SYNOPSIS AS INTRODUCED:
 
60 ILCS 1/235-25

    Amends the Township Code. Provides that tentative budgets for specified road districts shall be subject to a public hearing and public inspection prior to adopting. Provides that the township board may adopt all or part of the tentative budget and appropriation ordinance for road purposes and levy the amount determined by the board (rather than the township board shall adopt all the tentative budget and appropriation ordinance and levy the amount determined by the highway commissioner). Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Township Code is amended by changing
5Section 235-25 as follows:
 
6    (60 ILCS 1/235-25)
7    Sec. 235-25. Tentative budget and appropriation ordinance
8and tax for road purposes. In each road district comprised of
9a single township:
10        (1) The township board must hold a public hearing
11    before adopting a budget and appropriation ordinance for
12    road purposes.
13        (2) The township board must, at least 30 days before a
14    public hearing, prepare or cause to be prepared a
15    tentative budget and appropriation ordinance for road
16    purposes and file the ordinance with the township clerk.
17    The township clerk must make the tentative budget and
18    appropriation ordinance for road purposes available for
19    public inspection for at least 30 days before final action
20    on the ordinance. The required public hearing must be held
21    on or before the last day of the first quarter of the
22    fiscal year before the township board. Notice of the
23    hearing must be given by publication in a newspaper

1    published in the township at least 30 days before the time
2    of the hearing. If there is no newspaper published in the
3    township, notice of the public hearing may be given by
4    posting notices in 5 of the most public places in the
5    township. It is the duty of the township clerk to arrange
6    for the public hearing.
7        (3) The , the township board may shall adopt all or
8    part of a tentative budget and appropriation ordinance for
9    road purposes, as the township board deems necessary, and
10    shall levy the amount determined by the board highway
11    commissioner and certify to the county clerk the amount
12    necessary to be raised by taxation for road purposes as
13    provided in Section 6-501 of the Illinois Highway Code.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
