AMENDMENT TO HOUSE BILL 5371

2    AMENDMENT NO. ______. Amend House Bill 5371 as follows:
 
3on page 19, line 9, by deleting "2-102," and "7-101,"; and
 
4by deleting line 11 on page 19 through line 14 on page 31; and
 
5by deleting line 20 on page 35 through line 10 on page 38; and
 
6on page 56, below line 21, by inserting the following:
 
7    "Section 6. The Illinois Human Rights Act is amended by
8changing Section 7-101 as follows:
 
9    (775 ILCS 5/7-101)  (from Ch. 68, par. 7-101)
10    Sec. 7-101. Powers and duties. In addition to other powers
11and duties prescribed in this Act, the Department shall have
12the following powers:

1    (A) Rules and Regulations. To adopt, promulgate, amend,
2and rescind rules and regulations not inconsistent with the
3provisions of this Act pursuant to the Illinois Administrative
4Procedure Act.
5    (B) Charges. To issue, receive, investigate, conciliate,
6settle, and dismiss charges filed in conformity with this Act.
7    (C) Compulsory Process. To request subpoenas as it deems
8necessary for its investigations.
9    (D) Complaints. To file complaints with the Commission in
10conformity with this Act and to intervene in complaints
11pending before the Commission filed under Article 2, 4, 5, 5A,
12or 6.
13    (E) Judicial Enforcement. To seek temporary relief and to
14enforce orders of the Commission in conformity with this Act.
15    (F) Equal Employment Opportunities. To take such action as
16may be authorized to provide for equal employment
17opportunities and affirmative action.
18    (G) Recruitment; Research; Public Communication; Advisory
19Councils. To engage in such recruitment, research and public
20communication and create such advisory councils as may be
21authorized to effectuate the purposes of this Act.
22    (H) Coordination with other Agencies. To coordinate its
23activities with federal, state, and local agencies in
24conformity with this Act.
25    (I) Grants; Private Gifts.
26        (1) To accept public grants and private gifts as may

1    be authorized.
2        (2) To design grant programs and award grants to
3    eligible recipients.
4    (J) Education and Training. To implement a formal and
5unbiased program of education and training for all employees
6assigned to investigate and conciliate charges under Articles
77A and 7B. The training program shall include the following:
8        (1) substantive and procedural aspects of the
9    investigation and conciliation positions;
10        (2) current issues in human rights law and practice;
11        (3) lectures by specialists in substantive areas
12    related to human rights matters;
13        (4) orientation to each operational unit of the
14    Department and Commission;
15        (5) observation of experienced Department
16    investigators and attorneys conducting conciliation
17    conferences, combined with the opportunity to discuss
18    evidence presented and rulings made;
19        (6) the use of hypothetical cases requiring the
20    Department investigator and conciliation conference
21    attorney to issue judgments as a means to evaluating
22    knowledge and writing ability;
23        (7) writing skills;
24        (8) computer skills, including but not limited to word
25    processing and document management.
26    A formal, unbiased and ongoing professional development

1program including, but not limited to, the above-noted areas
2shall be implemented to keep Department investigators and
3attorneys informed of recent developments and issues and to
4assist them in maintaining and enhancing their professional
5competence.
6    (K) Hotlines. To establish and maintain hotlines and
7helplines to aid in effectuating the purposes of this Act
8including the confidential reporting of discrimination,
9harassment, and bias incidents. All communications received or
10sent via the hotlines and helplines are exempt from disclosure
11under the Freedom of Information Act.

15    "Section 99. Effective date. This Act takes effect upon
16becoming law except that Sections 5 and 10 take effect January
