AMENDMENT TO SENATE BILL 2751

2    AMENDMENT NO. ______. Amend Senate Bill 2751 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by adding Section
55-12022 as follows:
 
6    (55 ILCS 5/5-12022 new)
7    Sec. 5-12022. Building permit fee for veterans with a
8disability.
9    (a) A veteran with a disability or the veteran's caregiver
10shall not be charged any building permit fee for improvements
11to the residence of the veteran with a disability if the
12improvements are required to accommodate a disability of the
13veteran. Nothing in this subsection changes the obligation of
14any person to submit to the county applications, forms, or
15other paperwork to obtain a building permit. A veteran or
16caregiver must provide proof of veteran status and attest to

1the fact that the improvements to the residence are required
2to accommodate the veteran's disability. Proof of veteran
3status is to be construed liberally, and veteran status shall
4include service in the Armed Forces of the United States,
5National Guard, or the reserves of the Armed Forces of the
6United States.
7    (b) What constitutes proof of veteran status shall be
8determined by the county. The Illinois Department of Veterans'
9Affairs may not adjudicate any dispute arising under paragraph
10(a).
11    (c) A home rule county may not regulate building permit
12fees in a manner inconsistent with this Section. This Section
13is a limitation under subsection (i) of Section 6 of Article
14VII of the Illinois Constitution on the concurrent exercise by
15home rule units of powers and functions exercised by the
16State.
 
17    Section 10. The Township Code is amended by adding Section
18110-17 as follows:
 
19    (60 ILCS 1/110-17 new)
20    Sec. 110-17. Building permit fee for veterans with a
21disability. A veteran with a disability or the veteran's
22caregiver shall not be charged any building permit fee for
23improvements to the residence of the veteran with a disability
24if the improvements are required to accommodate a disability

14    Section 15. The Illinois Municipal Code is amended by
15adding Section 11-13-28 as follows:
 
16    (65 ILCS 5/11-13-28 new)
17    Sec. 11-13-28. Building permit fee for veterans with a
18disability.
19    (a) A veteran with a disability or the veteran's caregiver
20shall not be charged any building permit fee for improvements
21to the residence of the veteran with a disability if the
22improvements are required to accommodate a disability of the
