AMENDMENT TO HOUSE BILL 4480

2    AMENDMENT NO. ______. Amend House Bill 4480 by replacing 
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Controlled Substances Act is 
5amended by adding Section 314.6 as follows:
 
6    (720 ILCS 570/314.6 new)
7    Sec. 314.6. Patient records; release and report. 
8    (a) A pharmacy shall inform a patient if the pharmacy 
9releases the patient's records to any person or entity without 
10the patient's written consent.
11    (b) A pharmacy shall create and publish an annual report 
12containing the number of patient information requests, 
13including subpoenas and warrants, that the pharmacy received 
14and how many of those requests the pharmacy fulfilled during 
15the preceding calendar year. The report shall be delivered to 
16the Department of Financial and Professional Regulation.

1    (c) The Department of Financial and Professional 
2Regulation shall adopt rules to implement and administer this 
3Section.
4    (d) Subsection (a) of this Section does not apply to an 
5ongoing law enforcement or Department of Financial and 
6Professional Regulation investigation.".
