Amends the Community-Integrated Living Arrangements Licensure and Certification Act. Provides that the Division of Developmental Disabilities of the Department of Human Services shall continue, in cases of medically required absences from a community integrated living arrangement, to provide 50% of the per diem reimbursement to providers while the community integrated living arrangement holds the vacancy for the absent resident. Provides that the absent resident shall be able to return to the community integrated living arrangement when the resident is medically able to return. Defines "medically required absences".

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Community-Integrated Living Arrangements |
5 | | Licensure and
Certification Act is amended by adding Section |
6 | | 13.3 as follows: |
7 | | (210 ILCS 135/13.3 new) |
8 | | Sec. 13.3. Occupancy factor. The Division of Developmental |
9 | | Disabilities of the Department shall continue, in cases of |
10 | | medically required absences from a community integrated living |
11 | | arrangement, to provide 50% of the per diem reimbursement to |
12 | | providers while the community integrated living arrangement |
13 | | holds the vacancy for the absent resident. The absent resident |
14 | | is authorized to return to the community integrated living |
15 | | arrangement when the resident is medically able to return. |
16 | | As used in this Section, "medically required absences" |
17 | | means a situation in which a resident is temporarily absent |
18 | | from a community integrated living arrangement to receive |
19 | | medical treatment or for other reasons that have been |
20 | | recommended by medical personnel. Such reasons include, but |
21 | | are not limited to, hospitalizations, placements in short-term |
22 | | stabilization homes or state-operated facilities, stays in |
23 | | nursing facilities, rehabilitation in long-term care |
