AMENDMENT TO SENATE BILL 1769

2    AMENDMENT NO. ______. Amend Senate Bill 1769, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 1. Short title. This Act may be cited as the
6Government Zero-Emission Vehicle Act.
 
7    Section 5. Definitions. As used in this Act:
8    "Agency" means the Environmental Protection Agency.
9    "Governmental unit" means the State, a State agency, a
10unit of local government, or any other political subdivision
11of the State.
12    "Law enforcement vehicle" means a publicly owned or leased
13vehicle operated by a law enforcement agency and which is used
14for the law enforcement functions of the agency.
15    "Passenger vehicle" means a motor vehicle, except a
16motorcycle, designed primarily for the transportation of

1persons and designed for carrying no more than 10 passengers,
2including the driver, and primarily used for the
3transportation of persons. "Passenger vehicle" includes motor
4vehicles which are designed with seats that may be readily
5removed and reinstalled, but does not include such vehicles if
6used primarily for the transportation of property.
7    "Zero-emission vehicle" means a passenger motor vehicle
8that produces zero exhaust emissions of any criteria
9pollutant, precursor pollutant, or greenhouse gas, but only
10produces water vapor, in any mode of operation or condition,
11as determined by the Agency.
 
12    Section 10. Zero-emission vehicles of governmental units.
13Notwithstanding any other provision of law, all vehicles
14purchased or leased by a governmental must be either a
15manufactured zero-emission vehicle or a converted
16zero-emission vehicle by:
17        (1) January 1, 2028 for units of local government;
18        (2) January 1, 2030 for State government; and
19        (3) January 1, 2040 for State and local law
20enforcement vehicles.
 
21    Section 90. Home rule. A home rule unit may not regulate
22the unit's vehicles in a manner inconsistent with this Act.
23This Act is a limitation under subsection (i) of Section 6 of
24Article VII of the Illinois Constitution on the concurrent

1exercise by home rule units of powers and functions exercised
2by the State.
 
3    Section 95. The State Mandates Act is amended by adding
4Section 8.47 as follows:
 
5    (30 ILCS 805/8.47 new)
6    Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and
78 of this Act, no reimbursement by the State is required for
8the implementation of any mandate created by the Government
9Zero-Emission Vehicle Act.".
