2 | | AMENDMENT NO. ______. Amend House Bill 5050, AS AMENDED, |
3 | | by replacing everything after the enacting clause with the |
4 | | following: |
5 | | "Section 5. The Decennial Committees on Local Government |
6 | | Efficiency Act is amended by changing Section 25 and by adding |
7 | | Sections 35 and 40 as follows: |
8 | | (50 ILCS 70/25) |
9 | | Sec. 25. Report. Each committee shall summarize its work |
10 | | and findings within a written report, which shall include |
11 | | recommendations in respect to increased accountability and |
12 | | efficiency, and shall provide the report to the administrative |
13 | | office of each county board in which the governmental unit is |
14 | | located no later than March 31, 2025. Thereafter, the report |
15 | | shall be filed no later than 18 months after the formation of |
16 | | the committee. The report shall be made available to the |

2 | | For purposes of this Section, if a governmental unit is |
3 | | located in multiple counties, the committee may, if required, |
4 | | provide the same report to the county board of each of those |
5 | | counties. |

8 | | Sec. 35. Penalties for failure to submit a report. The |
9 | | county may impose a civil penalty of up to $1,000 by board vote |
10 | | in a public meeting against a governmental unit whose |
11 | | decennial committee failed to submit to the administrative |
12 | | office of the county board a decennial report under Section |
13 | | 25. The civil penalty shall be paid to the county that imposes |
14 | | the civil penalty. |
15 | | The States Attorney for the county that imposed the civil |
16 | | penalty may bring an action in the circuit court to enforce the |
17 | | collection of a civil penalty imposed under this Section. |

19 | | Sec. 40. County board commission; report. |
20 | | (a) Each county board shall create a decennial commission |
21 | | every 10 years to review the efficiency and cost reduction |
22 | | analysis reports submitted by decennial committees under this |
23 | | Act. The first county decennial commission must be formed by |
24 | | April 1, 2025. |

1 | | (b) Each county decennial commission shall conduct |
2 | | interviews with representatives from each governmental unit to |
3 | | review the decennial committee report for the governmental |
4 | | unit and ask follow-up questions, including questions related |
5 | | to: (1) any additional information discovered after the |
6 | | efficiency and cost reduction analysis was completed by the |
7 | | committee; (2) what steps the representatives believe can be |
8 | | achieved in an effort to reduce costs; and (3) how the |
9 | | governmental unit can work with the county to increase |
10 | | efficiency. |
11 | | (c) Each county decennial commission shall compile all |
12 | | findings into a report that also shall recommend ways to |
13 | | reduce costs and increase efficiency, shall include a plan to |
14 | | reduce the number of governmental units within the county by |
15 | | 10% to 20%, and shall include the names of each governmental |
16 | | unit whose decennial committee failed to submit a decennial |
17 | | report required under Section 25. The first county decennial |
18 | | commission report must be filed with the General Assembly by |
19 | | December 31, 2025. Thereafter, the report shall be filed no |
20 | | later than 24 months after the committees were required to be |
21 | | formed under Section 10. |
22 | | (d) After a county decennial commission has submitted the |
23 | | report required under subsection (c), the commission is |
24 | | dissolved until it is reestablished under subsection (a). |
25 | | Section 99. Effective date. This Act takes effect upon |
