AMENDMENT TO HOUSE BILL 5179

2    AMENDMENT NO. ______. Amend House Bill 5179 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Liquor Control Act of 1934 is amended by
5changing Sections 3-5, 3-6, and 3-9 as follows:
 
6    (235 ILCS 5/3-5)  (from Ch. 43, par. 101)
7    Sec. 3-5. Each commissioner, the secretary, and the
8Executive Director, and each person appointed by the
9commission shall, before entering upon the duties of his or
10her office, take and subscribe to the constitutional oath of
11office. No commissioner, The secretary, the Executive
12Director, and each inspector, clerk, or and other employee
13shall solicit or accept any gift, gratuity, emolument, or
14employment from any person subject to the provisions of this
15Act devote his or her entire time to the duties of his or her
16office.

3    Sec. 3-6. No person shall be appointed a commissioner,
4secretary, Executive Director, or inspector for the commission
5who is not a citizen of the United States. No commissioner,
6secretary, Executive Director, inspector, or other employee
7shall be appointed who has been convicted of any violation of
8any Federal or State law concerning the manufacture or sale of
9alcoholic liquor prior or subsequent to the passage of this
10Act or who has paid a fine or penalty in settlement of any
11prosecution against him or her for any violation of such laws
12or shall have forfeited his or her bond to appear in court to
13answer charges for any such violation, nor shall any person be
14appointed who has been convicted of a felony. No commissioner,
15secretary, Executive Director, inspector, or other employee,
16may, directly or indirectly, individually or as a member of a
17partnership, or as a shareholder of a corporation, have any
18interest whatsoever in the manufacture, sale or distribution
19of alcoholic liquor, nor receive any compensation or profit
20therefrom, nor have any interest whatsoever in the purchases
21or sales made by the persons authorized by this Act, or to
22purchase or to sell alcoholic liquor. No provision of this
23section shall prevent any such commissioner, secretary,
24Executive Director, inspector, or other employee from
25purchasing and keeping in his or her possession for the use of

1himself or herself or members of his or her family or guests
2any alcoholic liquor which may be purchased or kept by any
3person by virtue of this Act.

6    Sec. 3-9. Compensation of commissioners, secretary, and
7employees. The chairman of the Commission shall receive an
8annual salary of $32,000 or such greater amount as may be set
9by the Compensation Review Board. The other commissioners
10shall receive an annual salary of $28,000 or such greater
11amount as may be set by the Compensation Review Board. The
12secretary of the Commission shall receive an annual salary as
13set by the Compensation Review Board. All clerks, inspectors,
14and employees of the Commission shall receive reasonable
15compensation in the manner similar to other State employees in
16an amount fixed by the Commission, subject to the approval in
17writing of the Governor.
