SYNOPSIS AS INTRODUCED:

    Amends the O'Hare Driver Safety Act. Defines "Department" as the Illinois Department of Transportation. In a provision prohibition stopping or standing within one-half mile of O'Hare International Airport, provides that "traffic route" refers to all routes within the defined radii, including routes that are under the jurisdiction or partial jurisdiction of the Department. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The O'Hare Driver Safety Act is amended by
5changing Sections 5 and 10 as follows:

9    Sec. 5. Definitions. As used in this Act:
10    "Authority" means the Illinois Toll Highway Authority.
11    "Automated traffic safety system" means a device with one
12or more motor vehicle sensors to produce a recorded image of a
13motor vehicle that is stopped or standing on the side of a
14highway or roadway in violation of Section 11-1303 of the
15Illinois Vehicle Code.
16    "Department" means the Illinois Department of
17Transportation.
18    "Recorded images" has the same meaning given to that term
19under Section 11-208.6 of the Illinois Vehicle Code.

2    Sec. 10. No stopping or standing within one-half mile of
3O'Hare International Airport. Except where permitted, a person
4operating a motor vehicle shall not stop or stand the person's
5vehicle on a shoulder of a highway along traffic routes within
6a one-half mile radius of: (1) the eastern entrance to O'Hare
7International Airport; and (2) the intersection of Interstate
890 and Interstate 294.
9    No person who is the lessor of a motor vehicle under a
10written lease agreement shall be liable for an automated
11traffic safety system violation involving such motor vehicle
12during the period of the lease, unless, upon the request of the
13appropriate authority received within 120 days after the
14violation occurred, the lessor provides within 60 days after
15such receipt the name and address of the lessee.
16    Upon the provision of information by the lessor under this
17Section, the Authority may issue the violation to the lessee
18of the vehicle in the same manner as it would issue a violation
19to a registered owner of a vehicle, and the lessee may be held
20liable for the violation.
21    This Section shall not apply to vehicles that are stopped
22or standing in a restricted area if:
23        (1) a person is yielding to an emergency vehicle;
24        (2) the vehicle malfunctions;
25        (3) a person was directed to stop the person's vehicle
26    by a law enforcement officer;

1        (4) the vehicle was stolen prior to violation and not
2    controlled by the registered owner of the vehicle; or
3        (5) the driver of the vehicle received a Uniform
4    Traffic Citation from a police officer at the time of the
5    violation for the same offense.
6    As used in this Section, "traffic route" refers to all
7routes within the defined radii, including routes that are
8under the jurisdiction or partial jurisdiction of the
9Department.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
