2 | | (5) condition that results in the issuance of a boil |
3 | | water order. |
4 | | "Disruption notification list" means a list enumerating |
5 | | health care facilities, fire departments, dispatch centers, |
6 | | and their designees that are served by a public water supply |
7 | | and maintained by a public water distribution entity. |
8 | | "Fire department" means a fire protection service provider |
9 | | (i) organized under the Illinois Municipal Code or the Fire |
10 | | Protection District Act and (ii) recognized by the Office of |
11 | | the State Fire Marshal. |
12 | | "Health care facility" means a facility, hospital, or |
13 | | establishment licensed or organized under the Ambulatory |
14 | | Surgical Treatment Center Act, the University of Illinois |
15 | | Hospital Act, the Hospital Licensing Act, the Nursing Home |
16 | | Care Act, the Assisted Living and Shared Housing Act, or the |
17 | | Community Living Facilities Licensing Act. |
18 | | "Health care facility list" means a list enumerating |
19 | | health care facilities and their designees that are served by |
20 | | a public water supply and maintained by a public water |
21 | | distribution entity. |
22 | | "Public water distribution entity" means any of the |
23 | | following entities that are responsible for the direct |
24 | | supervision of a public water supply: a municipality, a |
25 | | private corporation, an individual private owner, or a |
26 | | regularly organized body governed by a constitution and |

1 | | by-laws requiring regular election of officers. |
2 | | "Public water supply" has the same meaning as defined in |
3 | | Section 3.365. |
4 | | "State agencies" means the Illinois Environmental |
5 | | Protection Agency and the Illinois Department of Public |
6 | | Health. |
7 | | "Water supply operator" means any individual trained in |
8 | | the treatment or distribution of water who has practical, |
9 | | working knowledge of the chemical, biological, and physical |
10 | | sciences essential to the practical mechanics of water |
11 | | treatment or distribution and who is capable of conducting and |
12 | | maintaining the water treatment or distribution processes of a |
13 | | public water supply in a manner that will provide safe, |
14 | | potable water for human consumption. |
15 | | (b) A public water distribution entity, through its |
16 | | designated employees or contractors, shall notify its water |
17 | | supply operator and all affected health care facilities , fire |
18 | | departments, and dispatch centers on the public water supply's |
19 | | disruption notification health care facility list not less |
20 | | than 14 days before any known, planned, or anticipated |
21 | | disruption event. An anticipated disruption event includes for |
22 | | purposes of this subsection any disruption event that could or |
23 | | should be reasonably anticipated by a public water |
24 | | distribution entity. |
25 | | (c) A public water distribution entity, through its |
26 | | designated employees or contractors, shall notify its water |

1 | | supply operator , and all affected health care facilities , all |
2 | | affected fire departments, and all affected dispatch centers |
3 | | on a disruption notification list that are served by the |
4 | | public water supply and affected by any unplanned disruption |
5 | | event in the public water supply's water distribution system. |
6 | | The notification required under this subsection shall be |
7 | | provided within 2 hours after the public water distribution |
8 | | entity becomes aware of the unplanned disruption event. |
9 | | (d) A health care facility , fire department, and dispatch |
10 | | center shall designate an email address to receive electronic |
11 | | notifications from the public water distribution entity |
12 | | concerning planned or unplanned disruption events. The email |
13 | | account shall be accessible to the health care facility's |
14 | | designated water management plan administrator , the fire |
15 | | department's chief officer, the dispatch center's chief |
16 | | officer, and other responsible administrative personnel. |
17 | | (e) Any planned or unplanned disruption event notification |
18 | | sent to a health care facility , fire department, or dispatch |
19 | | center under this Section shall also be sent to the State |
20 | | agencies via email to the email addresses designated by the |
21 | | State agencies within 5 business days. The State agencies |
22 | | shall establish, maintain, and retain a list of notifications |
23 | | received pursuant to this subsection. |
24 | | The notice required under this Section shall include, but |
25 | | shall not be limited to, the following: |
26 | | (1) a detailed description of the disruption event; |

1 | | (2) the date, time, and location of the disruption |
2 | | event; |
3 | | (3) the expected time needed to resolve the disruption |
4 | | event; and |
5 | | (4) a list of the health care facilities , fire |
6 | | departments, and dispatch centers notified by the public |
7 | | water distribution entity. |
8 | | Beginning one year after the effective date of this |
9 | | amendatory Act of the 102nd General Assembly, the State |
10 | | agencies shall make available upon request a list of |
11 | | disruption events, in an electronic format, sorted by the year |
12 | | and month of each occurrence. |
13 | | (f) A public water distribution entity may use contact |
14 | | information in its possession, including phone numbers, email |
15 | | addresses, and residential addresses, that it obtained before |
16 | | or after a planned or an unplanned disruption event in a public |
17 | | water supply in order to inform its customers of the |
18 | | disruption event, regardless of whether consent is expressly |
19 | | given to use the information for that purpose. |
