AMENDMENT TO SENATE BILL 1769

2    AMENDMENT NO. ______. Amend Senate Bill 1769, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 1. Short title. This Act may be cited as the
6Government Zero-Emission Vehicle Act.
 
7    Section 5. Definitions. As used in this Act:
8    "Agency" means the Environmental Protection Agency.
9    "Governmental unit" means the State or State agency.
10    "Law enforcement vehicle" means a publicly owned or leased
11vehicle that is operated by a law enforcement agency and used
12for the law enforcement functions of the agency.
13    "Passenger vehicle" means a motor vehicle, except a
14motorcycle, designed primarily for the transportation of
15persons and designed for carrying no more than 10 passengers,
16including the driver, and primarily used for the

1transportation of persons. "Passenger vehicle" includes motor
2vehicles which are designed with seats that may be readily
3removed and reinstalled, but does not include such vehicles if
4used primarily for the transportation of property.
5    "Zero-emission vehicle" means a passenger vehicle that
6produces zero exhaust emissions of any criteria pollutant,
7precursor pollutant, or greenhouse gas, but only produces
8water vapor, in any mode of operation or condition, as
9determined by the Agency.
 
10    Section 10. Zero-emission vehicles of governmental units.
11Notwithstanding any other provision of law, beginning on
12January 1, 2030 all passenger vehicles, except for law
13enforcement vehicles, purchased or leased by a governmental
14must be either a manufactured zero-emission vehicle or a
15converted zero-emission.
 
16    Section 95. The State Mandates Act is amended by adding
17Section 8.47 as follows:
 
18    (30 ILCS 805/8.47 new)
19    Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and
208 of this Act, no reimbursement by the State is required for
21the implementation of any mandate created by the Government
22Zero-Emission Vehicle Act.".
