AMENDMENT TO HOUSE BILL 3508

2    AMENDMENT NO. ______. Amend House Bill 3508 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The PFAS Reduction Act is amended by adding
5Section 40 as follows:
 
6    (415 ILCS 170/40 new)
7    Sec. 40. Guidance from United States Environmental
8Protection Agency; PFAS monitoring plan; technical assistance;
9PFAS disposal program.
10    (a) The Agency shall follow the most up-to-date guidance
11to states from the United States Environmental Protection
12Agency on addressing the discharge of PFAS in National
13Pollutant Discharge Elimination System (NPDES) permits;
14however, the Agency shall not require monitoring for PFAS in
15influent, effluent, and biosolids to commence less than 30
16days after the United States Environmental Protection Agency

1adopts an approved method for analyzing PFAS in these
2matrices. Monitoring required under NPDES permits shall be
3limited to those specific PFAS compounds for which an
4analytical method has been approved by the United States
5Environmental Protection Agency.
6    (b) The Agency shall create a PFAS monitoring plan. The
7plan shall focus on the following:
8        (1) monitoring PFAS occurrence in wastewater flows
9    from industrial and domestic sources, stormwater
10    discharges, and solid waste streams;
11        (2) gathering State-specific information in order to
12    craft effective policies to address PFAS occurrence in
13    wastewater, stormwater, and solid waste; and
14        (3) gathering data to inform PFAS source reduction and
15    pollution prevention programs, including, but not limited
16    to, industrial pretreatment programs administered by
17    publicly owned treatment works.
18    The plan shall be submitted to the Governor and the
19General Assembly by July 1, 2024.
20    (c) The Prairie Research Institute's Illinois Sustainable
21Technology Center shall provide technical assistance to
22industrial wastewater dischargers in best management
23practices, pollution prevention, production substitution, and
24elimination to reduce or eliminate PFAS compounds.
25    (d) The Agency shall establish a take-back program for
26fire departments that use and store firefighting foam

1containing PFAS. Fire departments that participated in the
2most recent survey described in Section 25 shall be eligible
3to participate in the program, but participation in the
4program shall not be required. The program shall provide
5funding and resources to ensure the proper destruction of
6firefighting foam containing PFAS. The program shall continue
7for a period of 5 years or until the Office of the State Fire
8Marshal finds that no firefighting foam containing PFAS is
9reported in the survey described in Section 25. This program
10is subject to appropriation.
11    (e) Implementation of this Section is subject to
12appropriation.".
 
13    Section 99. Effective date. This Act takes effect upon
14becoming law.".
