1 | | AN ACT concerning local government. |
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The Fire Protection District Act is amended by |
5 | | adding Section 15e as follows: |
6 | | (70 ILCS 705/15e new) |
7 | | Sec. 15e. Dissolution of Elk Grove Rural Fire Protection |
8 | | District. |
9 | | (a) The Elk Grove Rural Fire Protection District shall be |
10 | | dissolved by operation of law effective immediately upon the |
11 | | occurrence of all the conditions set forth in subsection (c). |
12 | | (b) The president of the board of trustees of the Elk Grove |
13 | | Rural Fire Protection District serving on October 1, 2023 and |
14 | | the mayor of the Village of Mount Prospect are hereby |
15 | | appointed and authorized to close up the business affairs of |
16 | | the Elk Grove Rural Fire Protection District, including by |
17 | | performing, or causing to be performed, all activities |
18 | | necessary to cause the conditions set forth in subsection (c) |
19 | | to be satisfied. The president of the board of trustees of the |
20 | | Elk Grove Rural Fire Protection District serving on October 1, |
21 | | 2023 and the mayor of the Village of Mount Prospect shall |
22 | | unanimously approve all actions taken by them in connection |
23 | | with the closing up of the business affairs of the Elk Grove |

1 | | Rural Fire Protection District. |
2 | | (c) After all the following conditions have been |
3 | | satisfied, the dissolution of the Elk Grove Rural Fire |
4 | | Protection District shall become effective immediately: |
5 | | (1) the payment of all outstanding liabilities of the |
6 | | Elk Grove Rural Fire Protection District; |
7 | | (2) the conveyance of title of all of the Elk Grove |
8 | | Rural Fire Protection District's remaining real and |
9 | | personal property to the Village of Mount Prospect in |
10 | | accordance with the agreement entered into between the Elk |
11 | | Grove Rural Fire Protection District, the Village of Mount |
12 | | Prospect, and Elk Grove Township; and |
13 | | (3) the submittal to, and approval by resolution |
14 | | adopted by, the Cook County Board of Commissioners of an |
15 | | accounting showing that all known outstanding liabilities |
16 | | of the Elk Grove Fire Protection District have been paid |
17 | | and title of all of the Elk Grove Rural Fire Protection |
18 | | District's known real and personal property has been |
19 | | conveyed to the Village of Mount Prospect. |
20 | | After the Cook County Board of Commissioners passes a |
21 | | resolution approving the accounting described in this |
22 | | paragraph (3), title of any remaining money of the Elk |
23 | | Grove Rural Fire Protection District shall, by operation |
24 | | of law, be transferred to the Village of Mount Prospect in |
25 | | accordance with the agreement entered into between the Elk |
26 | | Grove Rural Fire Protection District, the Village of Mount |

1 | | Prospect, and Elk Grove Township. |
2 | | Any bank or other financial institution at which the Elk |
3 | | Grove Rural Fire Protection District has accounts is |
4 | | authorized, upon presentment of a certified copy of the |
5 | | resolution passed by the Cook County Board of Commissioners |
6 | | approving the accounting described in paragraph (3), to |
7 | | transfer the funds in the Elk Grove Rural Fire Protection |
8 | | District's accounts to the Village of Mount Prospect. |
9 | | (d) Notwithstanding the requirements of Section 27-5 of |
10 | | the Property Tax Code, the Special Service Area created by the |
11 | | Village of Mount Prospect and approved by Cook County in order |
12 | | to take the place of the Elk Grove Rural Fire Protection |
13 | | District's tax levy after dissolution shall not require |
14 | | geographical contiguity. |
15 | | Section 99. Effective date. This Act takes effect upon |
16 | | becoming law. |
