SYNOPSIS AS INTRODUCED:
 
735 ILCS 5/21-106 new

    Amends the Code of Civil Procedure. Creates a process that Illinois residents may use to seek an Illinois judicial order making findings of fact to change a government-issued document from another state or country so that they may petition the issuing jurisdiction to change such a document.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Code of Civil Procedure is amended by
5adding Section 21-106 as follows:
 
6    (735 ILCS 5/21-106 new)
7    Sec. 21-106. Legislative intent. Residents of this State
8who were born in another state or in another country may have
9difficulty in securing government-issued documents with the
10correct information. It is the intent of the General Assembly
11that Illinois should have a legal process available for these
12residents to seek a judicial order making findings of fact so
13that they may petition the issuing jurisdiction to change such
14a document.
15    (a) Process. An Illinois resident may file a petition in
16his or her county of residence asking for a court to issue a
17finding of fact or facts to correct or update a
18government-issued document from another state or country. As
19used in this Section, "government-issued document" includes,
20but is not limited to, birth certificate, passport, driver's
21license, or identification card.
22    (b) The petition must contain the following information:
23        (1) petitioner's name and current address;

1        (2) the government-issued document that is at issue;
2        (3) the change that is sought;
3        (4) the reason for the change; and
4        (5) any person or entity that should receive notice of
5    this petition, if any.
6    (c) The court must schedule a hearing for this request and
7may, depending on the facts alleged in the petition, order
8notice of the hearing to a person or entity.
