SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Artificial Intelligence Reporting Act. Provides that each State agency shall prepare an annual report concerning the State agency's use of covered algorithms in its operations. Sets forth reporting requirements. Provides that, within 6 months after the effective date of the Act, and each year thereafter, each State agency shall submit the report to the General Assembly, the Auditor General, and the Department of Innovation and Technology. Provides that the Department of Innovation and Technology shall create and maintain a website to make the annual reports accessible to the public. Provides that each State agency shall designate among current staff a Chief Artificial Intelligence Officer to oversee the preparation and submission of the report. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Artificial Intelligence Reporting Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Covered algorithm" means a computational process that
8uses machine learning, natural language processing, artificial
9intelligence techniques, or other computational processing
10techniques of similar or greater complexity and that makes a
11decision or facilitates human decision-making with respect to
12covered data, including to determine the provision of products
13or services or to rank, order, promote, recommend, amplify, or
14similarly determine the delivery or display of information to
15an individual.
16    "State agency" means all boards, commissions, agencies,
17institutions, authorities, bodies politic and corporate of the
18State created by or pursuant to the constitution or statute,
19of the executive branch of State government that use covered
20algorithms in their operations.
 
21    Section 10. Reporting requirements.
22    (a) Each State agency shall prepare an annual report

1concerning the State agency's use of covered algorithms in its
2operations.
3    (b) The report shall include, but not be limited to, the
4following information:
5        (1) an inventory of all covered algorithms used by the
6    State agency;
7        (2) a description of the purpose for each covered
8    algorithm and any foreseeable future uses of the covered
9    algorithm;
10        (3) a description of training data used in connection
11    with the covered algorithm, including data inputs and
12    outputs; and
13        (4) evaluation metrics for the performance of the
14    covered algorithm.
15    (c) Each State agency shall prepare as part of the report a
16summary of the information described in subsection (b). The
17summary shall be written in a manner that encourages public
18understanding.
 
19    Section 15. Submission of the report. Within 6 months
20after the effective date of this Act, and each year
21thereafter, each State agency shall submit the report
22described in Section 10 to the General Assembly, the Auditor
23General, and the Department of Innovation and Technology.
 
24    Section 20. Publication and accessibility. The Department

1of Innovation and Technology shall create and maintain a
2website to make the annual reports submitted to the Department
3under Section 15 accessible to the public. The Department
4shall include on the website a full copy of each report and the
5summary of findings described in subsection (c) of Section 10.
 
6    Section 25. Designation of a Chief Artificial Intelligence
7Officer. Each State agency shall designate among current staff
8a Chief Artificial Intelligence Officer to oversee the
9preparation and submission of the report described in Section
1010.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
