2 | AMENDMENT NO. ______. Amend Senate Bill 1210 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Recreational Trails of Illinois Act is | ||||||
5 | amended by changing Section 12 as follows: | ||||||
6 | (20 ILCS 862/12) | ||||||
7 | Sec. 12. Recreational Trail Programs; powers and | ||||||
8 | authorities. | ||||||
9 | (a) The Department may expend funds for recreational trail | ||||||
10 | program purposes and for the maintenance and restoration of | ||||||
11 | the existing part of the National Road located in southeastern | ||||||
12 | Illinois . The Department may: plan, survey, design, develop, | ||||||
13 | operate, and maintain recreational trails and related | ||||||
14 | facilities of the State; maintain and restore the existing | ||||||
15 | part of the National Road located in southeastern Illinois; | ||||||
16 | prepare, or cause to be prepared, those plans, specifications, |

1 | and other documents as are necessary to advertising for and | ||||||
2 | the taking and acceptance of bids and letting of construction | ||||||
3 | contracts for those recreational trail projects and for the | ||||||
4 | maintenance and restoration of the existing part of the | ||||||
5 | National Road located in southeastern Illinois , as required in | ||||||
6 | the Illinois Procurement Code; enter into contracts for | ||||||
7 | construction management or supervision on all recreational | ||||||
8 | trail projects constructed; enter into contracts for | ||||||
9 | professional services for planning, testing, design, or | ||||||
10 | consulting on all recreational trail projects constructed; and | ||||||
11 | acquire land, waters, structures, and interests in land, | ||||||
12 | waters, and structures for those areas and related facilities. | ||||||
13 | The Department may enter into contracts and agreements with | ||||||
14 | the United States or any appropriate or allowable federal | ||||||
15 | entity, keep financial and other records, and furnish to | ||||||
16 | appropriate officials and agencies of the United States | ||||||
17 | reports and information as may be reasonably necessary to | ||||||
18 | enable those officials and agencies to perform their duties | ||||||
19 | under those programs. In connection with obtaining for the | ||||||
20 | State the benefits of any program, the Department shall | ||||||
21 | coordinate its activities with and represent the interest of | ||||||
22 | all agencies of the State and units of local government and | ||||||
23 | with appropriate and allowable not-for-profit and private | ||||||
24 | organizations having interests in the acquisition, planning, | ||||||
25 | development, and maintenance of recreational trail resources | ||||||
26 | and related facilities within the State. |

1 | (b) The Department may execute projects for recreational | ||||||
2 | trail purposes and for the maintenance and restoration of the | ||||||
3 | existing part of the National Road located in southeastern | ||||||
4 | Illinois using funds made available to the Department from | ||||||
5 | State appropriations, the federal government, and other public | ||||||
6 | and private sources in the exercise of its statutory powers | ||||||
7 | and duties. Projects involving participating federal-aid funds | ||||||
8 | may be undertaken by the Department after it has been | ||||||
9 | determined that sufficient funds are available to the | ||||||
10 | Department for meeting the non-federal share of project costs. | ||||||
11 | It is the legislative intent that, to the extent as may be | ||||||
12 | necessary to assure the proper operation, maintenance, and | ||||||
13 | preservation of areas and facilities surveyed, acquired, or | ||||||
14 | developed under any program participated in by this State | ||||||
15 | under authority of this Act, the areas and facilities shall be | ||||||
16 | maintained for public recreational trail purposes. The | ||||||
17 | Department may enter into and administer agreements with the | ||||||
18 | United States or any appropriate federal agency for survey, | ||||||
19 | planning, acquisition, development, and preservation projects | ||||||
20 | involving participating federal-aid funds on behalf of any | ||||||
21 | federal, State, or local unit of government or appropriate and | ||||||
22 | allowable not-for-profit or private organizations, provided | ||||||
23 | the federal, State, or local unit of government or appropriate | ||||||
24 | and allowable not-for-profit or private organization, gives | ||||||
25 | necessary assurances to the Department that it has available | ||||||
26 | sufficient funds to meet its share of the cost of the project |

1 | and that the surveyed, acquired, or developed areas and | ||||||
2 | facilities will be operated and maintained at its expense for | ||||||
3 | public recreational trail use. | ||||||
4 | (c) The Department may enter into agreements as necessary | ||||||
5 | with the Federal Highway Administration, or any successor | ||||||
6 | agency, for the purpose of authorizing federal obligation | ||||||
7 | limitations for projects under the federal Recreational Trails | ||||||
8 | Program. The Department and the Department of Transportation | ||||||
9 | shall enter into an inter-agency agreement to closely | ||||||
10 | coordinate the obligation of projects authorized by the | ||||||
11 | Illinois Division Office of the Federal Highway Administration | ||||||
12 | to maximize federal funding opportunities.

13 | (d) The Department may make grants to contractors for the | ||||||
14 | maintenance and restoration of the existing part of the | ||||||
15 | National Road located in southeastern Illinois. The grants | ||||||
16 | shall be made from State appropriations and to the extent | ||||||
17 | permitted by federal law from federal funds for this purpose. | ||||||
18 | Moneys for this purpose may be received from local units of | ||||||
19 | government or appropriate and allowable not-for-profit or | ||||||
20 | private organizations. | ||||||
