1 | AMENDMENT TO HOUSE BILL 5189 | ||||||
2 | AMENDMENT NO. ______. Amend House Bill 5189 by replacing | ||||||
3 | everything after the enacting clause with the following: | ||||||
4 | "Section 5. The Illinois Vehicle Code is amended by adding | ||||||
5 | Section 18c-7402.2 as follows: | ||||||
6 | (625 ILCS 5/18c-7402.2 new) | ||||||
7 | Sec. 18c-7402.2. Reports involving railroad fatalities. | ||||||
8 | Personally identifying information, as defined in Section | ||||||
9 | 1-159.2, of train crew members contained in reports involving | ||||||
10 | railroad fatalities and contained in communications between | ||||||
11 | police officers and train crew members involved in those | ||||||
12 | occurrences shall be redacted from any public reports and | ||||||
13 | shall be maintained by the police departments and any persons | ||||||
14 | in subsequent possession thereof listed below in a manner that | ||||||
15 | ensures the confidentiality of the train crew's personally | ||||||
16 | identifying information. Unredacted copies of such reports and |

1 | communications containing personally identifying information | ||||||
2 | shall be accessible at all reasonable times: | ||||||
3 | (1) to the host or employing railroad; | ||||||
4 | (2) by court order, and to others specifically | ||||||
5 | authorized by court order to obtain the information if the | ||||||
6 | access is necessary in the performance of their duties; | ||||||
7 | and | ||||||
8 | (3) to law enforcement officers, State's Attorneys, | ||||||
9 | Assistant State's Attorneys, and Illinois Commerce | ||||||
10 | Commission staff if the access is necessary in the | ||||||
11 | performance of their duties. ". |
