1 | AN ACT concerning public employee benefits.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||
4 | Section 5. The Illinois Pension Code is amended by | |||||||||||||||||||||
5 | changing Sections 16-163 and 16-164 as follows: | |||||||||||||||||||||
6 | (40 ILCS 5/16-163) (from Ch. 108 1/2, par. 16-163) | |||||||||||||||||||||
7 | Sec. 16-163. Board created. A board of 13 15 members | |||||||||||||||||||||
8 | constitutes the
board of trustees authorized to carry out the | |||||||||||||||||||||
9 | provisions of this Article and is
responsible for the general | |||||||||||||||||||||
10 | administration of the System. The board shall
be known as the | |||||||||||||||||||||
11 | Board of Trustees of the Teachers' Retirement System
of the | |||||||||||||||||||||
12 | State of Illinois. The board shall be composed of the
| |||||||||||||||||||||
13 | Superintendent of Education, ex officio; 5 7 persons, not | |||||||||||||||||||||
14 | members of the System, to be appointed by the Governor,
who | |||||||||||||||||||||
15 | shall hold no elected State office; 5 persons who, at the time | |||||||||||||||||||||
16 | of their
election, are
teachers as defined in Section 16-106, | |||||||||||||||||||||
17 | elected by the
contributing members; and 2 annuitant members | |||||||||||||||||||||
18 | elected by the annuitants of the
System, as provided in | |||||||||||||||||||||
19 | Section 16-165.
The president of the board shall be appointed | |||||||||||||||||||||
20 | by the Governor from among the trustees.

1 | Sec. 16-164. Board; appointed members; vacancies. Terms of | ||||||
2 | office for
the appointed members shall begin on July 15 of an | ||||||
3 | even-numbered year, except that the terms of office for | ||||||
4 | members appointed pursuant to this amendatory Act of the 96th | ||||||
5 | General Assembly shall begin upon being confirmed by the | ||||||
6 | Senate.
The Governor shall appoint 2 or 3 members , whichever | ||||||
7 | is applicable, as trustees with the advice and consent of the | ||||||
8 | Senate in each even-numbered year
who shall hold office for a | ||||||
9 | term of 4 years, except that, of the members appointed | ||||||
10 | pursuant to this amendatory Act of the 96th General Assembly, | ||||||
11 | 3 members shall be appointed for a term ending July 14, 2012 | ||||||
12 | and 3 members shall be appointed for a term ending July 14, | ||||||
13 | 2014. The Governor shall appoint the additional member | ||||||
14 | authorized under this amendatory Act of the 101st General | ||||||
15 | Assembly with the advice and consent of the Senate for a term | ||||||
16 | beginning on July 15, 2020 and ending July 14, 2022, and | ||||||
17 | successors shall hold office for a term of 4 years. Each such | ||||||
18 | appointee shall reside in and be
a taxpayer in the territory | ||||||
19 | covered by this system, shall be interested
in public school | ||||||
20 | welfare, and experienced and competent in financial and
| ||||||
21 | business management. A vacancy in the term of an appointed
| ||||||
22 | trustee shall be filled for the unexpired term by appointment | ||||||
23 | of the
Governor.

24 | Notwithstanding any provision of this Section to the | ||||||
25 | contrary, the term of office of each member of the Board | ||||||
26 | appointed by the Governor who is sitting on the Board on the |

1 | effective date of this amendatory Act of the 96th General | ||||||
2 | Assembly is terminated on that effective date. A trustee | ||||||
3 | sitting on the Board on the effective date of this amendatory | ||||||
4 | Act of the 96th General Assembly may not hold over in office | ||||||
5 | for more than 60 days after the effective date of this | ||||||
6 | amendatory Act of the 96th General Assembly. Nothing in this | ||||||
7 | Section shall prevent the Governor from making a temporary | ||||||
8 | appointment or nominating a trustee holding office on the day | ||||||
9 | before the effective date of this amendatory Act of the 96th | ||||||
10 | General Assembly. | ||||||

12 | Section 99. Effective date. This Act takes effect July 1, | ||||||
13 | 2024.
