1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Identification Card Act is amended
5by changing Sections 4 and 5 as follows:

8    Sec. 4. Identification card.
9    (a) The Secretary of State shall issue a standard Illinois
10Identification Card to any natural person who is a resident of
11the State of Illinois who applies for such card, or renewal
12thereof. No identification card shall be issued to any person
13who holds a valid foreign state identification card, license,
14or permit unless the person first surrenders to the Secretary
15of State the valid foreign state identification card, license,
16or permit. The card shall be prepared and supplied by the
17Secretary of State and shall include a photograph and
18signature or mark of the applicant. However, the Secretary of
19State may provide by rule for the issuance of Illinois
20Identification Cards without photographs if the applicant has
21a bona fide religious objection to being photographed or to
22the display of his or her photograph. The Illinois
23Identification Card may be used for identification purposes in

1any lawful situation only by the person to whom it was issued.
2As used in this Act, "photograph" means any color photograph
3or digitally produced and captured image of an applicant for
4an identification card. As used in this Act, "signature" means
5the name of a person as written by that person and captured in
6a manner acceptable to the Secretary of State.
7    (a-5) If an applicant for an identification card has a
8current driver's license or instruction permit issued by the
9Secretary of State, the Secretary may require the applicant to
10utilize the same residence address and name on the
11identification card, driver's license, and instruction permit
12records maintained by the Secretary. The Secretary may
13promulgate rules to implement this provision.
14    (a-10) If the applicant is a judicial officer as defined
15in Section 1-10 of the Judicial Privacy Act or a peace officer,
16the applicant may elect to have his or her office or work
17address listed on the card instead of the applicant's
18residence or mailing address. The Secretary may promulgate
19rules to implement this provision. For the purposes of this
20subsection (a-10), "peace officer" means any person who by
21virtue of his or her office or public employment is vested by
22law with a duty to maintain public order or to make arrests for
23a violation of any penal statute of this State, whether that
24duty extends to all violations or is limited to specific
25violations.
26    (a-15) The Secretary of State may provide for an expedited

1process for the issuance of an Illinois Identification Card.
2The Secretary shall charge an additional fee for the expedited
3issuance of an Illinois Identification Card, to be set by
4rule, not to exceed $75. All fees collected by the Secretary
5for expedited Illinois Identification Card service shall be
6deposited into the Secretary of State Special Services Fund.
7The Secretary may adopt rules regarding the eligibility,
8process, and fee for an expedited Illinois Identification
9Card. If the Secretary of State determines that the volume of
10expedited identification card requests received on a given day
11exceeds the ability of the Secretary to process those requests
12in an expedited manner, the Secretary may decline to provide
13expedited services, and the additional fee for the expedited
14service shall be refunded to the applicant.
15    (a-20) The Secretary of State shall issue a standard
16Illinois Identification Card to a person committed to the
17Department of Corrections or Department of Juvenile Justice
18upon receipt of the person's birth certificate, social
19security card, photograph, proof of residency upon discharge,
20and an identification card application transferred via a
21secure method as agreed upon by the Secretary and the
22Department of Corrections or Department of Juvenile Justice.
23Illinois residency shall be established by submission of a
24Secretary of State prescribed Identification Card verification
25form completed by the respective Department.
26    (a-25) The Secretary of State shall issue a limited-term

1Illinois Identification Card valid for 90 days to a committed
2person upon release on parole, mandatory supervised release,
3aftercare release, final discharge, or pardon from the
4Department of Corrections or Department of Juvenile Justice,
5if the released person is unable to present a certified copy of
6his or her birth certificate and social security card or other
7documents authorized by the Secretary, but does present a
8Secretary of State prescribed Identification Card verification
9form completed by the Department of Corrections or Department
10of Juvenile Justice, verifying the released person's date of
11birth, social security number, and his or her Illinois
12residence address. The verification form must have been
13completed no more than 30 days prior to the date of application
14for the Illinois Identification Card.
15    Prior to the expiration of the 90-day period of the
16limited-term Illinois Identification Card, if the released
17person submits to the Secretary of State a certified copy of
18his or her birth certificate and his or her social security
19card or other documents authorized by the Secretary, a
20standard Illinois Identification Card shall be issued. A
21limited-term Illinois Identification Card may not be renewed.
22    (a-30) The Secretary of State shall issue a standard
23Illinois Identification Card to a person upon conditional
24release or absolute discharge from the custody of the
25Department of Human Services, if the person presents a
26certified copy of his or her birth certificate, social

1security card, or other documents authorized by the Secretary,
2and a document proving his or her Illinois residence address.
3The Secretary of State shall issue a standard Illinois
4Identification Card to a person prior to his or her
5conditional release or absolute discharge if personnel from
6the Department of Human Services bring the person to a
7Secretary of State location with the required documents.
8Documents proving residence address may include any official
9document of the Department of Human Services showing the
10person's address after release and a Secretary of State
11prescribed verification form, which may be executed by
12personnel of the Department of Human Services.
13    (a-35) The Secretary of State shall issue a limited-term
14Illinois Identification Card valid for 90 days to a person
15upon conditional release or absolute discharge from the
16custody of the Department of Human Services, if the person is
17unable to present a certified copy of his or her birth
18certificate and social security card or other documents
19authorized by the Secretary, but does present a Secretary of
20State prescribed verification form completed by the Department
21of Human Services, verifying the person's date of birth and
22social security number, and a document proving his or her
23Illinois residence address. The verification form must have
24been completed no more than 30 days prior to the date of
25application for the Illinois Identification Card. The

2his or her conditional release or absolute discharge if
3personnel from the Department of Human Services bring the
4person to a Secretary of State location with the required
5documents. Documents proving residence address shall include
6any official document of the Department of Human Services
7showing the person's address after release and a Secretary of
8State prescribed verification form, which may be executed by
9personnel of the Department of Human Services.
10    (b) The Secretary of State shall issue a special Illinois
11Identification Card, which shall be known as an Illinois
12Person with a Disability Identification Card, to any natural
13person who is a resident of the State of Illinois, who is a
14person with a disability as defined in Section 4A of this Act,
15who applies for such card, or renewal thereof. No Illinois
16Person with a Disability Identification Card shall be issued
17to any person who holds a valid foreign state identification
18card, license, or permit unless the person first surrenders to
19the Secretary of State the valid foreign state identification
20card, license, or permit. The Secretary of State shall charge
21no fee to issue such card. The card shall be prepared and
22supplied by the Secretary of State, and shall include a
23photograph and signature or mark of the applicant, a
24designation indicating that the card is an Illinois Person
25with a Disability Identification Card, and shall include a
26comprehensible designation of the type and classification of

1the applicant's disability as set out in Section 4A of this
2Act. However, the Secretary of State may provide by rule for
3the issuance of Illinois Person with a Disability
4Identification Cards without photographs if the applicant has
5a bona fide religious objection to being photographed or to
6the display of his or her photograph. If the applicant so
7requests, the card shall include a description of the
8applicant's disability and any information about the
9applicant's disability or medical history which the Secretary
10determines would be helpful to the applicant in securing
11emergency medical care. If a mark is used in lieu of a
12signature, such mark shall be affixed to the card in the
13presence of two witnesses who attest to the authenticity of
14the mark. The Illinois Person with a Disability Identification
15Card may be used for identification purposes in any lawful
16situation by the person to whom it was issued.
17    The Illinois Person with a Disability Identification Card
18may be used as adequate documentation of disability in lieu of
19a physician's determination of disability, a determination of
20disability from a physician assistant, a determination of
21disability from an advanced practice registered nurse, or any
22other documentation of disability whenever any State law
23requires that a person with a disability provide such
24documentation of disability, however an Illinois Person with a
25Disability Identification Card shall not qualify the
26cardholder to participate in any program or to receive any

1benefit which is not available to all persons with like
2disabilities. Notwithstanding any other provisions of law, an
3Illinois Person with a Disability Identification Card, or
4evidence that the Secretary of State has issued an Illinois
5Person with a Disability Identification Card, shall not be
6used by any person other than the person named on such card to
7prove that the person named on such card is a person with a
8disability or for any other purpose unless the card is used for
9the benefit of the person named on such card, and the person
10named on such card consents to such use at the time the card is
11so used.
12    An optometrist's determination of a visual disability
13under Section 4A of this Act is acceptable as documentation
14for the purpose of issuing an Illinois Person with a
15Disability Identification Card.
16    When medical information is contained on an Illinois
17Person with a Disability Identification Card, the Office of
18the Secretary of State shall not be liable for any actions
19taken based upon that medical information.
20    (c) The Secretary of State shall provide that each
21original or renewal Illinois Identification Card or Illinois
22Person with a Disability Identification Card issued to a
23person under the age of 21 shall be of a distinct nature from
24those Illinois Identification Cards or Illinois Person with a
25Disability Identification Cards issued to individuals 21 years
26of age or older. The color designated for Illinois

1Identification Cards or Illinois Person with a Disability
2Identification Cards for persons under the age of 21 shall be
3at the discretion of the Secretary of State.
4    (c-1) Each original or renewal Illinois Identification
5Card or Illinois Person with a Disability Identification Card
6issued to a person under the age of 21 shall display the date
7upon which the person becomes 18 years of age and the date upon
8which the person becomes 21 years of age.
9    (c-3) The General Assembly recognizes the need to identify
10military veterans living in this State for the purpose of
11ensuring that they receive all of the services and benefits to
12which they are legally entitled, including healthcare,
13education assistance, and job placement. To assist the State
14in identifying these veterans and delivering these vital
15services and benefits, the Secretary of State is authorized to
16issue Illinois Identification Cards and Illinois Person with a
17Disability Identification Cards with the word "veteran"
18appearing on the face of the cards. This authorization is
19predicated on the unique status of veterans. The Secretary may
20not issue any other identification card which identifies an
21occupation, status, affiliation, hobby, or other unique
22characteristics of the identification card holder which is
23unrelated to the purpose of the identification card.
24    (c-5) Beginning on or before July 1, 2015, the Secretary
25of State shall designate a space on each original or renewal
26identification card where, at the request of the applicant,

1the word "veteran" shall be placed. The veteran designation
2shall be available to a person identified as a veteran under
3subsection (b) of Section 5 of this Act who was discharged or
4separated under honorable conditions.
5    (d) The Secretary of State may issue a Senior Citizen
6discount card, to any natural person who is a resident of the
7State of Illinois who is 60 years of age or older and who
8applies for such a card or renewal thereof. The Secretary of
9State shall charge no fee to issue such card. The card shall be
10issued in every county and applications shall be made
11available at, but not limited to, nutrition sites, senior
12citizen centers and Area Agencies on Aging. The applicant,
13upon receipt of such card and prior to its use for any purpose,
14shall have affixed thereon in the space provided therefor his
15signature or mark.
16    (e) The Secretary of State, in his or her discretion, may
17designate on each Illinois Identification Card or Illinois
18Person with a Disability Identification Card a space where the
19card holder may place a sticker or decal, issued by the
20Secretary of State, of uniform size as the Secretary may
21specify, that shall indicate in appropriate language that the
22card holder has renewed his or her Illinois Identification
23Card or Illinois Person with a Disability Identification Card.
24    (f) Upon providing required documentation, at the request
25of the applicant, the identification card may reflect Gold
26Star Family designation. The Secretary shall designate a space

1on each original or renewal of an identification card for such
2designation. This designation shall be available to a person
3eligible for Gold Star license plates under subsection (f) of
4Section 6-106 of the Illinois Vehicle Code.

2    (f) Upon providing required documentation, at the request
3of the applicant, the identification card may reflect Gold
4Star Family designation. The Secretary shall designate a space
5on each original or renewal of an identification card for such

13    Sec. 5. Applications.
14    (a) Any natural person who is a resident of the State of

6judicial officer as defined in Section 1-10 of the Judicial
7Privacy Act or a peace officer, the applicant may elect to have
8his or her office or work address in lieu of the applicant's
9residence or mailing address. An applicant for an Illinois
10Person with a Disability Identification Card must also submit
11with each original or renewal application, on forms prescribed
12by the Secretary, such documentation as the Secretary may
13require, establishing that the applicant is a "person with a
14disability" as defined in Section 4A of this Act, and setting
15forth the applicant's type and class of disability as set
16forth in Section 4A of this Act. For the purposes of this
17subsection (a), "peace officer" means any person who by virtue
18of his or her office or public employment is vested by law with
19a duty to maintain public order or to make arrests for a
20violation of any penal statute of this State, whether that
21duty extends to all violations or is limited to specific
22violations.
23    (a-5) Upon the first issuance of a request for proposals
24for a digital driver's license and identification card
25issuance and facial recognition system issued after January 1,
262020 (the effective date of Public Act 101-513), and upon

1implementation of a new or revised system procured pursuant to
2that request for proposals, the Secretary shall permit
3applicants to choose between "male", "female", or "non-binary"
4when designating the applicant's sex on the identification
5card application form. The sex designated by the applicant
6shall be displayed on the identification card issued to the
7applicant.
8    (b) Beginning on or before July 1, 2015, for each original
9or renewal identification card application under this Act, the
10Secretary shall inquire as to whether the applicant is a
11veteran for purposes of issuing an identification card with a
12veteran designation under subsection (c-5) of Section 4 of
13this Act. The acceptable forms of proof shall include, but are
14not limited to, Department of Defense form DD-214, Department
15of Defense form DD-256 for applicants who did not receive a
16form DD-214 upon the completion of initial basic training,
17Department of Defense form DD-2 (Retired), an identification
18card issued under the federal Veterans Identification Card Act
19of 2015, or a United States Department of Veterans Affairs
20summary of benefits letter. If the document cannot be stamped,
21the Illinois Department of Veterans' Affairs shall provide a
22certificate to the veteran to provide to the Secretary of
23State. The Illinois Department of Veterans' Affairs shall
24advise the Secretary as to what other forms of proof of a
25person's status as a veteran are acceptable.
26    For each applicant who is issued an identification card

1with a veteran designation, the Secretary shall provide the
2Department of Veterans' Affairs with the applicant's name,
3address, date of birth, gender, and such other demographic
4information as agreed to by the Secretary and the Department.
5The Department may take steps necessary to confirm the
6applicant is a veteran. If after due diligence, including
7writing to the applicant at the address provided by the
8Secretary, the Department is unable to verify the applicant's
9veteran status, the Department shall inform the Secretary, who
10shall notify the applicant that he or she must confirm status
11as a veteran, or the identification card will be cancelled.
12    For purposes of this subsection (b):
13    "Armed forces" means any of the Armed Forces of the United
14States, including a member of any reserve component or
15National Guard unit.
16    "Veteran" means a person who has served in the armed
17forces and was discharged or separated under honorable
18conditions.
19    (b-1) An applicant who is eligible for Gold Star license
20plates under Section 3-664 of the Illinois Vehicle Code may
21apply for an identification card with space for a designation
22as a Gold Star Family. The Secretary may waive any fee for this
23application. If the Secretary does not waive the fee, any fee
24charged to the applicant must be deposited into the Illinois
25Veterans Assistance Fund. The Secretary is authorized to issue
26rules to implement this subsection.

1    (c) All applicants for REAL ID compliant standard Illinois
2Identification Cards and Illinois Person with a Disability
3Identification Cards shall provide proof of lawful status in

6of lawful status are ineligible for REAL ID compliant
7identification cards under this Act.

7    (d) The Secretary of State may accept, as proof of date of
8birth and written signature for any applicant for a standard
9identification card who does not have a social security number
10or documentation issued by the United States Department of
11Homeland Security authorizing the applicant's presence in this
12country, any passport validly issued to the applicant from the
13applicant's country of citizenship or a consular
14identification document validly issued to the applicant by a
15consulate of that country as defined in Section 5 of the
16Consular Identification Document Act. Any such documents must
17be either unexpired or presented by an applicant within 2
18years of its expiration date.

1in support of the mission and goals of the Agency.
2    (b) Create and execute such seminars, symposia, or other
3conferences as may be necessary or advisable to the Agency.
4    (c) Report annually to the Governor and the General
5Assembly on the status of the Agency and its programs.
6    (d) Accept, hold, maintain, and administer, as trustee,
7property given in trust for education or historic purposes for
8the benefit of the people of the State of Illinois and dispose
9of any property under the terms of the instrument creating the
10trust.
11    (e) Accept, hold, maintain, and administer donated
12property of historical significance, such as books, papers,
13records, and personal property of any kind, including
14electronic and digital property, pursuant to gifting
15instruments, agreements, or deeds of gift, including but not
16limited to the King Hostick Public Trust Fund, and enter into
17such agreements as may be necessary to carry out the Board's
18duties and responsibilities under this Section.
19    (f) Lease concessions at the Library and Museum. All
20leases, for whatever period, shall be made subject to the
21written approval of the Governor's Office of Management and
22Budget. All concession leases extending for a period in excess
23of 10 years shall contain provisions for the Agency to
24participate, on a percentage basis, in the revenues generated
25by any concession operation.
26    (g) Enforce the laws of the State and the rules of the

1Agency.
2    (h) Cooperate with private organizations and agencies of
3the State of Illinois by providing areas and the use of staff
4personnel where feasible for the sale of publications on the
5historic and cultural heritage of the State and craft items
6made by Illinois craftsmen. These sales shall not conflict
7with existing concession agreements. The Board is authorized
8to negotiate and approve agreements with the organizations and
9agencies for a portion of the moneys received from sales to be
10returned to the Agency for the furtherance of interpretative
11and restoration programs.
12    (i) Accept offers of gifts, gratuities, or grants from the
13federal government, its agencies, or offices, or from any
14person, firm, or corporation.
15    (j) Subject to the provisions of the Illinois
16Administrative Procedure Act, make reasonable rules as may be
17necessary to discharge the duties of the Agency.
18    (k) Charge and collect admission fees and rental for
19access to and use of the facilities of the Library and Museum;
20however, an Illinois resident who shows a driver's license or
21Illinois Identification Card containing a designation that the
22resident is a Gold Star Family member shall not be charged an
23admission fee for entry to the Museum during its normal hours
24of operation.
25    (l) Operate a restaurant, cafe, or other food serving
26facility at the Museum or lease the operation of such a

1facility under reasonable terms and conditions, and provide
2vending services for food, beverages, or other products deemed
3necessary and proper, consistent with the purposes of the
4Library and Museum.
5    (m) Engage in marketing activities designed to promote the
6Library and Museum. In undertaking these activities, the Board
7may take all necessary steps with respect to products and
8services, including, but not limited to, retail sales,
9wholesale sales, direct marketing, mail order sales, telephone
10sales, advertising and promotion, purchase of product and
11materials inventory, design and printing and manufacturing of
12new products, reproductions, and adaptations, copyright and
13trademark licensing and royalty agreements, and payment of
14applicable taxes. In addition, the Board shall have the
15authority to sell advertising in its publications and printed
16materials.

2    Sec. 1. Erect, operate, and maintain aquariums and
3museums. The corporate authorities of cities and park
4districts having control or supervision over any public park
5or parks, including parks located on formerly submerged land,
6are hereby authorized to purchase, erect, and maintain within
7any such public park or parks edifices to be used as aquariums
8or as museums of art, industry, science, or natural or other
9history, including presidential libraries, centers, and
10museums, such aquariums and museums consisting of all
11facilities for their collections, exhibitions, programming,
12and associated initiatives, or to permit the directors or
13trustees of any corporation or society organized for the
14construction or maintenance and operation of an aquarium or
15museum as hereinabove described to erect, enlarge, ornament,
16build, rebuild, rehabilitate, improve, maintain, and operate
17its aquarium or museum within any public park now or hereafter
18under the control or supervision of any city or park district,
19and to contract with any such directors or trustees of any such
20aquarium or museum relative to the erection, enlargement,
21ornamentation, building, rebuilding, rehabilitation,
22improvement, maintenance, ownership, and operation of such
23aquarium or museum. Notwithstanding the previous sentence, a
24city or park district may enter into a lease for an initial
25term not to exceed 99 years, subject to renewal, allowing a

1corporation or society as hereinabove described to erect,
2enlarge, ornament, build, rebuild, rehabilitate, improve,
3maintain, and operate its aquarium or museum, together with
4grounds immediately adjacent to such aquarium or museum, and
5to use, possess, and occupy grounds surrounding such aquarium
6or museum as hereinabove described for the purpose of
7beautifying and maintaining such grounds in a manner
8consistent with the aquarium or museum's purpose, and on the
9conditions that (1) the public is allowed access to such
10grounds in a manner consistent with its access to other public
11parks, and (2) the city or park district retains a
12reversionary interest in any improvements made by the
13corporation or society on the grounds, including the aquarium
14or museum itself, that matures upon the expiration or lawful
15termination of the lease. It is hereby reaffirmed and found
16that the aquariums and museums as described in this Section,
17and their collections, exhibitions, programming, and
18associated initiatives, serve valuable public purposes,
19including, but not limited to, furthering human knowledge and
20understanding, educating and inspiring the public, and
21expanding recreational and cultural resources and
22opportunities. Any city or park district may charge, or permit
23such an aquarium or museum to charge, an admission fee. Any
24such aquarium or museum, however, shall be open without
25charge, when accompanied by a teacher, to the children in
26actual attendance upon grades kindergarten through twelve in

1any of the schools in this State at all times. In addition,
2except as otherwise provided in this Section, any such
3aquarium or museum must be open to persons who reside in this
4State without charge for a period equivalent to 52 days, at
5least 6 of which must be during the period from June through
6August, each year. Beginning on the effective date of this
7amendatory Act of the 101st General Assembly through June 30,
82022, any such aquarium or museum must be open to persons who
9reside in this State without charge for a period equivalent to
1052 days, at least 6 of which must be during the period from
11June through August, 2021. Any such museum shall be open
12without charge throughout the year to an Illinois resident who
13shows a driver's license or Illinois Identification Card
14containing a designation that the resident is a Gold Star
15Family member. Notwithstanding said provisions, charges may be
16made at any time for special services and for admission to
17special facilities within any aquarium or museum for the
18education, entertainment, or convenience of visitors. The
19proceeds of such admission fees and charges for special
20services and special facilities shall be devoted exclusively
21to the purposes for which the tax authorized by Section 2
22hereof may be used. If any owner or owners of any lands or lots
23abutting or fronting on any such public park, or adjacent
24thereto, have any private right, easement, interest or
25property in such public park appurtenant to their lands or
26lots or otherwise, which would be interfered with by the

1erection and maintenance of any aquarium or museum as
2hereinbefore provided, or any right to have such public park
3remain open or vacant and free from buildings, the corporate
4authorities of the city or park district having control of
5such park, may condemn the same in the manner prescribed for
6the exercise of the right of eminent domain under the Eminent
7Domain Act. The changes made to this Section by this
8amendatory Act of the 99th General Assembly are declaratory of
9existing law and shall not be construed as a new enactment.

11    Section 25. The Illinois Vehicle Code is amended by
12changing Sections 3-699.14, 6-106, and 6-110 as follows:

14    Sec. 3-699.14. Universal special license plates.
15    (a) In addition to any other special license plate, the
16Secretary, upon receipt of all applicable fees and
17applications made in the form prescribed by the Secretary, may
18issue Universal special license plates to residents of
19Illinois on behalf of organizations that have been authorized
20by the General Assembly to issue decals for Universal special
21license plates. Appropriate documentation, as determined by
22the Secretary, shall accompany each application. Authorized
23organizations shall be designated by amendment to this
24Section. When applying for a Universal special license plate

1the applicant shall inform the Secretary of the name of the
2authorized organization from which the applicant will obtain a
3decal to place on the plate. The Secretary shall make a record
4of that organization and that organization shall remain
5affiliated with that plate until the plate is surrendered,
6revoked, or otherwise cancelled. The authorized organization
7may charge a fee to offset the cost of producing and
8distributing the decal, but that fee shall be retained by the
9authorized organization and shall be separate and distinct
10from any registration fees charged by the Secretary. No decal,
11sticker, or other material may be affixed to a Universal
12special license plate other than a decal authorized by the
13General Assembly in this Section or a registration renewal
14sticker. The special plates issued under this Section shall be
15affixed only to passenger vehicles of the first division,
16including motorcycles and autocycles, or motor vehicles of the
17second division weighing not more than 8,000 pounds. Plates
18issued under this Section shall expire according to the
19multi-year procedure under Section 3-414.1 of this Code.
20    (b) The design, color, and format of the Universal special
21license plate shall be wholly within the discretion of the
22Secretary. Universal special license plates are not required
23to designate "Land of Lincoln", as prescribed in subsection
24(b) of Section 3-412 of this Code. The design shall allow for
25the application of a decal to the plate. Organizations
26authorized by the General Assembly to issue decals for

1Universal special license plates shall comply with rules
2adopted by the Secretary governing the requirements for and
3approval of Universal special license plate decals. The
4Secretary may, in his or her discretion, allow Universal
5special license plates to be issued as vanity or personalized
6plates in accordance with Section 3-405.1 of this Code. The
7Secretary of State must make a version of the special
8registration plates authorized under this Section in a form
9appropriate for motorcycles and autocycles.
10    (c) When authorizing a Universal special license plate,
11the General Assembly shall set forth whether an additional fee
12is to be charged for the plate and, if a fee is to be charged,
13the amount of the fee and how the fee is to be distributed.
14When necessary, the authorizing language shall create a
15special fund in the State treasury into which fees may be
16deposited for an authorized Universal special license plate.
17Additional fees may only be charged if the fee is to be paid
18over to a State agency or to a charitable entity that is in
19compliance with the registration and reporting requirements of
20the Charitable Trust Act and the Solicitation for Charity Act.
21Any charitable entity receiving fees for the sale of Universal
22special license plates shall annually provide the Secretary of
23State a letter of compliance issued by the Attorney General
24verifying that the entity is in compliance with the Charitable
25Trust Act and the Solicitation for Charity Act.
26    (d) Upon original issuance and for each registration

1renewal period, in addition to the appropriate registration
2fee, if applicable, the Secretary shall collect any additional
3fees, if required, for issuance of Universal special license
4plates. The fees shall be collected on behalf of the
5organization designated by the applicant when applying for the
6plate. All fees collected shall be transferred to the State
7agency on whose behalf the fees were collected, or paid into
8the special fund designated in the law authorizing the
9organization to issue decals for Universal special license
10plates. All money in the designated fund shall be distributed
11by the Secretary subject to appropriation by the General
12Assembly.
13    (e) The following organizations may issue decals for
14Universal special license plates with the original and renewal
15fees and fee distribution as follows:
16        (1) The Illinois Department of Natural Resources.
17            (A) Original issuance: $25; with $10 to the
18        Roadside Monarch Habitat Fund and $15 to the Secretary
19        of State Special License Plate Fund.
20            (B) Renewal: $25; with $23 to the Roadside Monarch
21        Habitat Fund and $2 to the Secretary of State Special
22        License Plate Fund.
23        (2) Illinois Veterans' Homes.
24            (A) Original issuance: $26, which shall be
25        deposited into the Illinois Veterans' Homes Fund.
26            (B) Renewal: $26, which shall be deposited into

13    Sec. 6-106. Application for license or instruction permit.
14    (a) Every application for any permit or license authorized
15to be issued under this Code shall be made upon a form
16furnished by the Secretary of State. Every application shall
17be accompanied by the proper fee and payment of such fee shall
18entitle the applicant to not more than 3 attempts to pass the
19examination within a period of one year after the date of
20application.
21    (b) Every application shall state the legal name, social
22security number, zip code, date of birth, sex, and residence
23address of the applicant; briefly describe the applicant;
24state whether the applicant has theretofore been licensed as a
25driver, and, if so, when and by what state or country, and

1whether any such license has ever been cancelled, suspended,
2revoked or refused, and, if so, the date and reason for such
3cancellation, suspension, revocation or refusal; shall include
4an affirmation by the applicant that all information set forth
5is true and correct; and shall bear the applicant's signature.
6In addition to the residence address, the Secretary may allow
7the applicant to provide a mailing address. In the case of an
8applicant who is a judicial officer or peace officer, the
9Secretary may allow the applicant to provide an office or work
10address in lieu of a residence or mailing address. The
11application form may also require the statement of such
12additional relevant information as the Secretary of State
13shall deem necessary to determine the applicant's competency
14and eligibility. The Secretary of State may, in his
15discretion, by rule or regulation, provide that an application
16for a drivers license or permit may include a suitable
17photograph of the applicant in the form prescribed by the
18Secretary, and he may further provide that each drivers
19license shall include a photograph of the driver. The
20Secretary of State may utilize a photograph process or system
21most suitable to deter alteration or improper reproduction of
22a drivers license and to prevent substitution of another photo
23thereon. For the purposes of this subsection (b), "peace
24officer" means any person who by virtue of his or her office or
25public employment is vested by law with a duty to maintain
26public order or to make arrests for a violation of any penal

1statute of this State, whether that duty extends to all
2violations or is limited to specific violations.
3    (b-3) Upon the first issuance of a request for proposals
4for a digital driver's license and identification card
5issuance and facial recognition system issued after January 1,
62020 (the effective date of Public Act 101-513), and upon
7implementation of a new or revised system procured pursuant to
8that request for proposals, the Secretary shall permit
9applicants to choose between "male", "female" or "non-binary"
10when designating the applicant's sex on the driver's license
11application form. The sex designated by the applicant shall be
12displayed on the driver's license issued to the applicant.
13    (b-5) Every applicant for a REAL ID compliant driver's
14license or permit shall provide proof of lawful status in the
15United States as defined in 6 CFR 37.3, as amended. Applicants
16who are unable to provide the Secretary with proof of lawful
17status may apply for a driver's license or permit under
18Section 6-105.1 of this Code.
19    (c) The application form shall include a notice to the
20applicant of the registration obligations of sex offenders
21under the Sex Offender Registration Act. The notice shall be
22provided in a form and manner prescribed by the Secretary of
23State. For purposes of this subsection (c), "sex offender" has
24the meaning ascribed to it in Section 2 of the Sex Offender
25Registration Act.
26    (d) Any male United States citizen or immigrant who

1applies for any permit or license authorized to be issued
2under this Code or for a renewal of any permit or license, and
3who is at least 18 years of age but less than 26 years of age,
4must be registered in compliance with the requirements of the
5federal Military Selective Service Act. The Secretary of State
6must forward in an electronic format the necessary personal
7information regarding the applicants identified in this
8subsection (d) to the Selective Service System. The
9applicant's signature on the application serves as an
10indication that the applicant either has already registered
11with the Selective Service System or that he is authorizing
12the Secretary to forward to the Selective Service System the
13necessary information for registration. The Secretary must
14notify the applicant at the time of application that his
15signature constitutes consent to registration with the
16Selective Service System, if he is not already registered.
17    (e) Beginning on or before July 1, 2015, for each original
18or renewal driver's license application under this Code, the
19Secretary shall inquire as to whether the applicant is a
20veteran for purposes of issuing a driver's license with a
21veteran designation under subsection (e-5) of Section 6-110 of
22this Code. The acceptable forms of proof shall include, but
23are not limited to, Department of Defense form DD-214,
24Department of Defense form DD-256 for applicants who did not
25receive a form DD-214 upon the completion of initial basic
26training, Department of Defense form DD-2 (Retired), an

2Identification Card Act of 2015, or a United States Department
3of Veterans Affairs summary of benefits letter. If the
4document cannot be stamped, the Illinois Department of

6to provide to the Secretary of State. The Illinois Department
7of Veterans' Affairs shall advise the Secretary as to what
8other forms of proof of a person's status as a veteran are
9acceptable.
10    For each applicant who is issued a driver's license with a
11veteran designation, the Secretary shall provide the
12Department of Veterans' Affairs with the applicant's name,
13address, date of birth, gender and such other demographic
14information as agreed to by the Secretary and the Department.
15The Department may take steps necessary to confirm the
16applicant is a veteran. If after due diligence, including
17writing to the applicant at the address provided by the
18Secretary, the Department is unable to verify the applicant's
19veteran status, the Department shall inform the Secretary, who
20shall notify the applicant that he or she must confirm status
21as a veteran, or the driver's license will be cancelled.
22    For purposes of this subsection (e):
23    "Armed forces" means any of the Armed Forces of the United
24States, including a member of any reserve component or
25National Guard unit.
26    "Veteran" means a person who has served in the armed

3    (f) An applicant who is eligible for Gold Star license

8fee, any fee charged to the applicant must be deposited into
9the Illinois Veterans Assistance Fund. The Secretary is
10authorized to issue rules to implement this subsection.

6for a standard driver's license and, on the date of
7application, is ineligible for a social security number, then:
8        (1) if the applicant has documentation, issued by the
9    United States Department of Homeland Security, authorizing
10    the applicant's presence in this country, the applicant
11    shall provide such documentation instead of a social
12    security number; and
13        (2) if the applicant does not have documentation
14    described in paragraph (1), the applicant shall provide,
15    instead of a social security number, the following:
16            (A) documentation establishing that the applicant
17        has resided in this State for a period in excess of one
18        year;
19            (B) a passport validly issued to the applicant
20        from the applicant's country of citizenship or a
21        consular identification document validly issued to the
22        applicant by a consulate of that country as defined in
23        Section 5 of the Consular Identification Document Act,
24        as long as such documents are either unexpired or
25        presented by an applicant within 2 years of its
26        expiration date; and

10    Sec. 6-110. Licenses issued to drivers.
11    (a) The Secretary of State shall issue to every qualifying
12applicant a driver's license as applied for, which license
13shall bear a distinguishing number assigned to the licensee,
14the legal name, signature, zip code, date of birth, residence
15address, and a brief description of the licensee.
16    Licenses issued shall also indicate the classification and
17the restrictions under Section 6-104 of this Code. The
18Secretary may adopt rules to establish informational
19restrictions that can be placed on the driver's license
20regarding specific conditions of the licensee.
21    A driver's license issued may, in the discretion of the
22Secretary, include a suitable photograph of a type prescribed
23by the Secretary.
24    (a-1) If the licensee is less than 18 years of age, unless
25one of the exceptions in subsection (a-2) apply, the license

1shall, as a matter of law, be invalid for the operation of any
2motor vehicle during the following times:
3        (A) Between 11:00 p.m. Friday and 6:00 a.m. Saturday;
4        (B) Between 11:00 p.m. Saturday and 6:00 a.m. on
5    Sunday; and
6        (C) Between 10:00 p.m. on Sunday to Thursday,
7    inclusive, and 6:00 a.m. on the following day.
8    (a-2) The driver's license of a person under the age of 18
9shall not be invalid as described in subsection (a-1) of this
10Section if the licensee under the age of 18 was:
11        (1) accompanied by the licensee's parent or guardian
12    or other person in custody or control of the minor;
13        (2) on an errand at the direction of the minor's
14    parent or guardian, without any detour or stop;
15        (3) in a motor vehicle involved in interstate travel;
16        (4) going to or returning home from an employment
17    activity, without any detour or stop;
18        (5) involved in an emergency;
19        (6) going to or returning home from, without any
20    detour or stop, an official school, religious, or other
21    recreational activity supervised by adults and sponsored
22    by a government or governmental agency, a civic
23    organization, or another similar entity that takes
24    responsibility for the licensee, without any detour or
25    stop;
26        (7) exercising First Amendment rights protected by the

1    United States Constitution, such as the free exercise of
2    religion, freedom of speech, and the right of assembly; or
3        (8) married or had been married or is an emancipated
4    minor under the Emancipation of Minors Act.
5    (a-2.5) The driver's license of a person who is 17 years of
6age and has been licensed for at least 12 months is not invalid
7as described in subsection (a-1) of this Section while the
8licensee is participating as an assigned driver in a Safe
9Rides program that meets the following criteria:
10        (1) the program is sponsored by the Boy Scouts of
11    America or another national public service organization;
12    and
13        (2) the sponsoring organization carries liability
14    insurance covering the program.
15    (a-3) If a graduated driver's license holder over the age
16of 18 committed an offense against traffic regulations
17governing the movement of vehicles or any violation of Section
186-107 or Section 12-603.1 of this Code in the 6 months prior to
19the graduated driver's license holder's 18th birthday, and was
20subsequently convicted of the offense, the provisions of
21subsection (a-1) shall continue to apply until such time as a
22period of 6 consecutive months has elapsed without an
23additional violation and subsequent conviction of an offense
24against traffic regulations governing the movement of vehicles
25or Section 6-107 or Section 12-603.1 of this Code.
26    (a-4) If an applicant for a driver's license or

1instruction permit has a current identification card issued by
2the Secretary of State, the Secretary may require the
3applicant to utilize the same residence address and name on
4the identification card, driver's license, and instruction
5permit records maintained by the Secretary. The Secretary may
6promulgate rules to implement this provision.
7    (a-5) If an applicant for a driver's license is a judicial
8officer or a peace officer, the applicant may elect to have his
9or her office or work address listed on the license instead of
10the applicant's residence or mailing address. The Secretary of
11State shall adopt rules to implement this subsection (a-5).
12For the purposes of this subsection (a-5), "peace officer"
13means any person who by virtue of his or her office or public
14employment is vested by law with a duty to maintain public
15order or to make arrests for a violation of any penal statute
16of this State, whether that duty extends to all violations or
17is limited to specific violations.
18    (b) Until the Secretary of State establishes a First
19Person Consent organ and tissue donor registry under Section
206-117 of this Code, the Secretary of State shall provide a
21format on the reverse of each driver's license issued which
22the licensee may use to execute a document of gift conforming
23to the provisions of the Illinois Anatomical Gift Act. The
24format shall allow the licensee to indicate the gift intended,
25whether specific organs, any organ, or the entire body, and
26shall accommodate the signatures of the donor and 2 witnesses.

1The Secretary shall also inform each applicant or licensee of
2this format, describe the procedure for its execution, and may
3offer the necessary witnesses; provided that in so doing, the
4Secretary shall advise the applicant or licensee that he or
5she is under no compulsion to execute a document of gift. A
6brochure explaining this method of executing an anatomical
7gift document shall be given to each applicant or licensee.
8The brochure shall advise the applicant or licensee that he or
9she is under no compulsion to execute a document of gift, and
10that he or she may wish to consult with family, friends or
11clergy before doing so. The Secretary of State may undertake
12additional efforts, including education and awareness
13activities, to promote organ and tissue donation.
14    (c) The Secretary of State shall designate on each
15driver's license issued a space where the licensee may place a
16sticker or decal of the uniform size as the Secretary may
17specify, which sticker or decal may indicate in appropriate
18language that the owner of the license carries an Emergency
19Medical Information Card.
20    The sticker may be provided by any person, hospital,
21school, medical group, or association interested in assisting
22in implementing the Emergency Medical Information Card, but
23shall meet the specifications as the Secretary may by rule or
24regulation require.
25    (d) The Secretary of State shall designate on each
26driver's license issued a space where the licensee may

1indicate his blood type and RH factor.
2    (e) The Secretary of State shall provide that each
3original or renewal driver's license issued to a licensee
4under 21 years of age shall be of a distinct nature from those
5driver's licenses issued to individuals 21 years of age and
6older. The color designated for driver's licenses for
7licensees under 21 years of age shall be at the discretion of
8the Secretary of State.
9    (e-1) The Secretary shall provide that each driver's
10license issued to a person under the age of 21 displays the
11date upon which the person becomes 18 years of age and the date
12upon which the person becomes 21 years of age.
13    (e-3) The General Assembly recognizes the need to identify
14military veterans living in this State for the purpose of
15ensuring that they receive all of the services and benefits to
16which they are legally entitled, including healthcare,
17education assistance, and job placement. To assist the State
18in identifying these veterans and delivering these vital
19services and benefits, the Secretary of State is authorized to
20issue drivers' licenses with the word "veteran" appearing on
21the face of the licenses. This authorization is predicated on
22the unique status of veterans. The Secretary may not issue any
23other driver's license which identifies an occupation, status,
24affiliation, hobby, or other unique characteristics of the
25license holder which is unrelated to the purpose of the
26driver's license.

1    (e-5) Beginning on or before July 1, 2015, the Secretary
2of State shall designate a space on each original or renewal
3driver's license where, at the request of the applicant, the
4word "veteran" shall be placed. The veteran designation shall
5be available to a person identified as a veteran under
6subsection (e) of Section 6-106 of this Code who was
7discharged or separated under honorable conditions.
8    (e-7) Upon providing required documentation, at the
9request of the applicant, the driver's license may reflect
10Gold Star Family designation. The Secretary shall designate a
11space on each original or renewal driver's license for such
12designation. This designation shall be available to a person
13eligible for Gold Star license plates under subsection (f) of
14Section 6-106 of this Code.
15    (f) The Secretary of State shall inform all Illinois
16licensed commercial motor vehicle operators of the
17requirements of the Uniform Commercial Driver License Act,
18Article V of this Chapter, and shall make provisions to insure
19that all drivers, seeking to obtain a commercial driver's
20license, be afforded an opportunity prior to April 1, 1992, to
21obtain the license. The Secretary is authorized to extend
22driver's license expiration dates, and assign specific times,
23dates and locations where these commercial driver's tests
24shall be conducted. Any applicant, regardless of the current
25expiration date of the applicant's driver's license, may be
26subject to any assignment by the Secretary. Failure to comply

1with the Secretary's assignment may result in the applicant's
2forfeiture of an opportunity to receive a commercial driver's
3license prior to April 1, 1992.
4    (g) The Secretary of State shall designate on a driver's
5license issued, a space where the licensee may indicate that
6he or she has drafted a living will in accordance with the
7Illinois Living Will Act or a durable power of attorney for
8health care in accordance with the Illinois Power of Attorney
9Act.
10    (g-1) The Secretary of State, in his or her discretion,
11may designate on each driver's license issued a space where
12the licensee may place a sticker or decal, issued by the
13Secretary of State, of uniform size as the Secretary may
14specify, that shall indicate in appropriate language that the
15owner of the license has renewed his or her driver's license.
16    (h) A person who acts in good faith in accordance with the
17terms of this Section is not liable for damages in any civil
18action or subject to prosecution in any criminal proceeding
19for his or her act.
20    (i) The Secretary shall designate a space on each original
21or renewal of a driver's license, at the request of the
22applicant, for a designation as a Gold Star Family. This
23designation shall be available to a person eligible for Gold
24Star license plates under subsection (f) of Section 6-106 of
25this Code.
