1 | | AN ACT concerning civil law. |
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly: |
4 | | Section 5. The Code of Civil Procedure is amended by |
5 | | adding Section 21-106 as follows: |
6 | | (735 ILCS 5/21-106 new) |
7 | | Sec. 21-106. Legislative intent. Residents of this State |
8 | | who were born in another state or in another country may have |
9 | | difficulty in securing government-issued documents with the |
10 | | correct information. It is the intent of the General Assembly |
11 | | that Illinois should have a legal process available for these |
12 | | residents to seek a judicial order making findings of fact so |
13 | | that they may petition the issuing jurisdiction to change such |
14 | | a document. |
15 | | (a) Process. An Illinois resident may file a petition in |
16 | | his or her county of residence asking for a court to issue a |
17 | | finding of fact or facts to correct or update a |
18 | | government-issued document from another state or country. As |
19 | | used in this Section, "government-issued document" includes, |
20 | | but is not limited to, birth certificate, passport, driver's |
21 | | license, or identification card. |
22 | | (b) The petition must contain the following information: |
23 | | (1) petitioner's name and current address; |
