| 1 | AMENDMENT TO SENATE BILL 188

| 2 | AMENDMENT NO. ______. Amend Senate Bill 188 on page 1, by | ||||||
| 3 | replacing lines 18 through 23 with the following: | ||||||
| 4 | "A parent who consents to the performance upon the | ||||||
| 5 | parent's
child of a health care service under this Section | ||||||
| 6 | shall be
entitled, upon request, to inspect and copy the part | ||||||
| 7 | of that child's records related to the specific health care | ||||||
| 8 | service
for which the parent is treated as the child's | ||||||
| 9 | personal
representative under HIPAA, 45 CFR 164.502(g). For | ||||||
| 10 | purposes of this Section, each appointment, referral, test, | ||||||
| 11 | treatment, procedure, or other medical intervention is a | ||||||
| 12 | separate and distinct health care service for the purpose of | ||||||
| 13 | determining whether a parent is treated as the child's | ||||||
| 14 | personal representative under HIPAA, 45 CFR 164.502(g), with | ||||||
| 15 | respect to that health care service.".
