1 | AN ACT concerning transportation. | |||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
3 | represented in the General Assembly: | |||||||||||||||||||||
4 | Section 5. The Illinois Vehicle Code is amended by | |||||||||||||||||||||
5 | changing Sections 3-606.1 and 3-606.5 as follows: | |||||||||||||||||||||
6 | (625 ILCS 5/3-606.1) (from Ch. 95 1/2, par. 3-606.1) | |||||||||||||||||||||
7 | Sec. 3-606.1. Retired members of the General Assembly. | |||||||||||||||||||||
8 | Upon receipt of a request from a retired member of the General | |||||||||||||||||||||
9 | Assembly, accompanied by the appropriate application and fee, | |||||||||||||||||||||
10 | the Secretary of State shall issue to such retired member | |||||||||||||||||||||
11 | plates bearing appropriate wording or abbreviations indicating | |||||||||||||||||||||
12 | that the holder is a retired member of the General Assembly. | |||||||||||||||||||||
13 | Such plates may be issued for a 2 year period beginning January | |||||||||||||||||||||
14 | 1st of each odd-numbered year and ending December 31st of the | |||||||||||||||||||||
15 | subsequent even-numbered year. Except as otherwise provided in | |||||||||||||||||||||
16 | this Section, upon the death of a retired member who has been | |||||||||||||||||||||
17 | issued a retired member of the General Assembly plate, that | |||||||||||||||||||||
18 | member's surviving spouse shall be entitled to retain the | |||||||||||||||||||||
19 | plate so long as the surviving spouse is a resident of Illinois | |||||||||||||||||||||
20 | and transfers the registration to his or her name within 90 | |||||||||||||||||||||
21 | days of the death of the retired member. | |||||||||||||||||||||
22 | A retired member of the General Assembly who has a | |||||||||||||||||||||
23 | disability as defined under Section 1-159.1 may request one |

1 | set of specialized plates which display the International | ||||||
2 | Symbol of Access and shall be subject to the provisions within | ||||||
3 | Section 3-616. The set of specialized plates displaying the | ||||||
4 | International Symbol of Access shall only be issued along with | ||||||
5 | the assignment of a corresponding disability placard that must | ||||||
6 | be displayed in the vehicle. The surviving spouse of the | ||||||
7 | retired member shall not be entitled to retain this plate. | ||||||
8 | "Retired member" means any individual who (a) has served | ||||||
9 | as a member of the General Assembly for a minimum of 6 years, | ||||||
10 | or (b) is 62 or older, has served as a member of the General | ||||||
11 | Assembly for a minimum of 4 years, and retired prior to the | ||||||
12 | convening of the 83rd General Assembly. | ||||||
13 | The fees and procedures relating to such plates for | ||||||
14 | retired members of the General Assembly shall be the same as | ||||||
15 | the fees and procedures applicable to personalized plates | ||||||
16 | issued under this Code. | ||||||
17 | This Section shall not apply to any retired member of the | ||||||
18 | General Assembly who receives a felony conviction that relates | ||||||
19 | to any transactions carried out as part of the retired | ||||||
20 | member's official duties. | ||||||

23 | Sec. 3-606.5. Retired Executive Branch Constitutional | ||||||
24 | Officers. Upon receipt of a request from a retired executive | ||||||
25 | branch constitutional officer, accompanied by the appropriate |

2 | retired executive branch constitutional officer plates bearing | ||||||
3 | appropriate wording or abbreviations indicating that the | ||||||
4 | holder is a retired executive branch constitutional officer | ||||||
5 | and the office held. Such plates may be issued for a 2-year | ||||||
6 | period beginning on January 1 of each odd-numbered year and | ||||||
7 | ending on December 31 of the subsequent even-numbered year. | ||||||
8 | Upon the death of a retired executive branch constitutional | ||||||

12 | retain the plate so long as the surviving spouse is a resident | ||||||
13 | of Illinois and transfers the registration to his or her name | ||||||
14 | within 90 days of the death of the retired executive branch | ||||||
15 | constitutional officer. For purposes of this Section, "retired | ||||||
16 | executive branch constitutional officer" means any individual | ||||||
17 | who has served at least one full term of office as (i) | ||||||
18 | Governor; (ii) Lieutenant Governor; (iii) Attorney General; | ||||||
19 | (iv) Secretary of State; (v) Comptroller; or (vi) Treasurer; | ||||||
20 | and who was not removed from office pursuant to Section 14 of | ||||||
21 | Article IV of the Illinois Constitution of 1970. | ||||||
22 | This Section shall not apply to any retired executive | ||||||
23 | branch constitutional officer who receives a felony conviction | ||||||
24 | that relates to any transactions carried out as part of the | ||||||
25 | retired executive branch constitutional officer's official | ||||||
26 | duties. |
