1 | AN ACT concerning safety. | |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly: | |||||||||||||||||||
4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||
5 | Microstamping-Enabled Pistols Act. | |||||||||||||||||||
6 | Section 5. Definitions. In this Act: | |||||||||||||||||||
7 | "Microstamp" means a unique alphanumeric or geometric code | |||||||||||||||||||
8 | that identifies the make, model, and serial number of a | |||||||||||||||||||
9 | firearm. | |||||||||||||||||||
10 | "Microstamping component" means a component part of a | |||||||||||||||||||
11 | semiautomatic pistol that will produce a microstamp on at | |||||||||||||||||||
12 | least one location of the expended cartridge case each time | |||||||||||||||||||
13 | the pistol is fired. | |||||||||||||||||||
14 | "Microstamping-enabled pistol" means a semiautomatic | |||||||||||||||||||
15 | pistol that contains a microstamping component. | |||||||||||||||||||
16 | Section 10. Microstamping standards and processes. | |||||||||||||||||||
17 | (a) The Director of the Illinois State Police or the | |||||||||||||||||||
18 | Director's designee shall: | |||||||||||||||||||
19 | (1) within 180 days after the effective date of this | |||||||||||||||||||
20 | Act, engage in and complete an investigation to certify | |||||||||||||||||||
21 | the technological viability of microstamping-enabled | |||||||||||||||||||
22 | pistols. This investigation shall include live-fire |

1 | testing evidence; and | ||||||
2 | (2) within 180 days after the effective date of this | ||||||
3 | Act, certify or decline to certify that | ||||||
4 | microstamping-enabled pistols are technologically viable. | ||||||
5 | Following a certification by the Illinois State Police | ||||||
6 | that microstamping-enabled pistols are technologically | ||||||
7 | viable, the Illinois State Police shall: | ||||||
8 | (A) within 365 days after the effective date of | ||||||
9 | this Act, establish performance standards, qualifying | ||||||
10 | criteria and testing protocols applicable to the | ||||||
11 | examination and verification of microstamping-enabled | ||||||
12 | pistols and microstamping components; | ||||||
13 | (B) within 2 years after the effective date of | ||||||
14 | this Act, establish and implement verification | ||||||
15 | processes for microstamping-enabled pistols and | ||||||
16 | microstamping components; | ||||||
17 | (C) within 2 years after the effective date of | ||||||
18 | this Act, establish processes and standards for the | ||||||
19 | training and licensure of persons, associations, | ||||||
20 | partnerships, corporations, or other entities so that | ||||||
21 | they may engage in the business of servicing | ||||||
22 | semiautomatic pistols and their components to ensure | ||||||
23 | compliance with the requirements of this Act; and | ||||||
24 | (D) within 2 years after the effective date of | ||||||
25 | this Act, establish a division within the Illinois | ||||||
26 | State Police to service semiautomatic pistols and |

3 | Section 15. Microstamping requirements. | ||||||
4 | (a) It is unlawful for any dealer in firearms licensed | ||||||
5 | under the Firearm Dealer License Certification Act to sell, | ||||||
6 | offer for sale, exchange, give, transfer or deliver any | ||||||
7 | semiautomatic pistol unless such pistol has been verified as a | ||||||
8 | microstamping-enabled pistol. A pistol may be verified as | ||||||
9 | microstamping-enabled if it contains a microstamp component | ||||||
10 | installed by its manufacturer or by a State licensed person, | ||||||
11 | association, partnership, corporation, or other entity in | ||||||
12 | compliance with State standards established by the Director of | ||||||
13 | the Illinois State Police or the Director's designee. | ||||||
14 | (b) A violation of subsection (a) is a Class 3 felony. | ||||||
15 | (c) The provisions of this Section do not apply to a pistol | ||||||
16 | manufactured prior to the effective date of this Act. | ||||||
17 | (d) This Section becomes operative either 4 years after | ||||||
18 | certification that microstamping-enabled pistols are | ||||||
19 | technologically viable by the Director of the Illinois State | ||||||
20 | Police or the Director's designee, or one year after a person | ||||||
21 | association, partnership, corporation, or other entity has | ||||||
22 | been licensed to engage in the business of servicing firearms | ||||||
23 | and their components to ensure compliance with the | ||||||
24 | requirements of this Act, whichever is earlier. | ||||||
25 | Section 99. Effective date. This Act takes effect upon |
