2 | AMENDMENT NO. ______. Amend Senate Bill 2240 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Public Community College Act is amended by | ||||||
5 | adding Section 3-80 as follows: | ||||||
6 | (110 ILCS 805/3-80 new) | ||||||
7 | Sec. 3-80. Remediation data sharing agreement. | ||||||
8 | (a) Beginning January 1, 2024, a community college | ||||||
9 | district, upon a request from the school district of a high | ||||||
10 | school located within the boundaries of the community college | ||||||
11 | district, shall provide individualized disaggregated data on | ||||||
12 | the enrollment of students in community college remediation | ||||||
13 | courses from the most recently completed academic year. A | ||||||
14 | signed remediation data sharing agreement between the school | ||||||
15 | district and the community college district must be entered | ||||||
16 | into before sharing remediation data. |

1 | (b) The remediation data sharing agreement shall meet all | ||||||
2 | of the following requirements: | ||||||
3 | (1) The agreement shall require that the data be | ||||||
4 | individualized by student and that each student record be | ||||||
5 | identified with the student's State identification number | ||||||
6 | and last previous high school within the school district, | ||||||
7 | as provided by the school district. | ||||||
8 | (2) The agreement shall provide that each student | ||||||
9 | record include, at a minimum, any course codes, the course | ||||||
10 | names or titles, and the academic department for any | ||||||
11 | courses that are in the department or subject area of | ||||||
12 | mathematics, reading, English, or communications or any | ||||||
13 | other course that is designated as remedial. | ||||||
14 | (3) The agreement shall provide that each student | ||||||
15 | record include, at a minimum, course codes, course names | ||||||
16 | or titles, and the academic department for any courses in | ||||||
17 | any department or subject area in which the student is | ||||||
18 | enrolled for a given term at the community college that | ||||||
19 | are noncredit-bearing courses. | ||||||
20 | (4) The agreement shall specify the format and method | ||||||
21 | by which the data will be shared with the school district. | ||||||
22 | (5) The agreement shall provide a timeline for which | ||||||
23 | the required data shall be provided to the school district | ||||||
24 | by the community college district, which must be at least | ||||||
25 | annually and must be within a reasonable amount of time | ||||||
26 | following the end of the academic year. |

1 | (6) The agreement shall provide that the data may not | ||||||
2 | be used in the evaluation of licensed educators. | ||||||
3 | (c) If, within 90 calendar days after the school | ||||||
4 | district's initial request to enter into a remediation data | ||||||
5 | sharing agreement with the community college district under | ||||||
6 | this Section, the school district and the community college | ||||||
7 | district do not reach an agreement on all of the provisions of | ||||||
8 | a remediation data sharing agreement, then the school district | ||||||
9 | and community college district shall jointly implement the | ||||||
10 | provisions of the model remediation data sharing agreement | ||||||
11 | developed under subsection (d) for those provisions for which | ||||||
12 | an agreement could not be reached and shall jointly implement | ||||||
13 | the remaining provisions for which agreement could be reached. | ||||||
14 | A community college district may combine its negotiations with | ||||||
15 | multiple school districts to establish one uniform remediation | ||||||
16 | data sharing agreement to use with all of the school districts | ||||||
17 | with high schools located within the boundaries of the | ||||||
18 | community college district or may negotiate individual | ||||||
19 | remediation data sharing agreements with school districts. | ||||||
20 | (d) The Illinois Community College Board and the State | ||||||
21 | Board of Education shall develop a model remediation data | ||||||
22 | sharing agreement that may be used by school districts and | ||||||
23 | community college districts under this Section. The model | ||||||
24 | remediation data sharing agreement shall address all of the | ||||||
25 | matters set forth in subsection (b) and shall be completed by | ||||||
26 | January 1, 2024. |

1 | (e) The sharing of data under this Section must be in | ||||||
2 | accordance with the requirements of the federal Family | ||||||
3 | Educational Rights and Privacy Act of 1974. Nothing in this | ||||||
4 | Section supersedes the federal Family Educational Rights and | ||||||
5 | Privacy Act of 1974 or rules adopted pursuant to the federal | ||||||
6 | Family Educational Rights and Privacy Act of 1974 or any | ||||||
7 | federal or State laws or rules governing student privacy | ||||||
8 | rights.

9 | Section 99. Effective date. This Act takes effect upon | ||||||
10 | becoming law.".
