| 2 | AMENDMENT NO. ______. Amend Senate Bill 1211 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 1. Short title. This Act may be cited as the Road | ||||||
| 5 | Designation Program Act. | ||||||
| 6 | Section 5. Purpose. This Act establishes a designation | ||||||
| 7 | program for the naming and subsequent placement of signage | ||||||
| 8 | upon interstate or State-numbered highway interchanges or upon | ||||||
| 9 | bridges or segments of highway under the jurisdiction of the | ||||||
| 10 | Department of Transportation. | ||||||
| 11 | Section 10. Definitions. As used in this Act:
| ||||||
| 12 | "Department" means the Department of Transportation.
| ||||||
| 13 | "Secretary" means the Secretary of the Department of | ||||||
| 14 | Transportation.
| ||||||

| 1 | Section 15. Road designation program.
| ||||||
| 2 | (a) Any person who desires to have an interstate or | ||||||
| 3 | State-numbered highway interchange or bridge or segment of | ||||||
| 4 | highway under the jurisdiction of the Department designated | ||||||
| 5 | shall petition the Department by submitting an application in | ||||||
| 6 | a form prescribed by the Secretary. The form shall include the | ||||||
| 7 | amount of the fee under subsection (b) and contain the | ||||||
| 8 | following:
| ||||||
| 9 | (1) a description of the interstate or State-numbered | ||||||
| 10 | highway interchange or bridge or segment of highway under | ||||||
| 11 | the jurisdiction of the Department for which the | ||||||
| 12 | designation is sought and the proposed name of the | ||||||
| 13 | interchange, bridge, or relevant segment of highway; and
| ||||||
| 14 | (2) a letter of sponsorship from the State | ||||||
| 15 | Representative and State Senator for each district in | ||||||
| 16 | which the road is located.
| ||||||
| 17 | (b) After determining that the petitioner meets all of the | ||||||
| 18 | application requirements of subsection (a), the Department | ||||||
| 19 | shall submit a recommendation containing the proposed | ||||||
| 20 | designations to the sponsors in the General Assembly named in | ||||||
| 21 | the application. The Department shall be notified upon the | ||||||
| 22 | approval or denial of a proposed designation. Upon the | ||||||
| 23 | approval of a proposed designation, the petitioner shall | ||||||
| 24 | submit a fee to be determined by the Secretary to cover the | ||||||
| 25 | costs of constructing and maintaining the proposed signs on | ||||||
| 26 | the interchange, bridge, or segment of highway. The fee shall | ||||||

| 1 | not exceed the cost of constructing and maintaining each sign.
| ||||||
| 2 | (c) The Department shall give notice of any proposed | ||||||
| 3 | designation under this Section on the Department's official | ||||||
| 4 | public website.
| ||||||
| 5 | (d) The honorary signs may be placed upon interstate or | ||||||
| 6 | State-numbered highway interchanges or upon bridges or | ||||||
| 7 | segments of highway under the jurisdiction of the Department | ||||||
| 8 | according to the provisions of this Section, and any | ||||||
| 9 | applicable federal and State limitations or conditions on | ||||||
| 10 | highway signage, including location and spacing.
| ||||||
| 11 | (e) Two signs shall be erected for each interchange, | ||||||
| 12 | bridge, or segment of highway designation processed under this | ||||||
| 13 | Section.
| ||||||
| 14 | (f) No interchange, bridge, or segment of highway may be | ||||||
| 15 | named or designated under this Section if it carries an | ||||||
| 16 | existing designation.
| ||||||
| 17 | (g) All money received by the Department for the | ||||||
| 18 | construction and maintenance of interchange, bridge, or | ||||||
| 19 | segment of highway signs shall be deposited into the Road | ||||||
| 20 | Fund.
| ||||||
| 21 | (h) The documents and fees required under this Section | ||||||
| 22 | shall be submitted to the Department.
The Department shall | ||||||
| 23 | waive all fees for road designations made in honor of members | ||||||
| 24 | of the United States Armed Forces and first responders who | ||||||
| 25 | have died in the line of duty.

| 1 | Section 99. Effective date. This Act takes effect upon | ||||||
| 2 | becoming law.".
