2 | | Sec. 5. Findings. The General Assembly finds the |
3 | | following: |
4 | | (1) Illinois' transportation system is crucial to |
5 | | every resident, employee, and business. It serves as the |
6 | | backbone of the economy and is a critical component of |
7 | | Illinois' economic competitiveness. |
8 | | (2) The State must continue to pursue an equitable |
9 | | transportation network in which marginalized communities |
10 | | have improved access to all modes of transportation, |
11 | | thereby enhancing access to jobs, housing, and other |
12 | | services. |
13 | | (3) Illinois is home to an expansive transportation |
14 | | network, currently ranking third in the nation for the |
15 | | number of roadway miles and bridges, totaling 127,044 and |
16 | | 26,848, respectively. The State also has 6,883 miles of |
17 | | freight railway, 1,118 inland waterway miles, 58 transit |
18 | | systems with over 450 million annual transit trips, and 17 |
19 | | major airports. |
20 | | (4) The historic Rebuild Illinois capital plan adopted |
21 | | in 2019 will end in June 2025. |
22 | | (5) The motor fuel tax and vehicle registration fees |
23 | | remain the most significant form of transportation funding |
24 | | for Illinois. |
25 | | (6) Illinois will continue to contend with |
26 | | transportation funding shortfalls due to increasing |

1 | | vehicle fuel efficiency and the rising popularity of |
2 | | electric vehicles. |
3 | | (7) New and innovative funding and policy options are |
4 | | needed to adequately maintain Illinois' transportation |
5 | | systems and support future growth. |
6 | | (8) The General Assembly should study these issues to |
7 | | determine funding mechanisms for transportation projects |
8 | | and operations in Illinois, policy changes to support the |
9 | | efficient governance and delivery of transportation |
10 | | projects, and the workforce needed to support the future |
11 | | transportation system.

14 | | Sec. 10. Commission created. |
15 | | (a) The Blue-Ribbon Commission on Transportation |
16 | | Infrastructure Funding and Policy is created within the |
17 | | Department of Transportation consisting of members appointed |
18 | | as follows: |
19 | | (1) Four members of the House of Representatives, with |
20 | | 2 to be appointed by the Speaker of the House of |
21 | | Representatives and 2 to be appointed by the Minority |
22 | | Leader of the House of Representatives. |
23 | | (2) Four members of the Senate, with 2 to be appointed |
24 | | by the President of the Senate and 2 to be appointed by the |
25 | | Minority Leader of the Senate. |

1 | | (3) Eight members appointed by the Governor with the |
2 | | advice and consent of the Senate. |
3 | | (4) The chair of the Commission to be appointed by the |
4 | | Governor from among his 8 appointments. |
5 | | (b) Members shall have expertise, knowledge, or experience |
6 | | in transportation infrastructure development, construction, |
7 | | workforce, or policy. Members shall also represent a diverse |
8 | | set of sectors, including the labor, engineering, |
9 | | construction, transit, active transportation, rail, air, or |
10 | | other sectors, and shall include participants of the |
11 | | Disadvantaged Business Enterprise Program. No more than 2 |
12 | | appointees shall be members of the same sector. |
13 | | (c) Members shall represent geographically diverse regions |
14 | | of the State. |
15 | | (d) Members shall be appointed by June 30 January 31 , |
16 | | 2023.

19 | | Sec. 15. Meetings. The Commission shall hold its first |
20 | | meeting by July 31 February 15 , 2023. The Commission may |
21 | | conduct meetings at such places and at such times as it may |
22 | | deem necessary or convenient to enable it to exercise fully |
23 | | and effectively its powers, perform its duties, and accomplish |
24 | | its objectives and purposes.

2 | | Sec. 20. Duties. The Commission shall evaluate Illinois' |
3 | | existing transportation infrastructure funding and policy |
4 | | processes and develop alternative solutions. The Commission |
5 | | shall: |
6 | | (1) Evaluate current transportation funding in |
7 | | Illinois, taking into account the viability of existing |
8 | | revenue sources and funding distributions. |
9 | | (2) Consider new and innovative funding options. |
10 | | (3) Evaluate the existing governance of Illinois' |
11 | | transportation system, including roles and |
12 | | responsibilities for the State and county, township, and |
13 | | municipal governments. |
14 | | (4) Evaluate current and future workforce needs to |
15 | | design, construct, and manage the state's transportation |
16 | | system within the Illinois Department of Transportation |
17 | | and within the State as a whole. |
18 | | (5) Evaluate current and future data needs of the |
19 | | Illinois Department of Transportation. |
20 | | (6) Consider and recommend steps to expedite project |
21 | | approval and completion. |
22 | | (7) Consider future trends that will impact the |
23 | | transportation system, including safety needs, racial |
24 | | equity, electric vehicles, and climate change. |
25 | | (8) Consider ways to improve transportation investment |

1 | | impacts on goals such as improving racial equity, |
2 | | addressing climate change, and increasing economic growth. |
3 | | (9) Consider improvements to the performance-based |
4 | | programming system. |
5 | | (10) Consider multimodal system needs, including |
6 | | public transportation, bicycle facilities, railways, |
7 | | waterways, and airports. |
8 | | (11) Consider alternative solutions employed by other |
9 | | states.

12 | | Sec. 25. Report. The Commission shall direct the Illinois |
13 | | Department of Transportation to enter into a contract with a |
14 | | third party to assist the Commission in producing a document |
15 | | that evaluates the topics under this Act and outline formal |
16 | | recommendations that can be acted upon by the General |
17 | | Assembly. The Commission shall report a summary of its |
18 | | activities and produce a final report of the data, findings, |
19 | | and recommendations to the General Assembly by January 1, 2024 |
20 | | September 15, 2023 . The final report shall include specific, |
21 | | actionable recommendations for legislation and organizational |
22 | | adjustments. The final report may include recommendations for |
23 | | pilot programs to test alternatives. The final report and |
24 | | recommendations shall also include any minority and individual |
25 | | views of task force members.

3 | | Sec. 27. Continuation of Act; validation. |
4 | | (a) The General Assembly finds and declares that: |
5 | | (1) Public Act 102-1129, which took effect on February |
6 | | 10, 2023, changed the repeal date set for the Blue-Ribbon |
7 | | Commission on Transportation Infrastructure Funding and |
8 | | Policy Act from February 1, 2023 to September 30, 2023. |
9 | | (2) The Statute on Statutes sets forth general rules
|
10 | | on the repeal of statutes and the construction of multiple |
11 | | amendments, but Section 1 of that Act also states that |
12 | | these rules will not be observed when the result would be |
13 | | "inconsistent with the manifest intent of the General |
14 | | Assembly or repugnant to the context of the statute". |
15 | | (3) This amendatory Act of the 103rd General Assembly
|
16 | | manifests the intention of the General Assembly to extend |
17 | | the repeal of the Blue-Ribbon Commission on Transportation |
18 | | Infrastructure Funding and Policy Act and have the |
19 | | Blue-Ribbon Commission on Transportation Infrastructure |
20 | | Funding and Policy Act continue in effect until February |
21 | | 1, 2024. |
22 | | (4) The Blue-Ribbon Commission on Transportation |
23 | | Infrastructure Funding and Policy Act was
originally |
24 | | enacted to protect, promote, and preserve the general |
25 | | welfare. Any construction of this Act that results in the |

1 | | repeal of this Act on February 1, 2023, would be |
2 | | inconsistent with the manifest intent of the General |
3 | | Assembly and repugnant to the context of the Blue-Ribbon |
4 | | Commission on Transportation Infrastructure Funding and |
5 | | Policy Act. |
6 | | (b) It is hereby declared to have been the intent of the |
7 | | General Assembly that the Blue-Ribbon Commission on |
8 | | Transportation Infrastructure Funding and Policy Act not be |
9 | | subject to repeal on February 1, 2023. |
10 | | (c) The Blue-Ribbon Commission on Transportation |
11 | | Infrastructure Funding and Policy Act shall be deemed to have |
12 | | been in continuous effect since May 27, 2022 (the effective |
13 | | date of Public Act 102-998), and it shall continue to be in |
14 | | effect until it is otherwise lawfully repealed. All previously |
15 | | enacted amendments to the Act taking effect on or after |
16 | | February 1, 2023, are hereby validated. |
17 | | (d) All actions taken in reliance on or pursuant to the |
18 | | Blue-Ribbon Commission on Transportation Infrastructure |
19 | | Funding and Policy Act by any person or entity are hereby |
20 | | validated. |
21 | | (e) In order to ensure the continuing effectiveness of the |
22 | | Blue-Ribbon Commission on Transportation Infrastructure |
23 | | Funding and Policy Act, it is set forth in full and reenacted |
24 | | by this amendatory Act of the 103rd General Assembly. Striking |
25 | | and underscoring are used only to show changes being made to |
26 | | the base text. This reenactment is intended as a continuation |

1 | | of the Act. It is not intended to supersede any amendment to |
2 | | the Act that is enacted by the 103rd General Assembly. |
3 | | (f) The Blue-Ribbon Commission on Transportation |
4 | | Infrastructure Funding and Policy Act applies to all claims, |
5 | | civil actions, and proceedings pending on or filed on or |
6 | | before the effective date of this amendatory Act of the 103rd |
7 | | General Assembly. |
