| 1 | AMENDMENT TO SENATE BILL 1769

| 2 | AMENDMENT NO. ______. Amend Senate Bill 1769, AS AMENDED, | ||||||
| 3 | by replacing everything after the enacting clause with the | ||||||
| 4 | following:
| ||||||
| 5 | "Section 1. Short title. This Act may be cited as the | ||||||
| 6 | Government Zero-Emission Vehicle Act. | ||||||
| 7 | Section 5. Definitions. As used in this Act: | ||||||
| 8 | "Agency" means the Environmental Protection Agency. | ||||||
| 9 | "Governmental unit" means the State or State agency. | ||||||
| 10 | "Law enforcement vehicle" means a publicly owned or leased | ||||||
| 11 | vehicle that is operated by a law enforcement agency and used | ||||||
| 12 | for the law enforcement functions of the agency. | ||||||
| 13 | "Passenger vehicle" means a motor vehicle, except a | ||||||
| 14 | motorcycle, designed primarily for the transportation of | ||||||
| 15 | persons and designed for carrying no more than 10 passengers, | ||||||
| 16 | including the driver, and primarily used for the | ||||||
| |||||||
| |||||||
| 1 | transportation of persons. "Passenger vehicle" includes motor | ||||||
| 2 | vehicles which are designed with seats that may be readily | ||||||
| 3 | removed and reinstalled, but does not include such vehicles if | ||||||
| 4 | used primarily for the transportation of property. | ||||||
| 5 | "Zero-emission vehicle" means a passenger vehicle that | ||||||
| 6 | produces zero exhaust emissions of any criteria pollutant, | ||||||
| 7 | precursor pollutant, or greenhouse gas, but only produces | ||||||
| 8 | water vapor, in any mode of operation or condition, as | ||||||
| 9 | determined by the Agency.

| 10 | Section 10. Zero-emission vehicles of governmental units. | ||||||
| 11 | Notwithstanding any other provision of law, beginning on | ||||||
| 12 | January 1, 2030 all passenger vehicles, except for law | ||||||
| 13 | enforcement vehicles, purchased or leased by a governmental | ||||||
| 14 | must be either a manufactured zero-emission vehicle or a | ||||||
| 15 | converted zero-emission.
| ||||||
| 16 | Section 95. The State Mandates Act is amended by adding | ||||||
| 17 | Section 8.47 as follows: | ||||||
| 18 | (30 ILCS 805/8.47 new) | ||||||
| 19 | Sec. 8.47. Exempt mandate. Notwithstanding Sections 6 and | ||||||
| 20 | 8 of this Act, no reimbursement by the State is required for | ||||||
| 21 | the implementation of any mandate created by the Government | ||||||
| 22 | Zero-Emission Vehicle Act.".
