| 1 | AMENDMENT TO HOUSE BILL 3955

| 2 | AMENDMENT NO. ______. Amend House Bill 3955 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The University of Illinois Hospital Act is | ||||||
| 5 | amended by adding Section 8h as follows: | ||||||
| 6 | (110 ILCS 330/8h new) | ||||||
| 7 | Sec. 8h. Emergency room treatment; delay of treatment | ||||||
| 8 | prohibition. Notwithstanding any provision of law to the | ||||||
| 9 | contrary, the University of Illinois Hospital, in accordance | ||||||
| 10 | with Section 1395dd(a) and 1395dd(b) of the Social Security | ||||||
| 11 | Act, shall not delay provisions of a required appropriate | ||||||
| 12 | medical screening examination or further medical examination | ||||||
| 13 | and treatment for a patient in a University of Illinois | ||||||
| 14 | Hospital emergency room in order to inquire about the | ||||||
| 15 | individual's method of payment or insurance status. | ||||||

| 1 | Section 10. The Hospital Licensing Act is amended by | ||||||
| 2 | adding Section 6.34 as follows: | ||||||
| 3 | (210 ILCS 85/6.34 new) | ||||||
| 4 | Sec. 6.34. Emergency room treatment; delay of treatment | ||||||
| 5 | prohibition. Notwithstanding any provision of law to the | ||||||
| 6 | contrary, a hospital licensed under this Act, in accordance | ||||||
| 7 | with Section 1395dd(a) and 1395dd(b) of the Social Security | ||||||
| 8 | Act, shall not delay provisions of a required appropriate | ||||||
| 9 | medical screening examination or further medical examination | ||||||
| 10 | and treatment for a patient in a hospital's emergency room in | ||||||
| 11 | order to inquire about the individual's method of payment or | ||||||
| 12 | insurance status.".
