AMENDMENT TO SENATE BILL 1769

2    AMENDMENT NO. ______. Amend Senate Bill 1769, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 1. Short title. This Act may be cited as the
6Government Zero-Emission Vehicle Act.
 
7    Section 5. Definitions. As used in this Act:
8    "Agency" means the Environmental Protection Agency.
9    "Governmental unit" means the State, a State agency, or
10any other political subdivision of the State.
11    "Law enforcement vehicle" means a publicly owned or leased
12vehicle that is operated by a law enforcement agency and used
13for the law enforcement functions of the agency.
14    "Passenger vehicle" means a motor vehicle, except a
15motorcycle, designed primarily for the transportation of
16persons and designed for carrying no more than 10 passengers,

1including the driver, and primarily used for the
2transportation of persons. "Passenger vehicle" includes motor
3vehicles which are designed with seats that may be readily
4removed and reinstalled, but does not include such vehicles if
5used primarily for the transportation of property.
6    "Zero-emission vehicle" means a passenger vehicle that
7produces zero exhaust emissions of any criteria pollutant,
8precursor pollutant, or greenhouse gas, but only produces
9water vapor, in any mode of operation or condition, as
10determined by the Agency.
 
11    Section 10. Zero-emission vehicles of governmental units.
12Notwithstanding any other provision of law, by January 1, 2030
13all passenger vehicles, except for law enforcement vehicles,
14purchased or leased by a governmental must be either a
15manufactured zero-emission vehicle or a converted
16zero-emission.
 
17    Section 95. The State Mandates Act is amended by adding
18Section 8.47 as follows:
 
19    (30 ILCS 805/8.47 new)
20    Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and
218 of this Act, no reimbursement by the State is required for
22the implementation of any mandate created by the Government
23Zero-Emission Vehicle Act.".
