois Mental Health First Aid Training Act and |
24 | | administered by certified instructors trained by a national |
25 | | association recognized as an authority in behavioral health, |

1 | | to provide the training and meet the requirements under this |
2 | | subsection. If licensed school personnel or an administrator |
3 | | obtains mental health first aid training outside of an |
4 | | in-service training program, he or she may present a |
5 | | certificate of successful completion of the training to the |
6 | | school district to satisfy the requirements of this |
7 | | subsection.

8 | | Training regarding the implementation of trauma-informed |
9 | | practices satisfies the requirements
of this subsection (b). |
10 | | A course of instruction as described in this subsection |
11 | | (b) may provide information that is relevant to
and within the |
12 | | scope of the duties of licensed school personnel or school |
13 | | administrators. Such information may include,
but is not |
14 | | limited to: |
15 | | (1) the recognition of and care for trauma in students |
16 | | and staff; |
17 | | (2) the relationship between educator wellness and |
18 | | student learning; |
19 | | (3) the effect of trauma on student behavior and |
20 | | learning; |
21 | | (4) the prevalence of trauma among students, including |
22 | | the prevalence of trauma among student
populations at |
23 | | higher risk of experiencing trauma; |
24 | | (5) the effects of implicit or explicit bias on |
25 | | recognizing trauma among various student groups in |
26 | | connection with race, ethnicity, gender identity, sexual |

1 | | orientation, socio-economic status, and other relevant |
2 | | factors; and |
3 | | (6) effective district practices that are shown to: |
4 | | (A) prevent and mitigate the negative effect of |
5 | | trauma on student behavior and learning; and |
6 | | (B) support the emotional wellness of staff. |
7 | | (c) School counselors, nurses, teachers and other school |
8 | | personnel
who work with pupils may be trained to have a basic |
9 | | knowledge of matters
relating to acquired immunodeficiency |
10 | | syndrome (AIDS), including the nature
of the disease, its |
11 | | causes and effects, the means of detecting it and
preventing |
12 | | its transmission, and the availability of appropriate sources |
13 | | of
counseling and referral, and any other information that may |
14 | | be appropriate
considering the age and grade level of such |
15 | | pupils. The School Board shall
supervise such training. The |
16 | | State Board of Education and the Department
of Public Health |
17 | | shall jointly develop standards for such training.

18 | | (d) In this subsection (d): |
19 | | "Domestic violence" means abuse by a family or household |
20 | | member, as "abuse" and "family or household members" are |
21 | | defined in Section 103 of the Illinois Domestic Violence Act |
22 | | of 1986. |
23 | | "Sexual violence" means sexual assault, abuse, or stalking |
24 | | of an adult or minor child proscribed in the Criminal Code of |
25 | | 1961 or the Criminal Code of 2012 in Sections 11-1.20, |
26 | | 11-1.30, 11-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, |

1 | | 12-12, 12-13, 12-14, 12-14.1, 12-15, and 12-16, including |
2 | | sexual violence committed by perpetrators who are strangers to |
3 | | the victim and sexual violence committed by perpetrators who |
4 | | are known or related by blood or marriage to the victim. |
5 | | At least once every 2 years, an in-service training |
6 | | program for school personnel who work with pupils, including, |
7 | | but not limited to, school and school district administrators, |
8 | | teachers, school social workers, school counselors, school |
9 | | psychologists, and school nurses, must be conducted by persons |
10 | | with expertise in domestic and sexual violence and the needs |
11 | | of expectant and parenting youth and shall include training |
12 | | concerning (i) communicating with and listening to youth |
13 | | victims of domestic or sexual violence and expectant and |
14 | | parenting youth, (ii) connecting youth victims of domestic or |
15 | | sexual violence and expectant and parenting youth to |
16 | | appropriate in-school services and other agencies, programs, |
17 | | and services as needed, and (iii) implementing the school |
18 | | district's policies, procedures, and protocols with regard to |
19 | | such youth, including confidentiality. At a minimum, school |
20 | | personnel must be trained to understand, provide information |
21 | | and referrals, and address issues pertaining to youth who are |
22 | | parents, expectant parents, or victims of domestic or sexual |
23 | | violence.

24 | | (e) At least every 2 years, an in-service training program |
25 | | for school personnel who work with pupils must be conducted by |
26 | | persons with expertise in anaphylactic reactions and |

1 | | management.
|
2 | | (f) At least once every 2 years, a school board shall |
3 | | conduct in-service training on educator ethics, |
4 | | teacher-student conduct, and school employee-student conduct |
5 | | for all personnel. |
6 | | (g) At least once every 2 years, a school board shall |
7 | | conduct in-service training for all school district employees |
8 | | on the methods to respond to trauma. The training must include |
9 | | instruction on how to respond to an incident involving |
10 | | life-threatening bleeding and, if applicable, how to use a |
11 | | school's trauma kit. A school board may satisfy the training |
12 | | requirements under this subsection by using the training, |
13 | | including online training, available from the American College |
14 | | of Surgeons or any other similar organization. |
15 | | School district employees who are trained to respond to |
16 | | trauma pursuant to this subsection (g) shall be immune from |
17 | | civil liability in the use of a trauma kit unless the action |
18 | | constitutes willful or wanton misconduct. |

12 | | becoming law.
