| 2 | AMENDMENT NO. ______. Amend House Bill 5397 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Illinois Petroleum Education and Marketing | ||||||
| 5 | Act is amended by changing Section 10 as follows: | ||||||
| 6 | (225 ILCS 728/10) | ||||||
| 7 | (Section scheduled to be repealed on January 1, 2028) | ||||||
| 8 | Sec. 10. Illinois Petroleum Resources Board. | ||||||
| 9 | (a) There is hereby created the Illinois Petroleum | ||||||
| 10 | Resources Board, which shall be subject to the provisions of | ||||||
| 11 | the Regulatory Sunset Act. The purpose of the Board is to | ||||||
| 12 | coordinate a program designed to demonstrate to the general | ||||||
| 13 | public the importance of the Illinois oil and gas exploration | ||||||
| 14 | and production industry, to encourage the wise and efficient | ||||||
| 15 | use of energy, to promote environmentally sound production | ||||||
| 16 | methods and technologies, to develop existing supplies of | ||||||
| |||||||
| |||||||
| 1 | State oil and gas resources, to support research and | ||||||
| 2 | educational activities concerning the oil and gas exploration | ||||||
| 3 | and production industry, and to support oilfield environmental | ||||||
| 4 | remediation and restoration activities. | ||||||
| 5 | (b) The Board shall be composed of 12 members to be | ||||||
| 6 | appointed as follows: | ||||||
| 7 | (1) Through December 31, 2006, the Governor shall make | ||||||
| 8 | appointments from a list of names submitted by qualified | ||||||
| 9 | producer associations, of which 10 shall be oil and gas | ||||||
| 10 | producers. | ||||||
| 11 | (2) Beginning January 1, 2007 and through the | ||||||
| 12 | effective date of this amendatory Act of the 103rd General | ||||||
| 13 | Assembly, all appointments shall be made by the qualified | ||||||
| 14 | producer associations. | ||||||
| 15 | (3) Beginning on the effective date of this amendatory | ||||||
| 16 | Act of the 103rd General Assembly, the Director of Natural | ||||||
| 17 | Resources shall make appointments to the Board, of which | ||||||
| 18 | 10 shall be oil and gas producers. The Director may make | ||||||
| 19 | these appointments based on names submitted to the | ||||||
| 20 | Department of Natural Resources by oil and gas producers | ||||||
| 21 | in the State. | ||||||
| 22 | (c) A member of the Board shall: | ||||||
| 23 | (1) be at least 25 years of age; | ||||||
| 24 | (2) be a resident of the State of Illinois; and | ||||||
| 25 | (3) have at least 5 years of active experience in the | ||||||
| 26 | oil industry. | ||||||

| 1 | (d) Members shall serve for a term of 3 years, except that | ||||||
| 2 | of the initial appointments, 4 members shall serve for one | ||||||
| 3 | year, 4 members for 2 years, and 4 members for 3 years. | ||||||
| 4 | (e) Vacancies shall be filled for the unexpired term of | ||||||
| 5 | office in the same manner as the original appointment. | ||||||
| 6 | (f) The Board shall, at its first meeting, elect one of its | ||||||
| 7 | members as chairperson, who shall preside over meetings of the | ||||||
| 8 | Board and perform other duties that may be required by the | ||||||
| 9 | Board. The first meeting of the Board shall be called by the | ||||||
| 10 | Governor. | ||||||
| 11 | (g) No member of the Board shall receive a salary or | ||||||
| 12 | reimbursement for duties performed as a member of the Board, | ||||||
| 13 | except that members are eligible to receive reimbursement for | ||||||
| 14 | travel expenses incurred in the performance of Board duties. | ||||||
