1 | AN ACT concerning education. | ||||||
2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly: | ||||||
4 | Section 5. The School Construction Law is amended by | ||||||
5 | changing Section 5-300 as follows: | ||||||
6 | (105 ILCS 230/5-300) | ||||||
7 | Sec. 5-300. Early childhood construction grants. | ||||||
8 | (a) The Capital Development Board is authorized to make | ||||||
9 | grants to public school districts and not-for-profit entities | ||||||
10 | for early childhood construction projects , except that in | ||||||
11 | fiscal year 2024 those grants may be made only to public school | ||||||
12 | districts . These grants shall be paid out of moneys | ||||||
13 | appropriated for that purpose from the School Construction | ||||||
14 | Fund, the Build Illinois Bond Fund, or the Rebuild Illinois | ||||||
15 | Projects Fund. No grants may be awarded to entities providing | ||||||
16 | services within private residences. A not-for-profit early | ||||||
17 | childhood entity that rents or leases from another | ||||||
18 | not-for-profit entity shall be considered an eligible entity | ||||||
19 | under this Section. | ||||||
20 | A public school district or other eligible entity must | ||||||
21 | provide local matching funds in the following manner: | ||||||
22 | (1) A public school district assigned to Tier 1 under | ||||||
23 | Section 18-8.15 of the School Code or any other eligible |

1 | entity in an area encompassed by that district must | ||||||
2 | provide local matching funds in an amount equal to 3% of | ||||||
3 | the grant awarded under this Section. | ||||||
4 | (2) A public school district assigned to Tier 2 under | ||||||
5 | Section 18-8.15 of the School Code or any other eligible | ||||||
6 | entity in an area encompassed by that district must | ||||||
7 | provide local matching funds in an amount equal to 7.5% of | ||||||
8 | the grant awarded under this Section. | ||||||
9 | (3) A public school district assigned to Tier 3 under | ||||||
10 | Section 18-8.15 of the School Code or any other eligible | ||||||
11 | entity in an area encompassed by that district must | ||||||
12 | provide local matching funds in an amount equal to 8.75% | ||||||
13 | of the grant awarded under this Section. | ||||||
14 | (4) A public school district assigned to Tier 4 under | ||||||
15 | Section 18-8.15 of the School Code or any other eligible | ||||||
16 | entity in an area encompassed by that district must | ||||||
17 | provide local matching funds in an amount equal to 10% of | ||||||
18 | the grant awarded under this Section. | ||||||
19 | A public school district or other eligible entity has no | ||||||
20 | entitlement to a grant under this Section. | ||||||
21 | (b) The Capital Development Board shall adopt rules to | ||||||
22 | implement this Section. These rules need not be the same as the | ||||||
23 | rules for school construction project grants or school | ||||||
24 | maintenance project grants. The rules may specify: | ||||||
25 | (1) the manner of applying for grants; | ||||||
26 | (2) project eligibility requirements; |

1 | (3) restrictions on the use of grant moneys; | ||||||
2 | (4) the manner in which school districts and other | ||||||
3 | eligible entities must account for the use of grant | ||||||
4 | moneys; | ||||||
5 | (5) requirements that new or improved facilities be | ||||||
6 | used for early childhood and other related programs for a | ||||||
7 | period of at least 10 years; and | ||||||
8 | (5.5) additional eligibility requirements for each | ||||||
9 | type of applicant; and | ||||||
10 | (6) any other provision that the Capital Development | ||||||
11 | Board determines to be necessary or useful for the | ||||||
12 | administration of this Section. | ||||||
13 | (b-5) When grants are made to non-profit corporations for | ||||||
14 | the acquisition or construction of new facilities, the Capital | ||||||
15 | Development Board or any State agency it so designates shall | ||||||
16 | hold title to or place a lien on the facility for a period of | ||||||
17 | 10 years after the date of the grant award, after which title | ||||||
18 | to the facility shall be transferred to the non-profit | ||||||
19 | corporation or the lien shall be removed, provided that the | ||||||
20 | non-profit corporation has complied with the terms of its | ||||||
21 | grant agreement. When grants are made to non-profit | ||||||
22 | corporations for the purpose of renovation or rehabilitation, | ||||||
23 | if the non-profit corporation does not comply with item (5) of | ||||||
24 | subsection (b) of this Section, the Capital Development Board | ||||||
25 | or any State agency it so designates shall recover the grant | ||||||
26 | pursuant to the procedures outlined in the Illinois Grant |

1 | Funds Recovery Act. | ||||||
2 | (c) The Capital Development Board, in consultation with | ||||||
3 | the State Board of Education, shall establish standards for | ||||||
4 | the determination of priority needs concerning early childhood | ||||||
5 | projects based on projects located in communities in the State | ||||||
6 | with the greatest underserved population of young children, | ||||||
7 | utilizing Census data and other reliable local early childhood | ||||||
8 | service data. | ||||||
9 | (d) In each school year in which early childhood | ||||||
10 | construction project grants are awarded, 20% of the total | ||||||
11 | amount awarded shall be awarded to a school district with a | ||||||
12 | population of more than 500,000, provided that the school | ||||||
13 | district complies with the requirements of this Section and | ||||||
14 | the rules adopted under this Section. | ||||||

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law. |
