AMENDMENT TO SENATE BILL 1508

2    AMENDMENT NO. ______. Amend Senate Bill 1508 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Lottery Law is amended by
5changing Sections 9.3, 20, 21.5, 21.6, 21.7, 21.8, 21.9,
621.10, 21.11, and 21.13 and by adding Sections 21.4, 21.15,
721.16, and 21.17 as follows:
 
8    (20 ILCS 1605/9.3)
9    Sec. 9.3. Expenditure and distribution of lottery
10proceeds.
11    (a) Beginning July 1, 2022, except as provided in Sections
1221.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and
1321.13, 21.15, and 21.16 of this Law Act and Section 25-70 of
14the Sports Wagering Act, the Department shall distribute all
15proceeds of lottery tickets and shares sold in the following
16priority and manner:

1        (1) The payment of prizes and retailer bonuses.
2        (2) The payment of costs incurred in the operation and
3    administration of the Lottery, including the payment of
4    sums due to the private manager under the management
5    agreement with the Department and including costs of
6    administering the Lottery sports wagering program pursuant
7    to Section 25-70 of the Sports Wagering Act.
8        (3) On the last day of each month or as soon thereafter
9    as possible, the State Comptroller shall direct and the
10    State Treasurer shall transfer from the State Lottery Fund
11    to the Common School Fund the Department's estimate of net
12    lottery proceeds.
13        (4) If an amount in excess of the annual net lottery
14    proceeds is transferred for a fiscal year, then the
15    Department shall offset the monthly transfers of estimated
16    net lottery proceeds during the following fiscal year by
17    that excess amount. If an amount less than the annual net
18    lottery proceeds is transferred for a fiscal year, then
19    after the related annual fiscal year audit is completed
20    following such fiscal year, the Department shall direct
21    the deposit of any remaining annual net lottery proceeds
22    from such fiscal year, subject to payments under
23    paragraphs (1) and (2), into the Common School Fund as
24    soon thereafter as possible.
25    (b) The net lottery proceeds shall be determined by
26deducting from total annual lottery proceeds the expenditures

1required by paragraphs (1) and (2) of subsection (a). The
2total annual lottery proceeds and annual net lottery proceeds
3shall be determined according to generally accepted accounting
4principles for governmental entities and verified by an annual
5fiscal year audit.

8    Sec. 20. State Lottery Fund.
9    (a) There is created in the State Treasury a special fund
10to be known as the State Lottery Fund. Such fund shall consist
11of all revenues received from (1) the sale of lottery tickets
12or shares, (net of commissions, fees representing those
13expenses that are directly proportionate to the sale of
14tickets or shares at the agent location, and prizes of less
15than $600 which have been validly paid at the agent level), (2)
16application fees, and (3) all other sources including moneys
17credited or transferred thereto from any other fund or source
18pursuant to law. Interest earnings of the State Lottery Fund
19shall be credited to the Common School Fund.
20    (a-5) The receipt and distribution of moneys under Section
2121.4 of this Act shall be in accordance with Section 21.4.
22    (b) The receipt and distribution of moneys under Section
2321.5 of this Law Act shall be in accordance with Section 21.5.
24    (c) The receipt and distribution of moneys under Section
2521.6 of this Law Act shall be in accordance with Section 21.6.

1    (d) The receipt and distribution of moneys under Section
221.7 of this Law Act shall be in accordance with Section 21.7.
3    (e) The receipt and distribution of moneys under Section
421.8 of this Law Act shall be in accordance with Section 21.8.
5    (f) The receipt and distribution of moneys under Section
621.9 of this Law Act shall be in accordance with Section 21.9.
7    (g) The receipt and distribution of moneys under Section
821.10 of this Law Act shall be in accordance with Section
921.10.
10    (h) The receipt and distribution of moneys under Section
1121.11 of this Law Act shall be in accordance with Section
1221.11.
13    (i) (Blank). The receipt and distribution of moneys under
14Section 21.12 of this Act shall be in accordance with Section
1521.12.
16    (j) The receipt and distribution of moneys under Section
1721.13 of this Law Act shall be in accordance with Section
1821.13.
19    (k) The receipt and distribution of moneys under Section
2025-70 of the Sports Wagering Act shall be in accordance with
21Section 25-70 of the Sports Wagering Act.
22    (l) The receipt and distribution of moneys under Section
2321.15 of this Law shall be in accordance with Section 21.15.
24    (m) The receipt and distribution of moneys under Section
2521.16 of this Law shall be in accordance with Section 21.16.

2    (20 ILCS 1605/21.4 new)
3    Sec. 21.4. Joint Special Instant Scratch-off game.
4    (a) The Department shall offer a joint special instant
5scratch-off game for the benefit of the special causes
6identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10,
721.11, 21.13, 21.15, and 21.16. The operation of the game
8shall be governed by this Section and any rules adopted by the
9Department. The game shall commence on January 1, 2024 or as
10soon thereafter, at the discretion of the Director, as is
11reasonably practical and shall be discontinued on January 1,
122027. If any provision of this Section is inconsistent with
13any other provision in the Act, then this Section governs.
14    (b) Once the joint special instant scratch-off game is
15used to fund a special cause, the game will be used to fund the
16special cause for the remainder of the special causes'
17existence per the causes' respective Section of this Act.
18    (c) New specialty tickets and causes authorized by this
19Act shall be funded by the joint special instant scratch-off
20game. New specialty tickets and causes after February 1, 2024
21must have a sunset date. The Department shall be limited to
22supporting no more than 10 causes in total at any given time.
23    (d) Net revenue received from the sale of the joint
24special instant scratch-off game for the purposes of this
25Section shall be divided equally among the special causes the

1game benefits. The Department shall transfer the net revenue
2into the special fund identified for each special cause in
3accordance with the special cause's respective Section of this
4Act. As used in this Section, "net revenue" means the total
5amount for which tickets have been sold less the sum of the
6amount paid out in prizes and to retailers, and direct and
7estimated administrative expenses incurred in operation of the
8ticket.
 
9    (20 ILCS 1605/21.5)
10    Sec. 21.5. Carolyn Adams Ticket For The Cure.
11    (a) The Department shall offer a special instant
12scratch-off game with the title of "Carolyn Adams Ticket For
13The Cure". The game shall commence on January 1, 2006 or as
14soon thereafter, in the discretion of the Director, as is
15reasonably practical, and shall be discontinued on December
1631, 2026. The operation of the game shall be governed by this
17Act and any rules adopted by the Department. The Department
18must consult with the Carolyn Adams Ticket For The Cure Board,
19which is established under Section 2310-347 of the Department
20of Public Health Powers and Duties Law of the Civil
21Administrative Code of Illinois, regarding the design and
22promotion of the game. If any provision of this Section is
23inconsistent with any other provision of this Act, then this
24Section governs.
25    (b) The Carolyn Adams Ticket For The Cure Grant Fund is

1created as a special fund in the State treasury. The net
2revenue from the Carolyn Adams Ticket For The Cure special
3instant scratch-off game shall be deposited into the Fund for
4appropriation by the General Assembly solely to the Department
5of Public Health for the purpose of making grants to public or
6private entities in Illinois for the purpose of funding breast
7cancer research, and supportive services for breast cancer
8survivors and those impacted by breast cancer and breast
9cancer education. In awarding grants, the Department of Public
10Health shall consider criteria that includes, but is not
11limited to, projects and initiatives that address disparities
12in incidence and mortality rates of breast cancer, based on
13data from the Illinois Cancer Registry, and populations facing
14barriers to care. The Department of Public Health shall,
15before grants are awarded, provide copies of all grant
16applications to the Carolyn Adams Ticket For The Cure Board,
17receive and review the Board's recommendations and comments,
18and consult with the Board regarding the grants. For purposes
19of this Section, the term "research" includes, without
20limitation, expenditures to develop and advance the
21understanding, techniques, and modalities effective in the
22detection, prevention, screening, and treatment of breast
23cancer and may include clinical trials. The grant funds may
24not be used for institutional, organizational, or
25community-based overhead costs, indirect costs, or levies.
26    Moneys received for the purposes of this Section,

1including, without limitation, net revenue from the special
2instant scratch-off game and gifts, grants, and awards from
3any public or private entity, must be deposited into the Fund.
4Any interest earned on moneys in the Fund must be deposited
5into the Fund.
6    As used in this subsection, For purposes of this
7subsection, "net revenue" means the total amount for which
8tickets have been sold less the sum of the amount paid out in
9prizes and to retailers, and direct and estimated the actual
10administrative expenses of the Department solely related to
11the Ticket For The Cure game.
12    (c) During the time that tickets are sold for the Carolyn
13Adams Ticket For The Cure game, the Department shall not
14unreasonably diminish the efforts devoted to marketing any
15other instant scratch-off lottery game.
16    (d) The Department may adopt any rules necessary to
17implement and administer the provisions of this Section.

20    Sec. 21.6. Scratch-off for Illinois veterans.
21    (a) The Department shall offer a special instant
22scratch-off game for the benefit of Illinois veterans. The
23game shall commence on January 1, 2006 or as soon thereafter,
24at the discretion of the Director, as is reasonably practical.
25The operation of the game shall be governed by this Act and any

1rules adopted by the Department. If any provision of this
2Section is inconsistent with any other provision of this Act,
3then this Section governs.
4    (b) The Illinois Veterans Assistance Fund is created as a
5special fund in the State treasury. The net revenue from the
6Illinois veterans scratch-off game shall be deposited into the
7Fund for appropriation by the General Assembly solely to the
8Department of Veterans' Affairs for making grants, funding
9additional services, or conducting additional research
10projects relating to each of the following:
11        (i) veterans' behavioral health services;
12        (ii) veterans' homelessness;
13        (iii) the health insurance costs of veterans;
14        (iv) veterans' disability benefits, including but not
15    limited to, disability benefits provided by veterans
16    service organizations and veterans assistance commissions
17    or centers;
18        (v) the long-term care of veterans; provided that,
19    beginning with moneys appropriated for fiscal year 2008,
20    no more than 20% of such moneys shall be used for health
21    insurance costs;
22        (vi) veteran employment and employment training; and
23        (vii) veterans' emergency financial assistance,
24    including, but not limited to, past due utilities,
25    housing, and transportation costs.
26    In order to expend moneys from this special fund,

1beginning with moneys appropriated for fiscal year 2008, the
2Director of Veterans' Affairs shall appoint a 3-member funding
3authorization committee. The Director shall designate one of
4the members as chairperson. The committee shall meet on a
5quarterly basis, at a minimum, and shall authorize expenditure
6of moneys from the special fund by a two-thirds vote.
7Decisions of the committee shall not take effect unless and
8until approved by the Director of Veterans' Affairs. Each
9member of the committee shall serve until a replacement is
10named by the Director of Veterans' Affairs. One member of the
11committee shall be a member of the Veterans' Advisory Council.
12    Moneys collected from the special instant scratch-off game
13shall be used only as a supplemental financial resource and
14shall not supplant existing moneys that the Department of
15Veterans' Affairs may currently expend for the purposes set
16forth in items (i) through (v).
17    Moneys received for the purposes of this Section,
18including, without limitation, net revenue from the special
19instant scratch-off game and from gifts, grants, and awards
20from any public or private entity, must be deposited into the
21Fund. Any interest earned on moneys in the Fund must be
22deposited into the Fund.
23    As used in this subsection, For purposes of this
24subsection, "net revenue" means the total amount for which
25tickets have been sold less the sum of the amount paid out in
26the prizes and to retailers, and direct and estimated the

1actual administrative expenses of the Department solely
2related to the scratch-off game under this Section.
3    (c) During the time that tickets are sold for the Illinois
4veterans scratch-off game, the Department shall not
5unreasonably diminish the efforts devoted to marketing any
6other instant scratch-off lottery game.
7    (d) The Department may adopt any rules necessary to
8implement and administer the provisions of this Section.

11    Sec. 21.7. Scratch-out Multiple Sclerosis scratch-off
12game.
13    (a) The Department shall offer a special instant
14scratch-off game for the benefit of research pertaining to
15multiple sclerosis. The game shall commence on July 1, 2008 or
16as soon thereafter, in the discretion of the Director, as is
17reasonably practical. The operation of the game shall be
18governed by this Act and any rules adopted by the Department.
19If any provision of this Section is inconsistent with any
20other provision of this Act, then this Section governs.
21    (b) The Multiple Sclerosis Research Fund is created as a
22special fund in the State treasury. The net revenue from the
23scratch-out multiple sclerosis scratch-off game created under
24this Section shall be deposited into the Fund for
25appropriation by the General Assembly to the Department of

1Public Health for the purpose of making grants to
2organizations in Illinois that conduct research pertaining to
3the repair and prevention of damage caused by an acquired
4demyelinating disease of the central nervous system.
5    Moneys received for the purposes of this Section,
6including, without limitation, net revenue from the special
7instant scratch-off game and from gifts, grants, and awards
8from any public or private entity, must be deposited into the
9Fund. Any interest earned on moneys in the Fund must be
10deposited into the Fund.
11    For purposes of this Section, the term "research"
12includes, without limitation, expenditures to develop and
13advance the understanding, techniques, and modalities
14effective for maintaining function, mobility, and strength
15through preventive physical therapy or other treatments and to
16develop and advance the repair, and also the prevention, of
17myelin, neuron, and axon damage caused by an acquired
18demyelinating disease of the central nervous system and the
19restoration of function, including but not limited to, nervous
20system repair or neuroregeneration.
21    The grant funds may not be used for institutional,
22organizational, or community-based overhead costs, indirect
23costs, or levies.
24    As used in this subsection, For purposes of this
25subsection, "net revenue" means the total amount for which
26tickets have been sold less the sum of the amount paid out in

1the prizes and to retailers, and direct and estimated the
2actual administrative expenses of the Department solely
3related to the scratch-off game under this Section.
4    (c) During the time that tickets are sold for the
5scratch-out multiple sclerosis scratch-off game, the
6Department shall not unreasonably diminish the efforts devoted
7to marketing any other instant scratch-off lottery game.
8    (d) The Department may adopt any rules necessary to
9implement and administer the provisions of this Section.

12    Sec. 21.8. Quality of Life scratch-off game.
13    (a) The Department shall offer a special instant
14scratch-off game with the title of "Quality of Life". The game
15shall commence on July 1, 2007 or as soon thereafter, in the
16discretion of the Director, as is reasonably practical, and
17shall be discontinued on December 31, 2025. The operation of
18the game is governed by this Act and by any rules adopted by
19the Department. The Department must consult with the Quality
20of Life Board, which is established under Section 2310-348 of
21the Department of Public Health Powers and Duties Law of the
22Civil Administrative Code of Illinois, regarding the design
23and promotion of the game. If any provision of this Section is
24inconsistent with any other provision of this Act, then this
25Section governs.

1    (b) The Quality of Life Endowment Fund is created as a
2special fund in the State treasury. The net revenue from the
3Quality of Life special instant scratch-off game must be
4deposited into the Fund for appropriation by the General
5Assembly solely to the Department of Public Health for the
6purpose of HIV/AIDS-prevention education and for making grants
7to public or private entities in Illinois for the purpose of
8funding organizations that serve the highest at-risk
9categories for contracting HIV or developing AIDS. Grants
10shall be targeted to serve at-risk populations in proportion
11to the distribution of recent reported Illinois HIV/AIDS cases
12among risk groups as reported by the Illinois Department of
13Public Health. The recipient organizations must be engaged in
14HIV/AIDS-prevention education and HIV/AIDS healthcare
15treatment. The Department must, before grants are awarded,
16provide copies of all grant applications to the Quality of
17Life Board, receive and review the Board's recommendations and
18comments, and consult with the Board regarding the grants.
19Organizational size will determine an organization's
20competitive slot in the "Request for Proposal" process.
21Organizations with an annual budget of $300,000 or less will
22compete with like size organizations for 50% of the Quality of
23Life annual fund. Organizations with an annual budget of
24$300,001 to $700,000 will compete with like organizations for
2525% of the Quality of Life annual fund, and organizations with
26an annual budget of $700,001 and upward will compete with like

1organizations for 25% of the Quality of Life annual fund. The
2lottery may designate a percentage of proceeds for marketing
3purposes. The grant funds may not be used for institutional,
4organizational, or community-based overhead costs, indirect
5costs, or levies.
6    Grants awarded from the Fund are intended to augment the
7current and future State funding for the prevention and
8treatment of HIV/AIDS and are not intended to replace that
9funding.
10    Moneys received for the purposes of this Section,
11including, without limitation, net revenue from the special
12instant scratch-off game and gifts, grants, and awards from
13any public or private entity, must be deposited into the Fund.
14Any interest earned on moneys in the Fund must be deposited
15into the Fund.
16    As used in this subsection, For purposes of this
17subsection, "net revenue" means the total amount for which
18tickets have been sold less the sum of the amount paid out in
19prizes and to retailers, and direct and estimated the actual
20administrative expenses of the Department solely related to
21the Quality of Life game.
22    (c) During the time that tickets are sold for the Quality
23of Life game, the Department shall not unreasonably diminish
24the efforts devoted to marketing any other instant scratch-off
25lottery game.
26    (d) The Department may adopt any rules necessary to

1implement and administer the provisions of this Section in
2consultation with the Quality of Life Board.

5    Sec. 21.9. Go For The Gold scratch-off game.
6    (a) The Department shall offer a special instant
7scratch-off game with the title of "Go For The Gold". The game
8must commence on July 1, 2014 or as soon thereafter, at the
9discretion of the Director, as is reasonably practical. The
10operation of the game is governed by this Act and by any rules
11adopted by the Department. If any provision of this Section is
12inconsistent with any other provision of this Act, then this
13Section governs.
14    (b) The Special Olympics Illinois and Special Children's
15Charities Fund is created as a special fund in the State
16treasury. The net revenue from the Go For The Gold special
17instant scratch-off game must be deposited into the Special
18Olympics Illinois and Special Children's Charities Fund for
19appropriation by the General Assembly solely to the Department
20of Human Services, which must distribute the moneys as
21follows: (i) 75% of the moneys to Special Olympics Illinois to
22support the statewide training, competitions, and programs for
23future Special Olympics athletes; and (ii) 25% of the moneys
24to Special Children's Charities to support the City of
25Chicago-wide training, competitions, and programs for future

1Special Olympics athletes. The moneys may not be used for
2institutional, organizational, or community-based overhead
3costs, indirect costs, or levies.
4    Moneys received for the purposes of this Section,
5including, without limitation, net revenue from the special
6instant scratch-off game and gifts, grants, and awards from
7any public or private entity, must be deposited into the
8Special Olympics and Special Children's Charities Fund. Any
9interest earned on moneys in the Special Olympics and Special
10Children's Charities Fund must be deposited into the Special
11Olympics and Special Children's Charities Fund.
12    As used in this subsection, For purposes of this
13subsection, "net revenue" means the total amount for which
14tickets have been sold less the sum of the amount paid out in
15prizes and to retailers, and direct and estimated the actual
16administrative expenses of the Department solely related to
17the Go For The Gold game.
18    (c) During the time that tickets are sold for the Go For
19The Gold game, the Department shall not unreasonably diminish
20the efforts devoted to marketing any other instant scratch-off
21lottery game.
22    (d) The Department may adopt any rules necessary to
23implement and administer the provisions of this Section.

1    Sec. 21.10. Scratch-off for State police memorials.
2    (a) The Department shall offer a special instant
3scratch-off game for the benefit of State police memorials.
4The game shall commence on January 1, 2019 or as soon
5thereafter, at the discretion of the Director, as is
6reasonably practical. The operation of the game shall be
7governed by this Act and any rules adopted by the Department.
8If any provision of this Section is inconsistent with any
9other provision of this Act, then this Section governs.
10    (b) The net revenue from the State police memorials
11scratch-off game shall be deposited into the Criminal Justice
12Information Projects Fund and distributed equally, as soon as
13practical but at least on a monthly basis, to the Chicago
14Police Memorial Foundation Fund, the Police Memorial Committee
15Fund, and the Illinois State Police Memorial Park Fund. Moneys
16transferred to the funds under this Section shall be used,
17subject to appropriation, to fund grants for building and
18maintaining memorials and parks; holding annual memorial
19commemorations; giving scholarships to children of officers
20killed or catastrophically injured in the line of duty, or
21those interested in pursuing a career in law enforcement;
22providing financial assistance to police officers and their
23families when a police officer is killed or injured in the line
24of duty; and providing financial assistance to officers for
25the purchase or replacement of bulletproof vests to be used in
26the line of duty.

1    As used in this subsection, For purposes of this
2subsection, "net revenue" means the total amount for which
3tickets have been sold less the sum of the amount paid out in

7    (c) During the time that tickets are sold for the State
8police memorials scratch-off game, the Department shall not
9unreasonably diminish the efforts devoted to marketing any
10other instant scratch-off lottery game.
11    (d) The Department may adopt any rules necessary to
12implement and administer the provisions of this Section.

15    Sec. 21.11. Scratch-off for homelessness prevention
16programs.
17    (a) The Department shall offer a special instant
18scratch-off game to fund homelessness prevention programs. The
19game shall commence on July 1, 2019 or as soon thereafter, at
20the discretion of the Director, as is reasonably practical.
21The operation of the game shall be governed by this Act and any
22rules adopted by the Department. If any provision of this
23Section is inconsistent with any other provision of this Act,
24then this Section governs.
25    (b) The Homelessness Prevention Revenue Fund is created as

1a special fund in the State treasury. The net revenue from the
2scratch-off game to fund homelessness prevention programs
3shall be deposited into the Homelessness Prevention Revenue
4Fund. Subject to appropriation, moneys in the Fund shall be
5used by the Department of Human Services solely for grants to
6homelessness prevention and assistance projects under the

8    As used in this subsection, "net revenue" means the total
9amount for which tickets have been sold less the sum of the
10amount paid out in the prizes and to retailers, and direct and
11estimated the actual administrative expenses of the Department
12solely related to the scratch-off game under this Section.
13    (c) During the time that tickets are sold for the
14scratch-off game to fund homelessness prevention programs, the
15Department shall not unreasonably diminish the efforts devoted
16to marketing any other instant scratch-off lottery game.
17    (d) The Department may adopt any rules necessary to
18implement and administer the provisions of this Section.
19    (e) Nothing in this Section shall be construed to affect
20any revenue that any Homelessness Prevention line item
21receives through the General Revenue Fund or the Illinois
22Affordable Housing Trust Fund.

2    (a) The Department shall offer a special instant
3scratch-off game for the benefit of Alzheimer's care, support,
4education, and awareness. The game shall commence on January
51, 2020 or as soon thereafter, at the discretion of the
6Director, as is reasonably practical, and shall be
7discontinued on January 1, 2025. The operation of the game
8shall be governed by this Act and any rules adopted by the
9Department. If any provision of this Section is inconsistent
10with any other provision of this Act, then this Section
11governs.
12    (b) The net revenue from the Alzheimer's care, support,
13education, and awareness scratch-off game shall be deposited
14into the Alzheimer's Awareness Fund.
15    Moneys received for the purposes of this Section,
16including, without limitation, net revenue from the special
17instant scratch-off game and from gifts, grants, and awards
18from any public or private entity, must be deposited into the
19Fund. Any interest earned on moneys in the Fund must be
20deposited into the Fund.

11    Sec. 21.15. Scratch-off for United Negro College Fund
12Illinois.
13    (a) The Department shall offer a special instant
14scratch-off game for the benefit of United Negro College Fund
15Illinois in support of educational scholarships to university
16and college students. The game shall commence on January 1,
172024 or as soon thereafter, at the discretion of the Director,
18as is reasonably practical. The operation of the game shall be
19governed by this Act and any rules adopted by the Department.
20The Department must consult with UNCF Illinois regarding the
21design and promotion of the game.
22    (b) The UNCF Scholarship Fund is created as a special fund
23in the State treasury. The net revenue from the special
24instant scratch-off game sold for the benefit of the United
25Negro College Fund Illinois in support of education

1scholarships to university and college students shall be
2deposited into the fund for appropriation by the General
3Assembly solely to the Student Assistance Commission for the
4purpose of funding UNCF Illinois Scholarship awards to
5university and college students. Funding shall be used solely
6for scholarship awards and not to cover any administrative
7costs of the United Negro College Fund, Inc., a 501(c)(3)
8nonprofit recipient organization.
9    Moneys received for the purposes of this Section,
10including, without limitation, net revenue from the special
11instant scratch-off game and from gifts, grants, and awards
12from any public or private entity, must be deposited into the

3    Sec. 21.16. Illinois DREAM scratch-off.
4    (a) The Department shall offer a special Illinois DREAM
5instant scratch-off game for the benefit of the Illinois DREAM
6Fund Commission. The new revenue from the Illinois DREAM
7scratch-off game shall be deposited into the Illinois DREAM
8Fund, a special fund that is created in the State treasury.
9Subject to appropriation, money in the Illinois DREAM Fund
10shall be used to assist in funding scholarships and other
11statutory responsibilities of the Illinois DREAM Fund
12Commission. The game shall commence on January 1, 2024 or as
13soon thereafter as is reasonably practical. The Department
14shall consult with the Illinois DREAM Fund Commission
15established under Section 67 of the Higher Education Student
16Assistance Act regarding the design and promotion of the game.
17    (b) The operation of any games under this Section shall be
18governed by this Act, and any rules shall be adopted by the
19Department.
20    (c) For purposes of this Section, "net revenue" means the
21total amount for which tickets have been sold less the sum of
22the amount paid out in prizes and the actual administrative
23expenses of the Department solely related to the Illinois
24DREAM scratch-off game.

6Illinois DREAM Fund Commission.

8    Sec. 21.17. Illinois Lottery Special Instant Scratch-off
9Task Force.
10    (a) There is hereby created the Illinois Lottery Special
11Instant Scratch-off Task Force.
12    (b) The Task Force shall study the joint special instant
13scratch-off game offered under Section 21.4 and make
14recommendations on:
15        (1) maximizing revenue for this State as well as
16    various special causes;
17        (2) whether to expand the program to additional
18    causes;
19        (3) establishing criteria for special causes;
20        (4) the impact on revenue of the joint special instant
21    scratch-off game; and
22        (5) other issues related to the joint special instant
23    scratch-off game.
24    (c) The Task Force may request testimony from any person
25or entity that may assist in increasing understanding of the

1joint special instant scratch-off game.
2    (d) The Task Force shall consist of the following members:
3        (1) the Director of the Lottery, or his or her
4    designee;
5        (2) 2 members, appointed by the Speaker of the House
6    of Representatives, one of whom shall be named co-chair of
7    the Task Force;
8        (3) 2 members, appointed by the Minority Leader of the
9    House of Representatives;
10        (4) 2 members, appointed by the President of the
11    Senate, one of whom shall be named co-chair of the Task
12    Force;
13        (5) 2 members, appointed by the Minority Leader of the
14    Senate; and
15        (6) 2 members, appointed by the Governor.
16    (e) Members of the Task Force shall serve without
17compensation for the duration of the Task Force, but may be
18reimbursed for reasonable travel expenses and in compliance
19with the Secretary of State's travel rules required for
20attendance at meetings.
21    (f) As soon as practicable, but no later than September 1,
222023, all members shall be appointed to the Task Force. As soon
23as practicable after all members have been appointed, the Task
24Force shall hold its first meeting. The Task Force shall meet a
25minimum of 4 times.
26    (g) The Department of the Lottery shall provide

1administrative support and other support to the Task Force.
2    (h) By January 1, 2025, the Task Force shall submit a
3report to the Governor and General Assembly reporting findings
4and recommendations regarding the joint special instant
5scratch-off games.
6    (i) This Section is repealed on January 1, 2027.

20    (a) The Illinois Student Assistance Commission shall

1establish an Illinois DREAM Fund Commission. The Governor
2shall appoint, with the advice and consent of the Senate,
3members to the Illinois DREAM Fund Commission, which shall be
4comprised of 9 members representing the geographic and ethnic
5diversity of this State, including students, college and
6university administrators and faculty, and other individuals
7committed to advancing the educational opportunities of the
8children of immigrants.
9    (b) The Illinois DREAM Fund Commission is charged with all
10of the following responsibilities:
11        (1) Administering this Section and raising funds for
12    the Illinois DREAM Fund.
13        (2) Establishing a not-for-profit entity charged with
14    raising funds for the administration of this Section, any
15    educational or training programs the Commission is tasked
16    with administering, and funding scholarships to students
17    who are the children of immigrants to the United States.
18        (3) Publicizing the availability of scholarships from
19    the Illinois DREAM Fund.
20        (4) Selecting the recipients of scholarships funded
21    through the Illinois DREAM Fund.
22        (5) Researching issues pertaining to the availability
23    of assistance with the costs of higher education for the
24    children of immigrants and other issues regarding access
25    for and the performance of the children of immigrants
26    within higher education.

1        (6) Overseeing implementation of the other provisions
2    of this amendatory Act of the 97th General Assembly.
3        (7) Establishing and administering training programs
4    for high school counselors and counselors, admissions
5    officers, and financial aid officers of public
6    institutions of higher education. The training programs
7    shall instruct participants on the educational
8    opportunities available to college-bound students who are
9    the children of immigrants, including, but not limited to,
10    in-state tuition and scholarship programs. The Illinois
11    DREAM Fund Commission may also establish a public
12    awareness campaign regarding educational opportunities
13    available to college bound students who are the children
14    of immigrants.
15    The Illinois DREAM Fund Commission shall establish, by
16rule, procedures for accepting and evaluating applications for
17scholarships from the children of immigrants and issuing
18scholarships to selected student applicants.
19    (c) To receive a scholarship under this Section, a student
20must meet all of the following qualifications:
21        (1) Have resided with his or her parents or guardian
22    while attending a public or private high school in this
23    State.
24        (2) Have graduated from a public or private high
25    school or received the equivalent of a high school diploma
26    in this State.

1        (3) Have attended school in this State for at least 3
2    years as of the date he or she graduated from high school
3    or received the equivalent of a high school diploma.
4        (4) Have at least one parent who immigrated to the
5    United States.
6    (d) The Illinois Student Assistance Commission shall
7establish an Illinois DREAM Fund to provide scholarships under
8this Section. The Illinois DREAM Fund shall be funded entirely
9from private contributions, gifts, grants, awards, and
10proceeds from the scratch-off created in Section 21.16 of the
11Illinois Lottery Law.
