AMENDMENT TO HOUSE BILL 4831

2    AMENDMENT NO. ______. Amend House Bill 4831 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Small
5Single-Use Plastic Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Hotel" has the meaning given in the Hotel Operators'
8Occupation Tax Act.
9    "Personal care products" means a product intended to be
10applied to or used on the human body in the shower, bath, or
11any part thereof and shall include only shampoo, hair
12conditioner, and bath soap.
13    "Small, single-use plastic bottle" means a plastic bottle
14or container with less than a 6-ounce capacity that is
15intended to be nonreusable by the end user.

1    Section 10. Small, single-use plastic bottles at hotels.
2    (a) Beginning July 1, 2025, a hotel with 50 rooms or more
3shall not provide small, single-use plastic bottles containing
4personal care products in any space within a sleeping room
5accommodation, within bathrooms shared by the public or
6guests, or to a customer of the establishment staying in a
7sleeping room accommodation.
8    (b) Beginning January 1, 2026, a hotel shall not provide
9small, single-use plastic bottles containing personal care
10products in any space within a sleeping room accommodation,
11within bathrooms shared by the public or guests, or to a
12customer of the establishment staying in a sleeping room
13accommodation.
14    (c) A hotel may provide personal care products in small,
15single-use plastic bottles to a person at no cost, upon
16request, at a place other than a sleeping room accommodation,
17a space within the sleeping room accommodation, or a space
18within bathrooms shared by the public or guests.
19    (d) A unit of local government, including a home rule
20unit, shall not regulate the provision of small, single-use
21plastic bottles in a manner inconsistent with the regulation
22by the State of the provision of small, single-use plastic
23bottles under this Act. This Section is a limitation under
24subsection (i) of Section 6 of Article VII of the Illinois
25Constitution on the concurrent exercise by home rule units of
26powers and functions exercised by the State.

1    Section 15. Civil penalties.
2    (a) A hotel in violation of this Act shall receive a
3written warning for the first violation from a State's
4Attorney or a municipal attorney. The written warning shall
5recite the violation and advise that subsequent violations may
6result in citations and penalties. Upon a second or subsequent
7violation, the hotel may be liable for a civil penalty of $500
8for each violation after an action under subsection (b).
9    (b) A State's Attorney or municipal attorney may bring an
10action in circuit court to request a civil penalty, and a
11circuit court may impose a civil penalty under this Section
12against a hotel violating this Act.".
