Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it shall be an unfair or deceptive act or practice for any petroleum-related business to sell or offer to sell any petroleum product for an amount that represents an unconscionably high price.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Consumer Fraud and Deceptive Business |
5 | | Practices Act is amended by adding Section 2BBBB as follows: |
6 | | (815 ILCS 505/2BBBB new) |
7 | | Sec. 2BBBB. Petroleum products price gouging. |
8 | | (a) As used in this Section: |
9 | | "Petroleum product" includes, but shall not be limited to, |
10 | | motor fuels, as defined in Section 1.1 of the Motor Fuel Tax |
11 | | Law, and fuel oil used for heating or cooking purposes. |
12 | | "Petroleum-related business" means any producer, supplier, |
13 | | wholesaler, distributor, or retail seller of any petroleum |
14 | | product. |
15 | | (b) It is an unlawful practice under this Act for any |
16 | | petroleum-related business to sell or offer to sell any |
17 | | petroleum product for an amount that represents an |
18 | | unconscionably high price. |
19 | | (c) For the purposes of subsection (b), a price is |
20 | | unconscionably high if: |
21 | | (1) the amount charged represents a gross disparity |
22 | | between the price of the petroleum product and the price |
23 | | at which the same or similar petroleum product is readily |
