| 2 | | AMENDMENT NO. ______. Amend Senate Bill 1769, AS AMENDED, |
| 3 | | by replacing everything after the enacting clause with the |
| 4 | | following:
|
| 5 | | "Section 1. Short title. This Act may be cited as the |
| 6 | | Government Zero-Emission Vehicle Act.
|
| 7 | | Section 5. Definitions. As used in this Act: |
| 8 | | "Agency" means the Environmental Protection Agency. |
| 9 | | "Governmental unit" means the State, a State agency, or |
| 10 | | any other political subdivision of the State. |
| 11 | | "Law enforcement vehicle" means a publicly owned or leased |
| 12 | | vehicle that is operated by a law enforcement agency and used |
| 13 | | for the law enforcement functions of the agency. |
| 14 | | "Passenger vehicle" means a motor vehicle, except a |
| 15 | | motorcycle, designed primarily for the transportation of |
| 16 | | persons and designed for carrying no more than 10 passengers, |

| 1 | | including the driver, and primarily used for the |
| 2 | | transportation of persons. "Passenger vehicle" includes motor |
| 3 | | vehicles which are designed with seats that may be readily |
| 4 | | removed and reinstalled, but does not include such vehicles if |
| 5 | | used primarily for the transportation of property. |
| 6 | | "Zero-emission vehicle" means a passenger vehicle that |
| 7 | | produces zero exhaust emissions of any criteria pollutant, |
| 8 | | precursor pollutant, or greenhouse gas, but only produces |
| 9 | | water vapor, in any mode of operation or condition, as |
| 10 | | determined by the Agency.

| 11 | | Section 10. Zero-emission vehicles of governmental units. |
| 12 | | Notwithstanding any other provision of law, by January 1, 2030 |
| 13 | | all passenger vehicles, except for law enforcement vehicles, |
| 14 | | purchased or leased by a governmental must be either a |
| 15 | | manufactured zero-emission vehicle or a converted |
| 16 | | zero-emission.

| 17 | | Section 95. The State Mandates Act is amended by adding |
| 18 | | Section 8.47 as follows:
|
| 19 | | (30 ILCS 805/8.47 new) |
| 20 | | Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and |
| 21 | | 8 of this Act, no reimbursement by the State is required for |
| 22 | | the implementation of any mandate created by the Government |
| 23 | | Zero-Emission Vehicle Act.".
