| 7 | | Sec. 4g. Indemnification prohibited. In any purchase of |
| 8 | | service contract or other agreement between the Department and |
| 9 | | any public or private agency for services consistent with this |
| 10 | | Act, the Department shall not include any term or provision |
| 11 | | that seeks to impose or imposes on the agency an obligation to |
| 12 | | indemnify, hold harmless, or insure the Department and any of |
| 13 | | its agents from any liability, loss, damage, claim, cost, or |
| 14 | | expense, including attorney's fees. The Department's inclusion |
| 15 | | of any term or provision that imposes or seeks to impose |
| 16 | | indemnity on any agency is void and unenforceable as against |
